Minnesota Officials Sue DHS to End ICE Surge

Legal Insurrection  by Mary Chastain Tuesday, January 13, 2026

Basically Minnesota: “Pay no attention to the man behind the curtain!”

Yeah, um, you don’t get to enforcement of federal law.

On behalf of Minnesota, Minneapolis, and St. Paul, Minnesota Attorney General Keith Ellison filed a lawsuit against the Department of Homeland Security to end the surge of ICE agents.

“This operation is driven by nothing more than the Trump Administration’s desire to punish political opponents and score partisan points—at the direct expense of Plaintiffs’ residents,” Ellison wrote in the lawsuit.
“Defendants’ actions appear designed to provoke community outrage, sow fear, and inflict emotional distress, and they are interfering with the ability of state and local officials to protect and care for their residents.”

In other words, “Pay no attention to the man behind the curtain!”

The lawsuit comes after an ICE agent shot and killed Renee Good after she tried to run him over.

Here are the allegations:

•   Violates the Tenth Amendment

•   Violation of Equal Sovereignty Under the U.S. Constitution

•   Administrative Procedure Act, 5 U.S.C. § 706(2)(A), (C) – Contrary to Law: Violation of State Law and City Ordinances

•   Administrative Procedure Act, 5 U.S.C. § 706(2)(A), (C) – Contrary to Law: Excessive Force

•   Administrative Procedure Act, 5 U.S.C. § 706(2)(A), (C) – Contrary to Law: Warrantless Arrests Without Individualized Assessment of Immigration Status

•   Administrative Procedure Act, 5 U.S.C. § 706(2)(A), (C) – Contrary to Law: Defendants’ Decision to Conduct Border Patrol Enforcement Action as if the Agents Are Near the Border

•   Administrative Procedure Act, 5 U.S.C. § 706(2)(A) – Arbitrary and Capricious: Revocation of 2021 Sensitive Locations Policy

•   Unconstitutional Retaliation in Violation of the First Amendment

•   Violation of the First Amendment – Viewpoint Discrimination

•   Ultra Vires Executive Action in Excess of Constitutional and Statutory Authority Conferred on the Executive

Watch CNN's Top Legal Analyst Gut Minnesota Dems' Laughable Anti-ICE Lawsuit

Matt Vespa | January 13, 2026 6:55 AM

There are no words: Minnesota Democrats are trying to sue the federal government into ceasing to enforce immigration law. It comes after more federal immigration officers are set to be deployed to the state, which has become a hotbed of left-wing lunacy following the shooting death of Renee Nicole Good, 37, who accelerated her vehicle toward an ICE agent on January 7. It was a good shoot—you can't run over cops, lady. That’s how you get three gunshot wounds to the face.

After an interview with Sen. Amy Klobuchar (D-MN) on CNN, host Anderson Cooper turned to Elie Honig, the network’s top legal analyst and former federal prosecutor, where he was blunt regarding this lawsuit’s chances of success in the courts: it has next to none.

Deploying Federalized National Guard is one thing, but, how can a state sue a Federal law enforcement agency to stop doing its job?

Dems are the Party of Lawlessness.

Minnesota Files Meritless Lawsuit to Stop Increase in Fraud Investigation and Immigration Enforcement

Yesterday, Minnesota Attorney General Keith Ellison, on behalf of the state and alongside the cities of Minneapolis and Saint Paul, filed a federal lawsuit that is most notable in the absence of any intelligible legal principle. The effort to stop the surge of federal personnel to investigate fraud and enforce immigration is breathtakingly frivolous and farcical.

Ellison has long been more advocate than attorney in his public life, even praising Antifa for instilling fear in Trump and Ellison’s political opponents.

Ellison has been actively trying to tamp down coverage of the massive fraud under his watch, including potentially billions meant to support children and impoverished families.

Recently, a tape was released in which Ellison met with Somali figures later convicted of fraud and agreed with them that they needed to support “candidates that will fight to protect our interests.”

I'm going out on a limb to suggest it isn't "meritless" in Minnesota! :judge:

Ellison is doing it to try to claim after he is indicted for fraud for his participation in the Scams there, that this is 'revenge' for his filing this lawsuit.

The criminal will once again claim he is the victim.
