Trump Himself Asks SCOTUS to Allow Deportations of Gang Members Under Alien Enemies Act

John Binder 2 Apr 2025

President Donald Trump, himself, is asking the Supreme Court of the United States (SCOTUS) to allow the federal government to deport illegal alien gang members to El Salvador under the Alien Enemies Act.

Last month, Trump invoked the Alien Enemies Act to begin deporting illegal alien gang members of Tren de Aragua and MS-13 under a deal negotiated with El Salvador’s President Nayib Bukele.

As two deportation flights were underway, U.S. District Court Judge James Boasberg issued a temporary restraining order to block the Trump administration from using the Alien Enemies Act. A lower court later upheld Boasberg’s ability to issue such an order.

Now, in support of the Department of Justice’s (DOJ) request, Trump is writing to SCOTUS himself, pleading with the justices to fully vacate Boasberg’s order.

Court rulings or not, didn't the administration just pack off another plane of illegal gangbangers to Salvador ...?

(and that's a GOOD thing that they did, defying both boasberg and the appellate court)

I don't think representing one's own interests before a court, whether personal interests or the interests of an office one holds, constitutes the practice of law.  For instance, anyone can file an amicus curia brief.  One does not need to be a lawyer.  Representing the interests of others before a court or giving legal advice to others (at least if not accompanied by a disclaimer warning the recipient that one is not a lawyer) constitutes the practice of law that would violate some statute or other depending on the context.
And when they behead your own people in the wars which are to come, then you will know what this was all about.

Except that it violates the due process of law.  The presumption of innocence is not something that applies only to citizens.  One cannot make America great again by making it cease to be America, and a major part of American culture has always been fidelity to the Anglo-Saxon legal traditions of presumption of innocence, trial by jury, the need of the state to prove its case beyond a reasonable doubt, writs of habeas corpus, and the like.
