The "rule" he's mentioning is when one party holds the Senate and another party the Presidency in a presidential election year. In this situation the Senate doesn't vote on a nominee until after the election. It's not hard to figure out why. If there's an opening in 2020 on the SCOTUS I expect a Pub majority to support Trump's nominee.
