The U.S Supreme Court has ruled that Texas death row inmate Ruben Gutierrez can sue District Attorney Luis Saenz for denying DNA testing that could prove his innocence. Justice Clarence Thomas dissented, saying the decision delays capital cases and departs from the Due Process Clause's original intent. Thomas contends that the Fourteenth Amendment protects against physical restraint and does not grant entitlements to government benefits.
