Harvard should turn over the photos, not because they are compelled to by law, but because it would be the decent thing to do.  If plaintiff wants to exploit the photos of her relatives for her own personal gain and further demean the progress of the last 150 years, then by all means let her.
If a political party does not have its foundation in the determination to advance a cause that is right and that is moral, then it is not a political party; it is merely a conspiracy to seize power.     -Dwight Eisenhower-

"The [U.S.] Constitution is a limitation on the government, not on private individuals ... it does not prescribe the conduct of private individuals, only the conduct of the government ... it is not a charter for government power, but a charter of the citizen's protection against the government."     -Ayn Rand-

Sounds like the photos didn't belong to the subjects in the photos, not in 1850, and thus not now.

Sounds like the courts made the correct ruling.

And the property is 170 years old and thus certainly in the public domain, right?

Just because Hahvahd is evil and racist doesn't mean some reparations-greedy broad can rob them.
The GOP is not the party leadership.  The GOP is the party MEMBERSHIP.   The members need to kick the leaders out if they leaders are going the wrong way.  No coddling allowed.
