The Centers for Disease Control morphed into the Centers for Rent Control this past year. If you cannot crush a virus, then you can at least crush landlords.

Director Rochelle Walensky this week ordered a two-month suspension in evictions for renters who refuse to pay landlords. This follows the unfunded mandates dropped upon the backs of landlords by the bureaucratic agency dating back to September that expired at the end of July.

By what authority?

One line of the bizarre, byzantine order states, “This Order does not relieve any individual of any obligation to pay rent, make a housing payment, or comply with any other obligation that the individual may have under a tenancy, lease, or similar contract.” A few lines later, the order reads: “Any evictions for nonpayment of rent prior to issuance of this Order but not yet completed, are subject to this order.” Get that? The CDC does not absolve renters from paying their landlords; it just removes the only real mechanism available to deedholders to compel tenants to fulfill obligations.

The head-scratching translation from Weaselese and Legalese to King’s English seems the least of the edict’s problems.

I would just ignore her 'royal edict'. The CDC does not make 'law'.
This is an illegal order and nobody is legally bound by it.

But if challenged, it cannot stand. It is a 'recommendation' at best, and a ground level it is really more just an opinion.
Can you imagine the chaos if bureaucrats are allowed to make law? Imagine what all the hundreds of three letter dictators would unleash.

Landlords should simply continue as usual and ignore it. A judge would have to literally ignore hundreds of years of legal precedent to rule in favor of the CDC so called 'law', especially since there is no defined 'end date' for the edict or any defined 'remedy' for the landlords in order to make them whole.

Are they saying that anyone not paying their rent cannot be evicted 'forever'? I have read articles about renters buying homes, houseboats, and Winnebagos with their rent money.  So, they are spending the landlords' money with the specific intent to cheat them. They are riding out the apartment for free for as long as possible and then plan to jump to something else they bought with the landlord's money.

Biteme said he knows it won't stand judicial scrutiny, but in the same breath said it doesn't matter  because he can tie it up in the courts until it becomes a moot point.
