Judge Juan Merchan instructed jurors on how to handle the case as proceedings got underway in former President Trump's NY criminal case on Monday.

Merchan spoke with the jurors just before prosecutors made their opening statement. He explained the nature of evidence and how it will be presented to the court, and he emphasized that the indictment against Trump is not evidence of guilt.

He told jurors they are not allowed to ask questions, but they are allowed to take notes throughout the trial.

He also went on to instruct the jurors not to discuss the case with anyone, visit any places where the crime was alleged to have been committed, or read about and research the case outside of the courtroom.

Prosecutors are seeking to establish that Trump's hush money payment to pornography actress Stormy Daniels was in fact a campaign contribution that went unreported. Trump argues the payment was not directly related to his 2016 campaign.

Anyone get the feeling that a 'guilty' verdict is already likely? 

Also, I think it could be probable that all what is happening surrounding Trump and his legal woes maybe also be a diversion to what else is happening to our country.  People are very focused on this. Border?  Economy?  Mob rule?  Should be more of a focus.  Just a thought here.

An observation about the prosecution's approach:  they are claiming that paying someone to suppress information about something not related to the conduct of government during the run-up to an election is "election fraud".  What then is pressuring tech companies with threats of onerous regulations, trotting out ex-intelligence-service-officials to lie and say that real evidence of at least potential corruption in the conduct of official duties is not real, but "Russian disinformation"?  Surely it, too would be election fraud under the prosecution's construction of the notion.
And when they behead your own people in the wars which are to come, then you will know what this was all about.

Anything more than $10,000 would need to be vetted for approval, he testified.

NEW YORK — A New York judge said Monday that Manhattan prosecutors can bring up several civil lawsuits involving former President Trump if he chooses to testify in his ongoing criminal trial.

After hearing arguments Friday, Judge Juan Merchan ruled that prosecutors can cross-examine Trump about six of the 13 prior court determinations they requested to raise in their efforts to impugn the former president’s credibility in front of jurors.

Merchan ruled that prosecutors are permitted to question Trump about two rulings — one by a judge, the other by a jury — finding that Trump defamed advice columnist E. Jean Carroll by denying her claims of sexual assault.

The judge said prosecutors can also raise the decision in Trump’s civil fraud trial finding that he fraudulently manipulated property values as well as rulings finding that Trump violated the gag order in that case. Trump can also face questioning about a 2018 ruling in a lawsuit against his foundation.

But Manhattan District Attorney Alvin Bragg (D) cannot bring up sanctions imposed against Trump in a lawsuit he filed against Hillary Clinton in Florida, the judge ruled, as well as several other “bad acts” prosecutors desired to cross-examine Trump about.

Merchan’s ruling is designed to give Trump’s legal team an informed view as it mulls whether the former president should take the stand in his defense.

Jonathan Turley left in ‘utter disbelief’ over DA’s case against Trump

Fox News contributor and legal expert Jonathan Turley said former President Donald Trump’s trial in Manhattan over allegedly falsifying business records has left him “in utter disbelief.”

“What is clear, is in this case, Trump is right. I mean, this is an embarrassment. I mean, the fact that we are actually talking about this case being presented in a New York courtroom, leaves me in utter disbelief. I mean, the the arguments today did in fact capture all the problems here,” Turley said Monday afternoon on Fox News.

"You had this misdemeanor under state law, that had run out, this is going back to relate it to the 2016 election. And they zapped it back into life by alleging that there was a campaign finance violation under the federal laws that doesn't exist," he said.

Turley was reacting to the trial Monday, which has officially kicked off in earnest after jury selection last week, as well as a recent poll finding 31% of Americans find Trump’s behavior at the crux of the case unethical, but not illegal. While an additional 14% said there was “nothing wrong” with Trump’s actions, and 35% who said his actions were “illegal.”

“This case should not have been brought , and if it were brought, there was no reason to have this right before the election in my view. But this is becoming the split screen election,” Turley said. “Earlier it was pretty damaging to see the split screen between Trump in different courtrooms. This is even more effective when the other side of the screen shows Biden campaigning in key states like Pennsylvania, while he's held in this courtroom."

“It really brings home something that bothers a lot of Americans, including people don't particularly like Trump, that this is the weaponization of the criminal legal system. It's something we should all be able to condemn."

Court wrapped up around 12:30 on Monday, earlier than initially anticipated, after a juror experiencing a toothache required a dental appointment.

I didn't think Trump could have limited the Cross-X anyway, and if I were he, I would not take the stand for Direct.  It would have the added effect of shocking the heck out of everybody, to boot!

NEW YORK — Attorneys for Donald Trump unveiled their defense strategy during opening arguments in his hush money case on Monday, largely choosing to dispute the laws under which prosecutors have charged Trump rather than the allegations themselves.

For the defense’s opening statement, Trump lawyer Todd Blanche told the jury that Trump was not involved in nor aware of the specifics of hush money payments because Trump left it up to his former lawyer and fixer Michael Cohen to manage. Blanche said his client had “nothing to do with” creating 34 checks, the hush money along with other compensation to Cohen, or the allegedly falsified entries on the ledger.

But he said many elements of the indictment against Trump seek to criminalize actions that are not actually illegal.

“Entering into a nondisclosure agreement is perfectly legal; companies do that all the time,” Blanche said. “There’s nothing illegal about that.”

Prosecutor Matthew Colangelo objected after Blanche said that Stormy Daniels’s allegations that she and Trump had an affair were almost an “attempt to extort President Trump.” Justice Juan Merchan sustained the objection on Blanche’s comment, and the attorney continued.

Trump trial: Judge to decide if former president violated gag order

Manhattan District Attorney Alvin Bragg will urge a judge on Tuesday at a hearing to hold Donald Trump in criminal contempt for allegedly violating a gag order in the former president’s hush money case in New York.

Bragg has claimed Trump violated the order at least 10 times and has argued to Judge Juan Merchan that a contempt finding should be accompanied by sanctions of $1,000 per gag order violation and a warning that additional violations would result in a punishment of prison time.

Merchan appeared poised to consider holding Trump in contempt seriously after he scheduled the hearing on the matter and ordered Trump’s attorneys to respond in writing ahead of the hearing with reasons why the former president should not be penalized for his comments.

Merchan issued the gag order on April 1, effectively banning Trump from speaking about witnesses in the case, prosecutors and their families, and court staff and their families.

While Merchan acknowledged in the order that courts are “understandably concerned” about Trump’s right to free speech, the judge said Trump’s verbal attacks on those involved in his legal proceedings served to intimidate witnesses or officials and therefore interfered with the court process.

“The People provide a plethora of compelling arguments in support of their claim that Defendant’s conduct is deliberate and intended to intimidate this Court and impede the orderly administration of this trial,” Merchan wrote.

On April 15, prosecutors filed three examples of alleged gag order violations, which involved Trump making references to Michael Cohen and Stormy Daniels, two known witnesses in the case who are both aggressively outspoken about Trump in their own rights.

Prosecutors allege Trump violated gag order 10 times

Fox News' Brooke Singman appeared on the channel to give an update on former President Trump's New York trial on Tuesday.

Prosecutors with Manhattan District Attorney Alvin Bragg's office argue Trump has violated a gag order imposed by Judge Juan Merchan. They say Trump has made 10 violations so far and they called on Merchan to impose a $1,000 fine for each alleged infraction.

Merchan has set aside Tuesday morning to discuss the alleged violations. Trump's defense team says none of the examples provided by prosecutors constitute a violation.

Gag order talk will end around 11 a.m., at which point former National Enquirer publisher David Pecker will return to the witness stand.

Judge loses patience with Trump's attorney: 'I'm asking the questions'

Justice Juan Merchan seems to be losing his patience with defense attorney Todd Blanche who is trying to defend Trump's posts that allegedly violate a gag order.

"I'm asking the questions. I'm going to be the one who decides whether your client is in contempt," the judge said.

He then added, "I keep asking you over and over again for a specific answer, and I’m not getting an answer."

Blanche has been spending the morning defending Trump's comments, which he said were in defense of public criticism by Stormy Daniels and Michael Cohen.

The attorney had spent several minutes speaking about Cohen's mention of a "pardon" and why Trump felt like he had to defend himself, which seemed to irk the judge.

“When your client violates a gag order, I expect more than one word," the judge seethed, referring to Blanche's close focus on the word "pardon."

Trump briefly spoke with defense attorney Emil Bove during Blanche's bout with the judge.

Trump compared himself in the post to Nelson Mandela, the South African activist who was repeatedly jailed for protesting his government's apartheid regime.

The judge just blasted Trump lawyer Todd Blanche for insisting that Trump is "trying to comply" with the gag order.

"Mr. Blanche, you are losing all credibility with the court," Judge Merchan seethed.

Merchan also ripped Blanche for "not offering me anything to support your argument," and not citing a single prior court ruling, or "case law," to support his claims.

“I don’t have any case law to support that, but its common sense," Blanche said earlier in the hearing.

Former President Trump's legal team attempted to justify Trump's alleged gag order violations by arguing they only came in response to attacks by witnesses Michael Cohen and Stormy Daniels on Tuesday.

When Judge Juan Merchan asked for specific examples of what attacks Trump was responding to, however, attorney Todd Blanche could not identify one. The latest exchange in the New York vs. Trump trial left Merchan visibly annoyed, warning Blanche that we was "losing all credibility with the court."

Blanche objected, saying the prosecution had taken as much time as they desired to discuss the gag order violations earlier that morning.

"They were answering my questions," Merchan responded.

"[The DA's office] has presented 10 exhibits and the defense has presented nothing," he continued. "I’ve asked you eight or nine times, ‘show me the exact post that he was responding to’ and you haven’t been able to do that once."

Blanche had attempted to justify some of Trump's other alleged gag order violations by arguing that they were political in nature and that he could not be expected to remain silent as a presidential candidate. He also said situations where Trump is merely reposting an article from a third party, such as a news outlet, cannot constitute a violation.

Merchan objected to that line of argument, however, asking how such an article would appear on Trump's account without Trump approving it.

“It’s your client’s position that when he was reposting these things, he was not violating the gag order?" Merchan asked.

Pecker says he helped hatch plan to bury women's stories about Trump before 2016 election

David Pecker worked with Donald Trump and Michael Cohen to identify and "kill" women's stories about Trump before the 2016 election, he testified just now.

"They asked me what can I do and what my magazines can do to help the campaign," Pecker testified.

"Thinking about it, I said what I would do is I would run or publish positive stories about Mr. Trump, and publish negative stories about his opponents," Pecker added.

"I said I would be your eyes and ears, and then I said that anything I hear in the marketplace, if I hear anything about women selling stories, I would notify Michael Cohen," Pecker testified.

Could Pecker turn on Trump?  This could get  bad.

Some negative stories about Ben Carson, Ted Cruz shown to jurors

Jurors are now being shown some of the National Enquirer's attacks on Ben Carson and Ted Cruz during the 2016 presidential campaign.

One negative story attacked Carson on Oct. 7, 2015, with the headline, "Bungling Surgeon Ben Carson Left sponge in patient’s brain!"



Two critical Cruz headlines were, "Ted Cruz Shame By Porn Star," published on Feb. 12, 2016, and "Boozin' Ted Cruz Fixin' to Lose," published on Feb. 19, 2016.

David Pecker said he would speak to Michael Cohen, then Trump's attorney, who would comment on them and adjust the stories if they needed tinkering.



"We would send him PDFs of the story before it was published to show him the direction the story was going," Pecker said about his correspondence with Cohen at the time.

He added that Cohen "would comment on them."

"We would add content... based on the information Michael Cohen shared," Pecker said.
