LevinTV host Mark Levin tore into Sen. Susan Collins, R-N.H., Monday night on his radio program over her comments on stare decisis, or precedent.

Collins claimed that she would not support certain potential Supreme Court nominees because they have “demonstrated a disrespect for the vital principle of stare decisis.”

Levin, a legal scholar, blasted Collins as an “absolute radical” on the issue.

“Look at the cases of Dred Scott v. Sanford, Plessy v. Ferguson, and Korematsu v. the United States. They were abominations,” Levin argued. “The Supreme Court has done some horrific things that have led to horrific outcomes, and yet the Left wants you to believe the Court is better than the other branches of government.”

Levin is full of shit.  From this morning's Wall Street Journal:

The issue is reliance.  Yes, the issue should have been decided by the people, not the courts.  But a forty-year old decision, whatever its merits at the time, has extended precious liberty to millions of Americans.   Liberty can be exercised for good or for ill.   But it can and must be defended against moral absolutists who claim the State as the agent of their oppression. 

 None of the conservative Justices on the SCOTUS, except perhaps Clarence Thomas, will destroy the reputation of the Court by denying this most fundamental liberty - the right of self-determination - to half the population. The proper way to undo Roe is to pass a Constitutional amendment.  That the past forty years have shown no movement on that front is proof enough that the American people are comfortable with the proposition that abortion be rare, but nevertheless safe and legal.

To follow your line of "logic" Dred Scott v Samford and Plessey v. Ferguson should still be law of the land.

I mean both of those followed stare decisis like Roe right?  And according to you we have to always adhere to precedent.
