Leftist Judge Creates Full-Blown Constitutional Crisis — Soon To Be Cured By SCOTUS

By: Margot Cleveland
March 03, 2025

There is still time for the Supreme Court to avert an unnecessary constitutional crisis created by litigants and their handpicked judge seeking to control the executive branch.

“It is DECLARED that plaintiff Hampton Dellinger is the Special Counsel of the Office of Special Counsel,” and he “shall be the Special Counsel of the Office of Special Counsel for the remainder of his five-year term unless and until he is removed in accordance with 5 U.S.C. §1211(b).”

Judge Amy Berman Jackson, a Barack Obama appointee, entered that ruling late Saturday evening in a two-page order. Judge Berman Jackson’s order then further mandated that five executive branch officials “recognize plaintiff’s title and position as Special Counsel of the Office of Special Counsel,” and “not obstruct or interfere with his performance of his duties.” And just like that, a mere two months into the president’s second term, a solitary federal judge created a constitutional crisis.

Consider the scenario: Donald Trump calls Hampton Dellinger, telling him “I’m firing you again.” The president then directs other officials — not the named defendants — to process Dellinger’s termination papers, to prevent Dellinger’s access to federal property or his former office, and to disconnect Dellinger’s cell phone and computer access.

  • Ah, the air is so much fresher here...
I'm tired of some shopped backwater circuit judge having control over the entire Executive Branch of our govt and no jurisdiction over the subject matter at hand.
The Republic is lost.

It is not melodramatic to say how important this SCOTUS ruling is.

If Roberts caves, it is pointless to go forward.  Musk's efforts will be all for naught.  He'll be hamstrung at every angle.  Yes, I am nervous.
I display the Confederate Battle Flag in honor of my great great great grandfathers who spilled blood at Wilson's Creek and Shiloh.  5 others served in the WBTS with honor too.

Vulcan fulminates with:

Agreed here.

And yet one more time, I'm going to post this:

There needs to be proclaimed (yes, proclaimed) "The Trump Doctrine" on the relationship between the Executive and the Judiciary.

It must re-define how much power the federal courts have to exercise against the president and his powers.

No individual federal judge anywhere should have the power to overturn executive action.
At the district court level, when and where federal/nationwide policies are impacted, judges should have no more power other than to issue an opinion (strictly an "opinion", not a "ruling").

It will be up to the president as to whether to accept or reject such an opinion.

If rejected, then it can be appealed upwards to the next level. The president should declare in his proclamation that only a judgment by the full appellate court (NOT a 3-judge panel) will be binding -- and ONLY within the confines of that district -- AGAIN, IF the president chooses to accept the ruling.

And after that, we're left with the U.S. Supreme Court. Of course, this is going to carry more weight, but I've come to the (very personal) conclusion that even the 9 justices in their black robes should not be entrusted to dictate final decisions before the American people.

Rather, in matters of national social and cultural importance, any U.S. Supreme Court decision should be "annullable-cancelable" by a vote of the U.S. Congress and Senate.

Frankly, I don't even trust most of our "elected leaders" (do YOU?).
I'd rather see such matters put up to a national vote -- much like the Swiss people do RIGHT NOW.

I never cared for William F. Buckley, but remember his famous comment about the Boston Telephone Directory...?
===================================

It's time to bring this issue to a head.
And no better way to do it than by Mr. Trump following my suggestions above.

Well, more times than not, Roberts has rained on Trump's parade.  I am nervous as well.

I remember it was a Federal bankruptcy judge in Hawaii who issued some nationwide order about the border during Trump's first presidency.

The Supreme Court needs to control the Federal judiciary. Not a damned one of them has any executive or legislative authority and it is way past time that they be reminded of this fact.
