Former Subway pitchman Jared Fogle asked a federal appeals court on Friday to shorten the more than 15-year prison sentence he received for possessing child pornography and paying for sex with underage girls.

Fogle's attorney argued that that the District Court judge in Indianapolis abused her authority by giving Fogle a sentence three years longer than the maximum term prosecutors agreed to pursue as part of his plea deal.

Fogle pleaded guilty in November to one count each of distributing and receiving child porn and traveling to engage in illicit sexual conduct with a child.

As part of his plea deal, he agreed not to seek a sentence of less than five years in prison and prosecutors agreed not to push for more than 12½ years behind bars.

Pedophile sandwich pitchman Jared Fogle was pummeled by a fellow inmate in a prison smackdown, according to a report.

The former Subway hawker, who is serving a 16-year sentence at Colorado’s Englewood FCI, was tackled and punched in the face by a 60-year-old armed robber, TMZ reported.

Steven Nigg, 60, who is serving time on gun charges, left Fogle with a bloody nose, swollen face and scratches on his neck after the recreation yard beatdown on Jan. 29, the site reported.

Nigg, who suffered a small cut on his hand, unleashed his barrage after reaching his boiling point over the number of child sex predators housed in the low-security facility, his relatives told TMZ.

He was punished for his vigilante vengeance with a stint in solitary.

Fogle, a father of two whose claims he lost 200 pounds by eating Subway foot-longs led to his hiring as the company’s pitchman, confessed to having sex with teenaged prostitutes.

He has been stress-eating behind bars amid threats and taunts – called “Chomo,” short for child molester – and has gained about 30 pounds.

Fogle was recently slapped by an inmate who had called him a “dirty child rapist,” a recently released prisoner said.

His earliest possible release date is July 11, 2029.
