Trump is absolutely correct and what is happening in the court system is alarming.  Yes, I believe that this is nothing more than election interference and keeping him from campaigning.  The left IS afraid of him. 

However, I still fear that if they do incarcerate him, he'll never get out.   **nononono*

One thing so far is for sure, Trump is not backing down.

We are well into the third week of the Manhattan criminal trial against former President Donald Trump. Readers will recall this is the case brought by District Attorney Alvin Bragg in New York state court alleging that Trump falsified business records reflecting payments made to his former attorney, Michael Cohen.

The heart of the prosecution's claim is that, rather than payments for legal services, those payments were actually reimbursement to Cohen for monies he expended securing a non-disclosure agreement from Stormy Daniels ahead of the 2016 presidential election. As such, Cohen's testimony will be critical to the prosecution's case against the former president.

One problem with that: Michael Cohen. The disgraced former personal attorney for Trump has convictions for fraud and perjury on his resume — bona fides most attorneys look to avoid like the plague in any witnesses they intend to call to the stand. Given his history, attempting to weigh the credibility of Cohen's testimony under oath will approximate nailing Jell-O to the wall.

Stormy Daniels' lawyer testified Thursday that it was his "understanding" that the porn star had in fact had sex with Donald Trump when she signed a letter denying the tryst — that was written by the attorney — in January 2018.

“Did you understand at the time that you wrote this letter that Stormy Daniels had in fact had a sexual encounter with Donald Trump at some point?" prosecutor Joshua Steinglass asked Daniels' lawyer Keith Davidson.

“That was my understanding,” Davidson replied.

Trump, who has denied ever having sex with the adult film actress, sat silently at the defense table during Davidson's testimony.

Davidson also claimed that the $130,000 that Daniels received to buy her silence about the alleged one-night-stand "wasn’t a payoff, and it wasn’t hush money."

He prefers to describe the arrangement as a "consideration," he testified.

“Judge, last weekend, last weekend, President Trump’s rival, President Biden, said in a public forum — he talked about this trial, and he talked about a witness that’s going to be in this trial. He mocked President Trump,” Trump attorney Todd Blanche said, referring to President Joe Biden‘s speech at the White House Correspondents’ Association dinner on Saturday.

“Donald has had a few tough days lately. You might call it ‘stormy weather,'” Biden said during his speech.

Michael Cohen whined over the phone that Donald Trump still owed him $130,000 for paying porn star Stormy Daniels — and griped that he was stiffed on a spot in Trump’s White House, Daniels’ lawyer testified.

“Jesus Christ, can you believe I’m not going to Washington?” attorney Keith Davidson recalled Cohen saying during the Dec. 9, 2016, call.

Davidson also told jurors that Cohen ranted about not yet being paid back for the payoff to Daniels.

“I’ve saved that guy’s ass so many times, you don’t even know,” Cohen added, according to Davidson.

“That f--king guy’s not even paid me the $130,000 back,” Cohen said, referring to the Daniels payoff, Davidson said.

Michael Cohen, former President Donald Trump’s ex-lawyer and a key witness in his hush money trial, has quite a few detractors in the New York courtroom.

Prosecutors have been contributing to skepticism about their star witness by highlighting personality flaws and his alleged wrongdoing. Those prosecutors, jurors, and even the judge in the case have criticized Cohen’s actions. It may not make sense that prosecutors are using him as a critical cog in a machine that aims to convict Trump on 34 felony counts and could be undermining the former attorney’s credibility at the same time.

But it’s intentional.

Prosecutors are hoping the jury dislikes Cohen enough to reflect those feelings as a “boomerang” effect against Trump, who once called him a “very talented lawyer.” They are trying to put Cohen in a frame on their own terms — before the former president’s team can do so and discredit the prosecution’s calling of him as a witness.

Lawyer for Stormy Daniels denies that payment from Cohen was 'hush money'

Keith Davidson, lawyer for adult film actress Stormy Daniels, said in court Thursday that the $130,000 payment to Daniels was not “hush money,” but a “consideration” payment.

Manhattan Assistant District Attorney Johsua Steinglass pressed Davidson on the witness stand about Daniels’ statement in January 2018, which Davidson prepared for his client, that denied any relationship with Trump and said that her only interaction with Trump was “a few public appearances and nothing more.”

“Rumors that I have received hush money from Donald Trump are completely false,” the statement says.“I don’t believe that Stormy ever alleged that any interaction with Trump was ‘romantic,‘” Davidson testified Thursday. But it is his understanding that Daniels had a sexual encounter with Trump.

He also said the payment “wasn’t a payoff.”“It wasn’t a payoff. And it wasn’t hush money. It was consideration,” Davidson said. Davidson added that he would never use “hush money” to describe the money exchange.

He would only refer to it as “consideration.” “Consideration” is a contractual legal term for what someone gives in return for the promise to abide by a contract; in this case, money. The payment was labeled "legal fees" in Trump's accounting, which prosecutors allege amounted to fraud.

Steinglass asked about the truthfulness of the Daniels’ statement. Davidson replied, “I think it’s technically true.”

He continues that he doesn’t believe anyone alleged of a relationship between Daniels and Trump -- it was an interaction.Davidson said he believes a “relationship” to be an ongoing occurrence.

Jurors just heard Donald Trump's voice on a conversation secretly recorded by Michael Cohen in which Cohen tells Trump, "I need to open up a company for a transfer of all that info regarding our friend 'David.'"

“I’ve spoken to Allen Weisselberg about how to set the whole thing up,” Cohen adds to Trump on the recording, referring to the long-time chief financial officer of the Trump Organization.

“Let me know what’s happening, OK?” Trump can be heard saying.

Prosecutors did not immediately explain the relevance of the recording, or who "David" refers to.

But the publisher of the National Enquirer, which orchestrated a separate payoff to Trump's other alleged lover Karen McDougal, is David Pecker.

It appears that Cohen was not simply unethical but  delusional. Davidson testified that Cohen was irate that he was not going to made Attorney General.  Even when he was representing Trump, some of us questioned his status as an attorney, let alone as a future Attorney General.

In his cross-examination of expert witness Douglas Daus, defense attorney Emil Bove asked Daus why the 2016 Trump-Cohen recording on Cohen's phone abruptly cuts off, attempting to raise doubts about the integrity of the recording.

Daus suggested that he heard in the recording that another call was coming in, but Daus said he could not say with certainty why the recording ended.

"You don't have firsthand knowledge of why it cuts off?" Bove said.

Bove -- a former prosecutor with plenty of experience handling cellphone extractions -- then discussed with Daus the different ways to extract a device. For a brief moment, the tone of the cross-examination shifted from tense to friendly.  .  .  .

Former President Trump's criminal trial is scheduled to resume at 9:30 a.m. Friday morning with the prosecution's seventh witness, Doug Daus, to take the stand.

Daus is a computer forensic analyst with the district attorney's office. Yesterday, he testified about examining two cell phones that belonged to Trump’s former attorney, Michael Cohen. 

During Daus' testimony, an audio recording was played former Trump attorney Michael Cohen could be heard telling Trump that he (Cohen) has to open up a company to transfer funds to “our friend David.”  Cross-examination began towards the end of the day, and the defense was asking about the chain of custody of the phone. 

Before Daus, Keith Davidson, an attorney who once represented both Karen McDougal and Stormy Daniels, completed his testimony. He testified about various interactions with Cohen before and after the 2016 election.

Davidson said Daniels’ denial of an affair with Trump was technically true because he wouldn’t characterize the interaction between Trump and Stormy as romantic. He also said the money Cohen paid Stormy was not a payoff, but rather a “consideration.” The defense played audio recordings of Davidson where he can be heard admitting Cohen didn’t need authority from Trump to make the payment to Stormy.

Court will end early today at 3:45 p.m. to accommodate a juror's appointment.

Judge Juan Merchan took the bench and greeted former President Trump and his legal team on Friday morning as day 11 of Trump's criminal trial began.

Before witness testimony resumed, Merchan said he wanted to clarify any misunderstanding of his gag order on Trump, who moments ago complained that his constitutional rights were under attack because he is not permitted to respond to witnesses who are testifying against him.

"You have an absolute right to testify at trial," Merchan told Trump. "That is a constitutional right that cannot be infringe upon."

"The order restricting extrajudicial statements does not prohibit you from testifying in any way," the judge continued. He clarified the gag order does not apply to statements made on the witness stand and instructed Trump to inform his attorneys if he has any questions."

Earlier, Trump said his lawyers will appeal the gag order today. The former president was fined $9,000 this week for violating the order on nine separate occasions.

Hope Hicks, Donald Trump's ex-press secretary and his former top White House spokeswoman, is expected to take the stand as soon as today, the Washington Post reported.

Hicks served as Trump’s 2016 campaign press secretary and went on to hold several roles in the White House.

Her name has popped up a few times during Trump’s hush money trial, with ex-National Enquirer publisher David Pecker testifying that she was "in and out" of a key August 2015 meeting at Trump Tower.

Pecker testified that during the meeting, he told Trump and Michael Cohen he would be the campaign’s “eyes and ears” about any negative stories that could hurt Trump.

Hicks no longer works for Trump.

"Anyone who knows me knows these words don’t reflect who I am. I said it. I was wrong and I apologize," Trump says in the statement on Oct. 8, 2016.

Hope Hicks entered the courtroom wearing a black blazer. and a blue button down shirt. As she walked by the defense table, Trump turned his head slightly but the pair did not make eye contact.

Attorney Todd Blanche smiled at her as she entered through the witness door.

Hicks was in her office on the 14th floor at Trump Tower at the time of the email.

Hope Hicks testified that Donald Trump thought his comments with Billy Bush in the "Access Hollywood" tape were "pretty standard stuff for two guys chatting with each other."

“I know Mr. Trump felt this wasn’t good," Hicks said, recalling the moment Trump learned about the tape.

She said Trump called it "just two guys talking privately, locker room talk."

"It wasn’t something to get so upset over. He certainly didn’t," Hicks told prosecutors.

She later added, “He felt this was pretty standard stuff for two guys chatting with each other.”

Hicks recalled how she was a "little stunned" about the video that she knew was concerning and would "dominate the news cycle" the next several days.

"Obviously it wasn’t helpful, but there were a lot of layers to it that complicated where we were trying to go with the campaign," Hicks testified about the video, saying it was a "damaging development."

"This was pulling us backwards.”

In trump's defense, we are 11 days in, and I can't discern one law that has been broken.  There needs to be some scorched earth, cut them off at the knees with Bragg and James on this one.

I am hardly a Trump defender, but this bullshit should get some prosecutor doing some jail time themselves.

But Cohen had his own ideas.

“Instead … say: These accusations are completely untrue and just the latest despicable attempt by the liberal media and the Clinton machine to distract the public from the FBI’s ongoing criminal investigation into Secretary Clinton and her closest associates.”

Hicks read the email sent to her by Cohen on Nov. 4, 2016.

Hicks testified that "there’s just a little irony there" after reading the text aloud in court.

Other texts from Cohen included: “Call me," "Any news," and “Any news???”

Hicks said the Wall Street Journal story didn't get "any traction" despite initial fears.
