It's about time someone proposed a bill to repeal the red flag laws that Rick Scott implemented while he was governor!
Rep. Joel Rudman files bill to repeal Florida’s red flag laws, allow open carryRepublican State Rep. Joel Rudman filed a bill for the 2025 Legislative Session that would repeal the state’s red flag laws, allow open carry and enact other measures to ease gun restrictions in the state.
“My first bill has been filed for the 2025 Legislative Session. And it reiterates my commitment to freedom and to the Constitution,” Rudman said. “My bill repeals Florida’s unconstitutional red flag laws and makes Florida an open carry state. ‘Shall not be infringed’ will mean something here in the Gunshine state!”
The bill, HB 31, would allow for open carry of firearms in most places and reduce restrictions on where guns can be carried.
HB 31 proposes several key changes to existing gun laws, including:
Open carry: Allowing the open carrying of legal firearms in most public places
Identification: A person carrying a concealed weapon, concealed handgun, or an unconcealed firearm must carry valid identification at all times and it must be displayed to law enforcement if asked.
Fees: Eliminates the nonrefundable license fee to carry concealed weapons or concealed firearms. Renewal fees were also eliminated.
Changes to risk protection orders
Current law says a law enforcement officer taking custody of a person may seize and hold a firearm or any ammunition the person has at the time of taking the person into custody if the person poses a potential danger to himself or others and has made a threat of violence against someone else.
The current law also says if the law enforcement officer takes custody of the person at their home, the officer may seek the voluntary surrender of firearms from the home...................
