A New York judge decided Tuesday that a fraud case against Donald Trump over his former school for real estate investors will go to trial – raising the possibility that the Republican presidential primary front-runner could testify during campaign season.

New York County Supreme Court Judge Cynthia Kern made the decision at a hearing Tuesday, though it remains unclear whether the case will be weighed at a jury trial – which is what Trump’s team is seeking. Trump attorney Jeffrey Goldman said it’s possible the trial could be held this fall, and Trump could testify.

In the case, New York Attorney General Eric Schneiderman, a Democrat, has accused Trump and others of misleading thousands of students over the school.

Schneiderman alleges that Trump University was unlicensed since it began operating in 2005 and promised lessons with real estate experts hand-picked by Trump, only one of whom had ever met him. The attorney general said the school used "bait-and-switch" tactics, inducing students to enroll in increasingly expensive seminars.

Trump has denied any wrongdoing. He has said it was "a terrific school" with 98 percent approval ratings by its students.

Schneiderman had sued Trump and the school, which changed its name to the Trump Entrepreneur Initiative before it closed in 2010, for $40 million. The lawsuit seeks restitution and damages for more than 5,000 students nationwide, including 600 New Yorkers, who paid up to $35,000 each.

A New York court earlier had refused to throw out the fraud lawsuit.

Trump filed complaints with the state's ethics commission in 2013, four months after the lawsuit was filed, alleging Schneiderman pursued it to wring out campaign contributions from Trump's daughter Ivanka. The commission dropped the complaint after a review. Schneiderman denied it, and his campaign returned the $500 donation Ivanka Trump had made in 2012.

Trump's fellow Republican candidates have attacked him over litigation against the school, including a class-action suit in California. Trump criticized the judge in that case.

This was a major scam.  A corrupt enterprise from top to bottom from the get-go.

Trump has been involved in more than a few of these things.

We could have a Rat Nominee indicted and a Pub nominee being tried for fraud at the same time. I think it's unlikely hillary will be indicted. The justice dept will not pursue it unless her poll numbers drop, or she moves away from obama's positions. Trump will probably be found guilty and be forced to pay restitution. It will be just one more reason he'll lose in the general election.

I think it's a safe bet that if Trump becomes the nominee the media will start reporting on all his business dealings that had the slightest bit of illegality.

It's so frustrating to watch this slow moving train wreck that is Trump and not be able to get his followers to see it. On top of this, even though he is not a conservative everything he does will be used to discredit conservatism. It won't just be disinformation that the left will use with the public. It will be the GOPe itself that will use the Trump disaster as a reason to further marginalize conservatives.

Trump over and over again said, I could settle this lawsuit tomorrow. Why didn't he?   Because he doesn't have a legal leg to stand on.

I know I should care about them, but I don't. The damage will be imposed on me because of these people who followed Trump over the cliff. Conservatism had it's best chance in a generation to elect a real conservative POTUS. Because of Trump I doubt Cruz can win if he's able to get the nomination. We end up with hillary and probably lose the Senate. Nothing will change, spending will continue out of control, amnesty will be passed and the Pubs will be a permanent minority party.  It's a mess!

You can bet we will hear 24hrs a day about all this stuff and they will ask "why can't we see his tax returns". He is such a train wreck if he's the nominee he'll make hillary look like she actually knows something and is reasonable.

No big deal. They LOVE him in NY. Just look at the almost half a million that voted for him out of a 20 million population. There isn't a chance a jury will go against him.....is there?

BTW there has been a trend for a number of years to run for office or higher office to outrun illegal and embarrassing problems. Wonder if that is what is happening here?

He actually ran in 2000 under the Reform Party ticket and withdrew due to "party infighting."  I wonder who caused that.  :silly:  He went on to win the Michigan and California primaries. 

Think about it.  If he had stayed on the ticket in 2000, he could have handed Al Gore the election, just as he is about to elect Hillary Clinton.  Better late than never I suppose.
