Attorney General Merrick Garland has assigned the U.S. attorney in Chicago to review classified documents found at the Penn Biden Center for Diplomacy and Global Engagement in Washington, two sources with knowledge of the inquiry told CBS News. The roughly 10 documents are from President Biden's vice-presidential office at the center, the sources said. CBS News has learned the FBI is also involved in the U.S. attorney's inquiry.

The classified material was identified by personal attorneys for Mr. Biden on Nov. 2, the day before the midterm elections, Richard Sauber, special counsel to the president confirmed. The documents were discovered when Mr. Biden's personal attorneys "were packing files housed in a locked closet to prepare to vacate office space at the Penn Biden Center in Washington, D.C.," Sauber said in a statement to CBS News. The documents were contained in a folder that was in a box with other unclassified papers, the sources said. The sources revealed neither what the classified documents contain nor their level of classification. A source familiar told CBS News the documents did not contain nuclear secrets.

Sauber also said that on the same day the material was discovered, Nov. 2, the White House counsel's office notified the National Archives, which took possession of the materials the following morning. ... CBS News

Special counsel to the president Richard Sauber said “a small number of documents with classified markings” were discovered as Biden's personal attorneys were clearing out the offices of the Penn Biden Center, where the president kept an office after he left the vice presidency in 2017 until shortly before he launched his 2020 presidential campaign in 2019. The documents were found on Nov. 2, 2022, in a “locked closet” in the office, Sauber said.

A batch of records from President Biden's time as Vice President, including a "small number of documents with classified markings," were discovered at the Penn Biden Center by the president's personal attorneys on Nov. 2, according to Richard Saubel, special counsel to the White House. 

The attorneys found the documents in a locked closet while preparing to vacate office space at the center, which the president used from mid-2017 until he began the 2020 campaign. 

The National Archives were notified of the finding and took possession of the documents on Nov. 3, Saubel said. 

"The documents were not the subject of any previous request or inquiry by the Archives," Saubel said in a statement. "Since that discover, the President's personal attorneys have cooperated with he Archives and the Department of Justice in process to ensure that any Obama-Biden Administration records are appropriately in the possession of the Archives."

1) Oversight Cmte Chair Comer on Biden/classified documents: We asked the National Archives question for information when they raided Mar-A-Largo. And the only response we got was they referred us to the Department of Justice.

2) Comer: In the research we did at the time, every president had accidentally packed documents that may or may not be considered classified, but they weren't raided. Now we find out the current President actually accidentally had classified documents.

    Several classified documents from President Joe Biden’s time as vice president were discovered last fall in a private office, Biden’s attorneys acknowledged Monday.

Attorney General Merrick Garland has asked the US attorney in Chicago to investigate the matter, a source familiar with the matter tells CNN, and congressional Republicans are also taking notice.

Biden’s lawyers say they found the government materials in November while closing out a Washington, DC-based office – the Penn Biden Center for Diplomacy and Global Engagement – that Biden used as part of his relationship with the University of Pennsylvania, where he was an honorary professor from 2017 to 2019.

Fewer than a dozen classified documents were found at Biden’s office, another source told CNN. It is unclear what the documents pertain to or why they were taken to Biden’s private office….

The classified materials included some top-secret files with the “sensitive compartmented information” designation, also known as SCI, which is used for highly sensitive information obtained from intelligence sources.

The White House on Monday disclosed that lawyers for President Biden discovered what they called a “small number” of classified documents in November in an office Biden had used between his time serving as vice president and president.

The documents were turned over the next day to the National Archives, and the White House said it is cooperating with the Department of Justice (DOJ) as it conducts a review of the documents.

The news quickly drew comparisons to former President Trump, who has been in hot water over his potential mishandling of classified materials upon leaving office two years ago.

Among the items from Joe Biden’s time as vice president discovered in a private office last fall are 10 classified documents including US intelligence memos and briefing materials that covered topics including Ukraine, Iran and the United Kingdom, according to a source familiar with the matter.

Attorney General Merrick Garland has received a preliminary report on the documents inquiry, a law enforcement source said, and now faces the critical decision on how to proceed, including whether to open a full-blown criminal investigation.

John Lausch Jr., the US attorney in Chicago, has briefed Garland multiple times. No additional briefings are scheduled but would be conducted if necessary, a source said.

The classified documents were dated between 2013 and 2016, according to the source familiar. They were found in three or four boxes also containing unclassified papers that fall under the Presidential Records Act.

 The vast majority of the items in the office contained personal Biden family documents, including materials about Beau Biden’s funeral arrangements and condolence letters, the source told CNN. It is not clear if the boxes with classified documents contained personal materials.

Attorney General Merrick Garland has assigned the US attorney in Chicago, a holdover from the Trump administration, to investigate the matter, CNN previously reported. Garland made this move after receiving a referral from the National Archives and Records Administration.

What a crazy Wednesday morning!

If you are just waking up, the FBI conducted a massive raid last night on an office maintained by Joe Biden in Washington, D.C., along with pre-dawn raids at his homes in Delaware, in search of classified documents improperly removed from the White House when his term as vice president ended. Sources confirm that the agents also went through the closets of First Lady Jill Biden, along with the rooms of Biden’s children Hunter and Ashley.

Wait. You haven’t heard about it yet? That’s because it did not happen. It did not happen because Joe Biden’s name is not Donald Trump … and Joe Biden is a Democrat sitting atop a politically corrupted Department of Justice.

One part of the story is true: Highly classified documents were discovered at a private office Biden had in D.C. via the Penn Biden Center. (More on the center in a bit.)

What we’re being told is that Biden’s lawyers found the dozen or so classified documents at the private, unsecure office while packing it up in early November. Not that Biden uses it. Heck, he barely uses the Oval Office. His peeps contacted the National Archives. Nothing more to see. Move on. The stash is absolutely positively nothing at all like the documents Trump had in his possession that warranted the overwhelming prime time assault on Mar-a-Lago.
