The inability to produce accurate transcripts affects defendants facing criminal charges, parents fighting custody battles, businesses defending lawsuits, and anyone seeking to appeal a judicial decision, according to James Christopher writing in Washington Examiner. Without a proper record, constitutional guarantees risk becoming empty assurances.
 
California exemplifies the scope of the problem. Data from April 2023 through June 2025 reveals that roughly 2.04 million hearings in family law, probate, and unlimited civil cases—representing 72% of those examined—proceeded without any verbatim record. State judicial officials have acknowledged this shortage leaves parties unable to secure the documentation necessary for appeals.



New York recognized the same threat years earlier. A 2021 state court assessment found the number of senior court reporters had dropped from 600 in 2017 to just 510 in 2021. Officials warned that insufficient staffing virtually guarantees delays and recommended hiring nearly 200 additional senior reporters, expanding real-time transcription capabilities, strengthening oversight, and implementing statewide electronic filing of transcripts.


Despite identifying these risks, New York failed to act with appropriate urgency.
