The head of a Texas company building the $3.8 billion Dakota Access pipeline told employees Tuesday that it is committed to the project despite strong opposition and a federal order to voluntarily halt construction near an American Indian reservation in North Dakota.

The memo to employees, which was also released to some media outlets, is the first time in months the company has provided significant details of the four-state, 1,172-mile (1886-km) project.

It came the same day as a planned "day of action" in cities around the U.S. and in other countries, including a rally that drew hundreds in Washington to hear Sen. Bernie Sanders and others speak. Authorities also arrested 22 people for interfering with construction on the pipeline about 70 miles (113 km) northwest of the main protest site near the Standing Rock Sioux Reservation in North Dakota.

Energy Transfer Partners CEO Kelcy Warren told employee the pipeline is nearly 60 percent complete and that "concerns about the pipeline's impact on the local water supply are unfounded." The Standing Rock Sioux tribe and others argue the project will impact drinking water for thousands of tribal members and millions downstream.

"I am confident that as long as the government ultimately decides the fate of the project based on science and engineering, the Dakota Access Pipeline will become operational. ... So we will continue to obey the rules and trust the process," he wrote.

Standing Rock Tribal Chairman Dave Archambault II said he and the thousands of others who have gathered at an encampment in southern North Dakota to protest won't budge.

"People are still coming down here and are committed to stopping the project," he said.

The tribe is challenging the Army Corps of Engineers' decision to grant about 200 permits at water crossings for pipeline, which goes through the Dakotas and Iowa to Illinois. The tribe says the project will disturb sacred sites and impact drinking water. Energy Transfer Partners disputes those claims, saying the pipeline would include safeguards and that workers monitoring the pipeline remotely could close valves within three minutes if a breach is detected.

"We have designed the state-of-the-art Dakota Access pipeline as a safer and more efficient method of transporting crude oil than the alternatives being used today," his memo said.

The tribe's effort to temporarily block construction near its reservation was denied by U.S. District Judge James Boasberg on Friday. But minutes later, federal officials ordered a temporary halt to construction on Army Corps land around and underneath Lake Oahe — one of six reservoirs on the Missouri River. Three federal agencies also asked ETP for a "voluntary pause" in work for 20 miles (32 km) on either side of Lake Oahe.

ETP removed about 30 pieces of damaged or vandalized construction equipment from the area near the protest site Tuesday, according to Morton County Sheriff's Department spokesman Rob Keller. The company did not immediately respond to a request for comment on whether it has halted construction in that section or is backing down on its plans to build the pipeline, but has said construction continues elsewhere....

the federal order is in fact Obama attempting to over-ride the courts unconstitutionally.  Apparently, the Indian tribe is engaging in an old-fashioned shakedown.

Shipping oil via pipeline is less expensive and safer than by rail with fewer carbon emissions.

The Dakota Access would be a boon for the northern Plains, which has suffered more from the rout in oil prices than other regions with better access to markets. The pipeline would make Bakken crude more economical by reducing the shipping cost and supply glut at the source. It was on course to be finished by the end of this year.

The federal government ordered a halt to work on a $3.8 billion four-state oil pipeline in the Upper Midwest on Friday, handing a temporary victory to the Standing Rock Sioux tribe and other opponents of the project.

The unusual move by three federal agencies immediately followed a federal judge’s ruling denying an injunction sought by the tribe. The judge said the Dakota Access Pipeline would be able to proceed.

The U.S. Army Corps of Engineers said it wouldn’t authorize construction near Lake Oahe, a culturally important location to the tribe, until the agency determines if it needs to reconsider its previous approvals under the National Environmental Policy Act.

“This case has highlighted the need for a serious discussion on whether there should be nationwide reform with respect to considering tribes’ views on these types of infrastructure projects,” the Corps and the departments of Justice and Interior said in a joint statement.

The agencies also asked the pipeline’s builder to voluntarily halt work on either side of the lake....

Even Obama's Executive Dept. knows better than to try to directly and openly overrule a federal judge.

However, they are behind the scenes most certainly making it hell-on-earth for the pipeline company in any way they can.  OSHA as a start I bet.

Even Obama's Executive Dept. knows better than to try to directly and openly overrule a federal judge.

However, they are behind the scenes most certainly making it hell-on-earth for the pipeline company in any way they can.  OSHA as a start I bet.
Don't forget Mr. Trump's favorite agency, the EPA.

The Corps of Engineers, the BLM (Bureau of Land Management), Department of Interior, DOT, Tribal Police, etc. can all 'make life hard' for people who don't comply with 'requests'.
One of the claims is that this is "sacred land", a claim met with skepticism by many who have seen a shakedown before. But one of the 'supporting' organizations for the opposition movement is none other than the UN. Some 30 environmental organizations are lined up to bleed money out of  oppose the project. A certain candidate would just deliver the bag...
For North Dakota, the 470,000 BOPD operating, 570,000 BOPD takeaway capacity represents roughly half of the oil produced in the State, a reduction in rail shipment and transportation accidents, and a 4-5 dollar per barrel cost break for oil companies transporting the oil over rail costs. This means that completing DUC wells and drilling can proceed at a lower price threshold than it would if transport was limited to the rail option: that translates to more American oil, more jobs, and economic improvement over the current downturn.

The work is being stopped by U.S. Army Corps of Engineers near Lake Oahe.  They have requested a voluntary stop outside their jurisdiction as the work approaches both sides of the Lake.
