The Latest: Congressman says election lawsuit will proceed
« on: November 15, 2018, 09:52:55 pm »
Anyone still think that the GOP has a snowball's chance in hell of maintaining the majority in the Senate??  If anything, the power of the House and Senate will be in dispute and tied up in the court system for a very long time.

The Latest: Congressman says election lawsuit will proceed

Republican U.S. Rep. Bruce Poliquin, of Maine, isn't conceding defeat in the first use of ranked balloting in a U.S. congressional race.

He said in a statement Thursday he "won the constitutional 'one-person, one-vote' first-choice election" on Election Day. He said he isn't abandoning his federal lawsuit in which he seeks to have Maine's new ranked-choice voting system declared unconstitutional.

Election officials declared his Democratic opponent, Jared Golden, the winner Thursday after a federal judge denied Poliquin's request to halt additional tabulations.

Poliquin received the most first-place votes on Election Day but additional tallies were required because no one won a majority. The ranked-choice system lets voters rank all candidates and then eliminates last-place candidates and reallocates votes to ensure there's a majority winner........

He should push this all the way to the U.S. Supreme Court.

The Maine "voting law" that awarded the election to his democrat-communist opponent (who actually received FEWER votes) is unconstitutional and I sense it will be rendered so by the Supremes.

Oh, I don't doubt that a lot of the races will wind up before the Supreme court. That leaves the balance of power in quite an upheaval ... exactly as planned.

The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators.

Your point is well-taken. But...

One of the "Regulations" regarding voting passed by Congress is called The Voting Rights Act.
Another was the 14th Amendment, which guarantees everyone "due process under law".

The law that created IRV in Maine violates both the spirit and the letter of both of the above, in my opinion.

It took the 2nd place finisher and made him the winner of the election, even though the candidate he "defeated" received MORE votes cast.

If such a law had been used in the old south to prevent black candidates from winning, how would that have gone over?
