If you call it a "tax"  then it wasn't passed legally.  All "Tax"  bills must originate in the House.  Congress went out of it's way to avoid calling it a "Tax"  because that would have made the whole affair illegitimate.   


With this utter *IDIOT*  decision by Roberts,  he is trying to have it both ways.   It is a *TAX*  for purposes of the Supreme Court allowing it to stand,   but it is *NOT A TAX*  for the purposes of passing it into law. 


Roberts just had a bad case of "Black President" worship,  and just had to follow his fetish.


I think he and his family was threatened by the Obama Thugocracy.

Judge Napolitano gave a succinct summation of the situation.

The law assed by Congress, giving plenary (absolute) authority over immigration suspensions such as this, and makes NO mention of previous campaign statements, Presidential motives, etc.

So when the three-judge panel goes off in those directions, they are WRONG.

Yet Napolitano said he was less optimistic, after hearing them last evening.

If we remain a nation of laws, the President is entitled to have THIS LAW be enforced by the judiciary.

Obviously holding up Session's appointment, using the 9th District, and delaying the appointment of the 9 Justice to the SC all tie together.

In the meantime, if a single terror incident can be tied to this ongoing obstruction by the dems and their judiciary comrades, the blood will be on them alone.

Under our Constitution  the judiciary has exactly zero power to enforce a law.  That power is ENTIRELY vested with the executive.  The judiciary does one thing only.  It renders opinions!

That first happened in a case called Marbury vs Madison.  It has happened on numerous occasions since.  The fact is that none of the three brances of our government can tell another branch what to do.

I have seen that theory being bandied about ever since the decision.   They claim he had illegally adopted children from Ireland and Obama used that to threaten him. 



My own theory is that he was so inspired to demonstrate how non-racist he was (virtue signaling) that he bent himself into legal contortions to rescue the signature legislation of the "FIRST BLACK PRESIDENT!"   


I have a lot of reasons for believing Roberts is so in love with the idea of a "Black" President that he would eschew common sense in his Obamacare decision,  but i'll just mention one. 

Robert's Flubbed the Oath of Office which he administered to Obama.   I interpret that as his being so emotionally involved that he couldn't keep his thoughts straight.   

He was so aware of the "HISTORIC"  significance of the event in which he was participating that he became emotionally choked up.   


Roberts is a "Black President"  groupie.

I just find it humorous that even the man that everyone claims is the best pick Trump could make for SCOTUS thinks his tweets attacking judges is wrong.

So when the court declares the EO as discriminatory, and Trump turns around and cancels ALL Green Cards, Visas worldwide, the only recourse the courts have is  8888crybaby

I'd think anyone who thought their toes were being stepped on would have a similar reaction. We all have an ego and don't like when we think someone gored our ox.

Besides, it would be one more thing the left would bitch about if he didn't and he wants to get confirmed. So  he's patting their heads and playing the game to get the job as painlessly as he can.

He should know better but thats another issue.

A point I have made repeatedly.   The courts cannot win this.   They are going to make fools of themselves if they go against Trump.   All he has to do is order State to revoke Visas and he's got the same result.

One of the reasons America is in the shape it's in is that people lack a basic civics education. What is disturbing is that self identified conservatives do not understand the basic separation of powers, much less the responsibilities of those powers of office granted by the constitution.

Then they go out on the internet and spread completely mistaken information through their arguments. To semi-paraphrase trump, any kid that ever watched Schoolhouse Rock would know this stuff...and we should be arguing points based on fact and merit. Not how we wish things were.

It's ridiculous. Most of the freakout over this EO is down to two things. A lack of understanding of basic civics and making Trump out to be a Dictator. When Trump hoses something he should be called on it. But this ain't something he hosed. That people got butthurt over his tweets does not impact the legality of the order. And although it has been repeatedly pointed out that this very issue has been trough the courts in several forms, that 6 presidents have done exactly this and that just because one does not like a thing, one does not get to reinvent constitutional law and authority to win arguments on the internet, the nonsense carries on.

Civics people. Learn it before making mistaken declarative statements and screaming about bigots and dictators. You don't have to like it. But it's the laws we all are SUPPOSED to live under.
