Is a Constitutional Crisis Coming At Us Next Week?
« on: January 01, 2025, 11:59:24 am »
The Daily Caller reported Tuesday that Rep. Chip Roy (R-Tex.) “said Tuesday that Speaker Mike Johnson does not have the votes among the House Republican conference to continue serving as speaker despite President-elect Donald Trump’s endorsement of Johnson on Monday.”

If Roy is correct, this is a big deal, for as PJM’s Paula Bolyard explained Monday: “If there's no House Speaker, there may not be a vote. If there is no certification, Trump cannot be inaugurated as president. Nor can JD Vance be sworn in without that crucial ceremonial vote. With no speaker in the House, the presidency could fall to Chuck Grassley until the House, with a slim Republican majority, can get things sorted out.”

Chuck Grassley would become president because, as the President Pro Tempore of the Senate, he is next in the line of succession. He is also 91 years old, and has been in the Senate since Jimmy Carter, who just died at age 100, was president of the United States.

Kamala could very end up as acting President? Not sure if it's the current or newly elected VP who presides if Congress cannot decide who is president.

Bloody hell.  President Chuck Grassley?  That guy is ancient.  The republicans had better hope Kim Reynolds wins reelection, or his death might just flip the senate.

It is not a 'Constitutional Crisis'.

That occurs if the Constitution is not followed.

In this case, the Constitution spells out what will happen, so all we have to do is follow what it says.

A constitutional crisis occurs when something occurs and the Constitution doesn't lay out what to do. Period.

Democrats have already indicated that not one will support Johnson.  Last I heard, there are eight Republicans that will not support Johnson, so there will be a fight over who is Speaker.  Because the Republicans can never unify over anything, I expect this will last for some period of time.

I do not envision Trump being inaugurated on January 20th.  The Dems will sit back and not progress anything over the next couple months.

So, if Chuck Grassley becomes the acting POTUS, at least he is conservative.  Hopefully, he will issue a boatload of EOs to end anything Biden established.  And a nice side benefit is that he will prove that as a 91 year old, he can accomplish stuff that Biden was clueless about.  Biden was senile in 2020 when he was campaigning from his basement.

And if Grassley does become the acting POTUS, I do not see it as a crisis.  His age is not a problem, he can utter more than two sentences that are intelligently spoken, which is better than the current fool and his sidekick.  The USA will be fine while the idiot Republicans find their posterior using a flashlight.

This isn't a Constitutional crisis.  It is a Congressional crisis.  The House doesn't need a Speaker to certify a President.

Amendment XII

The President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted.

It doesn't matter who is or is not House Speaker.  Congress just needs to sit their asses down, listen, and witness.

The Electoral College chooses the President ... not Congress, under normal circumstances.  Things haven't been 'normal' for a long time.

Of all tyrannies, a tyranny sincerely exercised for the good of its victims may be the most oppressive. It would be better to live under robber barons than under omnipotent moral busybodies. The robber baron's cruelty may sometimes sleep, his cupidity may at some point be satiated; but those who torment us for our own good will torment us without end for they do so with the approval of their own conscience.
