The Democratic co-chairman of the state Board of Elections on Thursday recommended the dismissal of lawsuit challenging Sen. Ted Cruz’s placement on the Republican presidential primary ballot.

The state Board of Elections has received multiple challenges, as well as a lawsuit that challenges Cruz’s eligibility for the presidency based on his Canadian birth.

But Democratic co-chair Douglas Kellner in an email wrote that he backed a motion to dismiss the suit because it fails to mention Cruz as a party as require by state law.
