Levin is full of shit. From this morning's Wall Street Journal:
No one on Mr. Trump's list of nominees will claim they want to overturn Roe - and not because they are lying. In their caution and deference to precedent, they will be showing proper conservative respect for the law and the reputation of the Court.
The issue is reliance. Yes, the issue should have been decided by the people, not the courts. But a forty-year old decision, whatever its merits at the time, has extended precious liberty to millions of Americans. Liberty can be exercised for good or for ill. But it can and must be defended against moral absolutists who claim the State as the agent of their oppression.
None of the conservative Justices on the SCOTUS, except perhaps Clarence Thomas, will destroy the reputation of the Court by denying this most fundamental liberty - the right of self-determination - to half the population. The proper way to undo Roe is to pass a Constitutional amendment. That the past forty years have shown no movement on that front is proof enough that the American people are comfortable with the proposition that abortion be rare, but nevertheless safe and legal.
