Former FBI Director James Comey will appear at a federal court in Alexandria, Va., this morning to face charges of making a false statement to Congress and obstructing a congressional proceeding.

Comey has maintained his innocence and is expected to plead not guilty.

The charges stem from testimony he gave before Congress in 2020 about the FBI’s investigations into former Secretary of State Hillary Clinton’s use of a private email server and alleged ties between President Trump’s 2016 campaign and Russia that were ultimately unproven.

Comey was asked during that testimony whether he ever authorized a leak about the Clinton investigation, and he denied doing so. But the indictment alleges that when he gave that testimony, he knew he had authorized another person to leak to the media.

The case has received significant national attention in large part because the former FBI director is a top critic of Trump and the president has often called for his political opponents like Comey to be prosecuted.

A few days ahead of the indictment being handed up, Trump posted on Truth Social urging Attorney General Pam Bondi to go forward with cases against Comey, New York Attorney General Letitia James (D) and Sen. Adam Schiff (D-Calif.).

The president celebrated Comey’s indictment shortly after the charges were unveiled, calling him a “Dirty Cop” who lied.

But proving the case against Comey may not be easy.

The prosecutor’s office in the Eastern District of Virginia underwent much turmoil before the case was brought. Erik Siebert, who was serving as the U.S. attorney for that district, stepped down last month amid pressure from Trump to quickly bring charges and was reportedly unsure if there was sufficient evidence to pursue cases against James or Comey.

The president chose Lindsey Halligan, who had served as a White House aide, to replace Siebert. She previously was on Trump’s criminal defense team and has never prosecuted a federal case.

The grand jury that approved the charges against Comey was divided, as 14 of the 23 jurors approved the two counts, just over the necessary 12-vote threshold. Jurors also rejected another count of making a false statement.

Comey’s team may file a motion to dismiss the case on the grounds that he is being politically targeted, pointing to those who expressed concern about the weakness of the case and Trump’s numerous comments expressing his desire for Comey to face legal scrutiny.

Comey produced a letter signed by 51 former intelligence officials testifying to the fact that he's totally innocent.

A federal magistrate judge suggested Monday that “profound investigative missteps” by the government could provide former FBI Director James Comey grounds for having his case dismissed.

Magistrate Judge William Fitzpatrick granted Comey’s request to review typically secret grand jury material, finding “government misconduct may have tainted” the proceedings.

“The Court recognizes that the relief sought by the defense is rarely granted,” the judge wrote. “However, the record points to a disturbing pattern of profound investigative missteps, missteps that led an FBI agent and a prosecutor to potentially undermine the integrity of the grand jury proceeding.”

Comey faces charges for allegedly lying to Congress during his September 2020 testimony and obstructing a congressional investigation. The government alleges he authorized Columbia University law professor Daniel Richman to leak information, despite testifying that he had not “authorized someone else at the FBI to be an anonymous source in news reports” regarding an investigation into Hillary Clinton.

A core claim used to undercut the prosecutions of President Trump’s foes will on Wednesday face its first real test in court.

Former FBI Director James Comey will seek to convince a judge to dismiss his case because he is the target of a selective and vindictive prosecution at the hands of Trump’s Justice Department.

Though the narrative of Trump’s retribution campaign against his political enemies has become pervasive, U.S. District Judge Michael Nachmanoff must decide whether Comey was unfairly singled out and his charges should be dropped.

Comey, an outspoken critic of the president since leaving his first administration, contends that Trump’s “personal spite” was the impetus of a two-count indictment stemming from 2020 testimony he gave Congress, brought just days before the statute of limitations was set to expire.

“The circumstances of the charging decision in this case — a last-minute retaliatory charge after a torrent of personal invective by a President who expressly sought charges regardless of the facts — warrant dismissal with prejudice on both vindictive and selective prosecution grounds,” his lawyers wrote in their motion filed last month.

 Fitzpatrick’s role was limited to addressing specific pretrial issues, such as the defense’s request for grand jury materials, which he granted as an "extraordinary remedy" due to "genuine issues of misconduct".
 After reviewing the disclosed materials, Comey’s legal team is expected to file motions that could include requests for dismissal.

Additionally, Nachmanoff has temporarily halted Fitzpatrick’s disclosure order to allow the Department of Justice to challenge it, meaning the process is still ongoing.
 Therefore, while the magistrate judge’s findings significantly increase the likelihood that the case could be dismissed, he cannot unilaterally dismiss it himself.
