The stunning turn of events came more than 90 minutes into the hearing at the federal courthouse in Wilmington, Del., where Hunter was expected to plead guilty to two misdemeanor counts of willful failure to pay taxes and enter a diversion program on a felony federal weapons charge.

Prosecutors admitted under questioning from US District Judge Maryellen Noreika that President Biden’s 53-year-old son still could be charged with offenses including failing to register as a foreign agent for lucrative dealings in countries such as China and Ukraine that allegedly involved his father.

“As far as I’m concerned, the plea agreement is null and void,” defense attorney Chris Clark reportedly told the court in response a little before noon.

Both sides then tried to move forward with a revised plea deal that specified Hunter would face no additional charges linked to tax crimes from 2014 to 2019 — or any counts involving his drug use and associated gun ownership crimes. However, Noreika indicated that agreement was unacceptable as well, leading the first son to change his plea

However, it was far from clear whether Noreika would accept the revised agreement.

Hunter Biden's plea deal fell apart during his first court appearance Wednesday morning and pleaded "not guilty" as federal prosecutors confirmed the president's son is still under federal investigation.

The president's son was expected to plead guilty to two misdemeanor tax counts of willful failure to pay federal income tax, as part of plea deal to avoid jail time on a felony gun charge.

But Judge Maryellen Noreika did not accept the plea agreement, questioning the constitutionality--specifically the diversion clause and the immunity Hunter Biden would receive.

The judge pressed federal prosecutors on the investigation and questioned whether there was the possibility for future charges, and asked prosecutors if Hunter Biden was currently under active investigation. Prosecutors said he was, but would not answer specifically what the president's son is under investigation for.  .............

My guess is that if they had not tried to pull those last-minute shenanigans with getting the amicus brief from the republicans taken out, the judge would probably have accepted some form of this plea agreement.

President Biden has pardon power over all federal charges. I fully expect Joe Biden to pardon Hunter on anything and everything the feds can or will charge against him. The pardon power is broad and can be used on current and future charges as long as you know which ones... and in this case, dad will know from his son which charges he should be pardoned on.

On the way out the door, maybe?  Any interference that obvious would stink to high heavens, and the vultures are already circling Biden.

This just in: The judge won't accept the proposed plea deal at least for now.
Some thoughts: Now we know why DOJ didn’t show us the plea agreement terms. What didn't they want us to know ahead of time? A) a global immunity deal for Hunter; B) A binding plea (that is, the judge must accept the specific terms if she accepts the agreement); C) Misdemeanor probation; D) Other unusual plea terms.
1. A global immunity deal for Hunter while the overall investigation is “ongoing”, is stunning—a super-sweetheart deal.
2. A binding plea is extremely unusual in the vast majority of federal jurisdictions. It means for example, that if the agreement calls for probation the judge must give Hunter probation. It is binding.
3. That the prosecution and defense would disagree about the terms of the agreement in open court is a joke.  Ambiguous terms in a plea agreements are construed against the government! There should be no room for disagreement on the key terms of the agreement. So, this was either astounding incompetence or corruption on DOJ’s part. I think it is corruption. This looks like a wink and a nod deal (as @shipwreckedcrew
 has noted) where DOJ would have plausible deniability if the judge asked no questions and accepted the deal. The scope of immunity is the most important feature of a plea deal. It is inconceivable that the prosecutors were incompetent here. Leo Wise has an excellent reputation for competence.
4. Think about this. DOJ was about to sanction a plea deal where Hunter would get misdemeanor     probation on serious tax charges plus pretrial diversion (no time served or criminal record) on the felony gun charge. Hunter would also get complete immunity on all other charges. And he would not have to cooperate with the government’s ongoing investigation. Totally disgraceful. Merrick Garland and David Weiss should be ashamed. And where is Lisa Monaco? Why hasn't she been called to testify?

🚨 BREAKING UPDATE: Before Hunter Biden's plea deal collapsed, Federal Judge Maryellen Noreika asked the case's top prosecutor if the deal meant Hunter would be IMMUNE from prosecution for other possible crimes—including those related to representing foreign governments.

The prosecutor said NO, then one of Hunter's attorneys jumped up and said "then there's no deal!"

Reporters present in the courtroom have said the judge seemed highly skeptical of the "unusual deal" from the get-go, as it offered Hunter Biden BROAD immunity from prosecution in perpetuity.

The new "Conditions of Release" for Hunter Biden have just hit the docket, signed by Judge Maryellen Noreika, who shelved Hunter's plea deal today

If Hunter does NOT comply with any part of the order, he could be immediately arrested

HUNTER IS REQUIRED TO:

1) NOT possess a firearm
2) NOT use or possess any controlled substances (including marijuana) unless prescribed
3) Submit to full federal supervision
4) NO use of alcohol AT ALL
5) Seek active employment
6) Submit to testing for prohibited substances
7) Participate in substance abuse therapy

PENALTIES FOR VIOLATING COULD INCLUDE:

1) Immediate issuance of an arrest warrant
2) Revocation of release
3) Forfeiture of bond
4) Prosecution for contempt of court

The judge in Delaware did something not a single judge in DC has done in standing up to Jack Smith; she refused to rubber stamp the Biden-Garland DOJ's steamrollering over our justice system.  The corruption is palpable.  And she wanted no part of it.  And every federal judge participating in this tyranny, particularly in DC, will long be remembered as disgraceful partisans who defied their obligation to do justice and the Constitution.

Based on conversations with people who were in the courtroom today, and my experience as a former federal prosecutor, I think I know the full story of what happened with the Hunter Biden plea agreement blow-up this morning.

Bear with me, because this is a little complicated:

Typically, if the Government is offering to a defendant that it will either drop charges or decline to bring new charges in return for the defendant's guilty plea, the plea is structured under Federal Rule of Criminal Procedure 11(c)(1)(A).  An agreement not to prosecute Hunter for FARA violations or other crimes in return for his pleading guilty to the tax misdemeanors, for example, would usually be a (c)(1)(A) plea.  This is open, transparent, subject to judicial approval, etc.

In Hunter's case, according to what folks in the courtroom have told me, Hunter's plea was structured under Federal Rule of Criminal Procedure 11(c)(1)(B), which is usually just a plea in return for a joint sentencing recommendation only, and contained no information on its face about other potential charges, and contained no clear agreement by DOJ to forego prosecution of other charges.

Instead, DOJ and Hunter's lawyers effectively hid that part of the agreement in what was publicly described as a pretrial diversion agreement relating to a § 922(g)(3) gun charge against Hunter for being a drug user in possession of a firearm.

That pretrial diversion agreement as written was actually MUCH broader than just the gun charge. If Hunter were to complete probation, the pretrial diversion agreement prevented DOJ from ever bringing charges against Hunter for any crimes relating to the offense conduct discussed in the plea agreement, which was purposely written to include his foreign influence peddling operations in China and elsewhere.

So they put the facts in the plea agreement, but put their non-prosecution agreement in the pretrial diversion agreement, effectively hiding the full scope of what DOJ was offering and Hunter was obtaining through these proceedings.  Hunter's upside from this deal was vast immunity from further prosecution if he finished a couple years of probation, and the public wouldn't be any the wiser because none of this was clearly stated on the face of the plea agreement, as would normally be the case.

Judge Noreika smelled a rat. She understood that the lawyers were trying to paint her into a corner and hide the ball. Instead, she backed DOJ and Hunter's lawyers into a corner by pulling all the details out into the open and then indicating that she wasn't going to approve a deal as broad as what she had discovered. 

DOJ, attempting to save face and save its case, then stated on the record that the investigation into Hunter was ongoing and that Hunter remained susceptible to prosecution under FARA. Hunter's lawyers exploded. They clearly believed that FARA was covered under the deal, because as written, the pretrial diversion agreement language was broad enough to cover it. They blew up the deal, Hunter pled not guilty, and that's the current state of play.

And so here we are. Hunter's lawyers and DOJ are going to go off and try to pull together a new set of agreements, likely narrower, to satisfy Judge Noreika. Fortunately, I doubt if FARA or any charges related to Hunter's foreign influence peddling will be included, which leaves open the possibility of further investigations leading to further prosecutions.

Is there any real possibility  of additional charges coming out of this court case?

I suspect there is very little change of Hunter pleading guilty to any felonies,and surely there are felony charges pending for influence peddling and other crimes. What are the chances of any  felonies being prosecuted once the Biden Crime Family is out of office,given the FACT that the DNC is likely  to  use every resource it has to prevent this from happening because at this point there seems to be no way of escaping the fact that the DNC knew all about this and did nothing to stop it.

Wouldn't it be interesting if this case were still open if/when Trump is sworn into office,and Hunter was offered a deal to testify  against prominent DNC members who  knew,but  remained quiet about felonies that were committed because his father was President?

Could a conspiracy charge be brought forward and have any chance of being brought to court?

BTW,what would be the reaction of you  Trump haters if this did happen?

I am now a lawyur and doan even play one on teebee,but HOW  can someone pay someone else's taxes unless they are their legal representatives?

In addition,IF they are the legal representatives of someone who has been committing felonies and indications are that they were helping to cover these felonies up,can they  also be charged as an accomplice?
