Florida, Georgia courts to hear challenges to mandatory mask policies

July 21 (UPI) -- Judges in two states will hear legal arguments Tuesday against new mandatory face mask requirements designed to stem the spread of COVID-19 -- which opponents, including the governor of Georgia, are fighting in court.

A number of municipal governments have imposed mandatory requirements for face coverings in public as a measure to fight the spread of COVID-19. Health officials have said masks are critical in suppressing and controlling the virus.  .  .  .

.  .  .  Tuesday morning, Fulton County Superior Court Judge Kelly Ellerbe will hear the legal challenge in a case that could set a key precedent for similar orders nationwide. The hearing is scheduled for 11 a.m.

Gov. Kemp And Mayor Bottoms Hearing Canceled, Judge Recuses

A Fulton judge is recusing herself from Tuesday's case between Gov. Kemp and Mayor Lance Bottoms

ATLANTA, GA — Fulton County Superior Court Judge Kelly Ellerbe is recusing herself from a case between Gov. Brian Kemp and Atlanta Mayor Keisha Lance Bottoms.

The first hearing was scheduled for 11 a.m. Tuesday but was canceled, according to the Georgia Attorney General's Office.

The state will have to seek another hearing, which will be reassigned to a new judge, reported the Atlanta Journal-Constitution.  .  .

.  .  .  Atlanta isn't the only city to issue a mask mandate. Savannah, East Point, Athens-Clarke County have also issued orders and other cities across the state could soon pass similar measures.

Not sure why the judge recused herself.
