🚨 MILITARY JUSTICE AWAITS: The Sword of Accountability Hangs Over James Clapper
The recent admission by former Director of National Intelligence James Clapper—a retired four-star General—that he has “lawyered up” amid mounting legal scrutiny over his role in the Russia Collusion hoax, is far more than a political embarrassment. It represents the prelude to a potential national security reckoning of unprecedented magnitude.
Under Title 10, U.S. Code § 802 (Article 2 of the UCMJ), retired members of the armed forces entitled to pay—including General Clapper—are subject to recall to active duty for the purpose of court-martial if they are alleged to have committed acts that constitute treason, sedition, or subversion while serving in a national security capacity. This is not a theoretical exercise—this is well-established law. In United States v. Dinger (2018), the Court of Appeals for the Armed Forces upheld the military’s jurisdiction over retired officers for crimes committed while on active duty.
Clapper’s involvement in the orchestration and dissemination of fraudulent intelligence that led to the weaponization of our law enforcement apparatus against a sitting president could be construed as treasonous conspiracy—a betrayal not only of constitutional norms but of the sacred trust bestowed upon him by his commission. His actions weren’t mere policy disagreements—they were part of a coordinated psychological and informational warfare campaign against the Commander-in-Chief and the American people.
A civilian trial—plagued by endless motions, media manipulation, and a partisan judiciary—would allow Clapper to cloak himself in political martyrdom and delay justice indefinitely. By contrast, a court-martial proceeding, governed by the Uniform Code of Military Justice, would be swift, apolitical, and insulated from media spectacle. The rules of evidence are stricter, and national security violations carry weighty implications, often triggering automatic classification reviews and triggering sealed indictments.
A successful court-martial conviction for treason, conspiracy to commit treason, or misuse of classified information for political purposes could result in life imprisonment or even capital punishment under UCMJ Articles 94 and 106a. Moreover, such a trial would reaffirm the authority of the Constitution over its military servants, and send an unmistakable signal that no rank or title places one above justice.
This is not vengeance—it is a long overdue application of the law. Clapper knows what’s coming. And he should be afraid.
