Court Liberates Employers from Red Tape, Strikes Down Another Unlawful Labor Rule

On December 12, 2016, the federal Northern District Court of Texas put the final nail in the coffin [1] of the Department of Labor’s misguided persuader rule. The lawsuit brought by the National Federation of Independent Business argued that the rule violated free speech and undermined attorney-client privilege. Thankfully, the Court agreed and set aside the rule as unlawful [2] in a November ruling.

In short, the persuader rule imposed onerous reporting and public disclosure requirements on employers that contract with labor relations consultants for advice on how to respond to union organizing campaigns. Previously, employers only had to disclose hiring labor consultants when they directly come into contact with employees.
