Texas Sen. Ted Cruz is threatening to filibuster any Supreme Court nominee made by President Obama to replace the late Supreme Court Justice Antonin Scalia.

“This should be a decision for the people,” Cruz said on ABC’s “This Week With George Stephanopoulos” on Sunday. “Let the election decide. If the Democrats want to replace [Scalia], they need to win the election. But I don’t think the American people want a court that will strip our religious liberties. I don’t think the American people want a court that will mandate unlimited abortions on demand, partial-birth abortion with taxpayer funding and no parental notification, and I don’t think the American people want a court that will write the Second Amendment out of the Constitution.”

On Saturday, Obama said he plans “to fulfill my constitutional responsibilities to nominate a successor in due time,” pressing the Senate to “fulfill its responsibility to give that person a fair hearing and a timely vote.”

Asked whether he would filibuster Obama’s choice, Cruz said: "Absolutely.”

“The Senate’s duty is to advise and consent,” Cruz said on NBC’s “Meet The Press” Sunday. “We’re advising that a lame-duck president in an election year is not going to be able to tip the balance of the Supreme Court.”

Scalia, who died suddenly Saturday at the age of 79, was the court’s longest-serving member and an outspoken conservative champion of the Constitution.

Roy Moore's "spiritual warfare" is driving past a junior high without stopping.

Is Cruz saying that he'll suspend his Presidential campaign for this?

After all, he can't campaign and filibuster at the same time.

I don't know.  There is no 60 vote requirement for cloture for judges unless the Republicans change it.

A Congressional session runs for one year, January 3rd to sometime in December.

There are two sessions for each “Congress” (odd year to odd year). Adjournment means that Congress is out of session, it is closed to business.

 This is in contrast to a recess, which we might think of as “time off” or “pause.”
After Congress is adjourned, there are formal processes involved in reconvening.

 The Constitution forbids either the Senate or the House to adjourn for more than three days without the permission of the other chamber.

A “recess appointment” can not be made during adjournment. There is no provision for appointment during adjournment.

Yet these hypocrites seem to forget they used the filibuster, and even racism to delay and finally deny George w. Bush's nominee Miguel Estrada a seat on the federal bench.

Democrats and Leftist Groups labeled Mr. Estrada as "Politically Dangerous," because if confirmed they felt that he might ascend to the USSC as the first Hispanic on the high court.

For 28 months Democrats and Leftist Groups used every racist tactic in the book to deny and delay an up or down vote.

So ruthless were these tactics that Estrada's Wife miscarried their child and later killed herself, which promoted Estrada to withdraw his nomination to the federal bench.

There are those who claim that she died from an accidental overdose of alcohol and sleeping pills, having also miscarried during the nomination fight.
