Ketanji Brown Jackson Defends Using ‘Noncitizens’ Term to Describe Illegal Aliens: ‘Language Matters’

President Joe Biden’s nominee to replace Justice Stephen Breyer on the Supreme Court, Judge Ketanji Brown Jackson, defended her use of the term “noncitizens” to describe border crossers and illegal aliens in her legal opinions.

As Breitbart News previously reported, Jackson has made a note in her opinions to employ the term “noncitizen” or “undocumented non-citizens” rather than the terms “alien” or “illegal aliens” that are regularly used in court and in federal statutes.


During her third day of confirmation hearings before the Senate Judiciary Committee, Jackson defended using the terms “noncitizen” and “undocumented non-citizens” when referring to border crossers and illegal aliens.

“Judges are the only branch of government who are required to write our opinions, to explain our decisions,” Jackson said:

It seems to me a jurist should use the language written in the law so as to avoid ANY appearance of trying to lead the jury by using language that isn't written in the law. :judge:

I'm not a lawyer, but I did take vocabulary and grammar in grade school.

A "non-citizen" can also be a legal immigrant with temporary status, legal resident status, greencard, refugee officially granted asylum status.  So many "non-citizens" can still be legal residents.

"Illegal" - aliens, immigrants, non-citizens - are "illegally" in the United States in violation of immigration "laws".  Breaking laws also makes one a criminal.  Maybe, instead of calling them "illegal" whatevers we should refer to them as "criminal" whatevers because their presence in the United States is a crime, or adjectively "criminal".

They can't be "immigrants" because that implies compliance with established immigration laws.

How about "criminal trespassers"?

Personally, I favor calling them criminal aliens, because it emphasizes that their status is the result of criminal activity on their part, and sidesteps the stupid liberal nostrum that "human beings aren't illegal".
