Judge issues new permanent injunction on Biden oil and gas leasing pause

A federal judge placed a permanent injunction against President Joe Biden's pause on federal oil and gas leasing in 13 states, following up on a temporary injunction placed on the Biden order last summer.
 
U.S. District Judge Terry Doughty ruled late Thursday that the federal government may not stop issuing leases on federal lands and waters in accordance with the pause Biden ordered during his first week in office. Doughty's order said federal law requires the Interior Department to carry out lease sales, pointing to various statutes, including one requiring the department to hold sales "where eligible lands are available" and to do so "at least quarterly.”
 
Doughty had already put a preliminary injunction on the leasing pause last June. The Biden administration has since carried out one offshore lease sale and one series of onshore lease sales across various states pursuant to the preliminary injunction.

However, the 5th U.S. Circuit Court of Appeals on Wednesday vacated Doughty's preliminary injunction. The ruling did not deal with the merits of the case but remanded the decision to Doughty's court, the U.S. District Court for the Western District of Louisiana, for further proceedings on the grounds that he did not define the word "pause" when enjoining the government from pausing leasing.

The U.S. Environmental Protection Agency has revoked the permit for a proposed 1.92 million barrels-per-day offshore oil export terminal off the coast of Corpus Christi, Texas.

The Bluewater oil export terminal is being jointly developed by Phillips 66 and Trafigura. The deepwater terminal would be located approximately 15 nautical miles off the coast and would allow for up to two Very Large Crude Carriers (VLCCs) to simultaneously load domestically produced crude oil via single point mooring (SPM) buoys for export to overseas markets.

As proposed, the facility is expected to service approximately 16 VLCCs per month, equivalent to 384 million barrels per year.

Bluewater Texas Terminals LLC applied for a Clean Air Act permit from the EPA in May 2019, and later received a pollution control license that allowed it to emit almost 19,000 tons per year of Volatile Organic Compounds, which can lead to adverse health effects, and 833 tons per year of hazardous air pollutants, which cause cancer and other serious health impacts.

But during a public comment period on the project, the EPA received pushback from environmental groups who argued for more stringent pollution controls.

On Thursday, the EPA revoked the license and has now directed the developer to withdraw its applications by September 15 and submit a revised proposal that would reduce pollutants by at least 95%. ...

And the lying POTUS just 2 months ago said he was doing everything on his behalf to up domestic production.

Never have I seen a president so devoid of being able to tell the truth.

Migosh, they've done something that I actually APPROVE OF.

American-produced petroleum shouldn't be exported.
Particularly so during a time due to high consumer prices due to (what else) not enough domestic supply to meet demand.

American-produced energy products (raw and refined) should STAY in America. Both to meet demand and keep prices down.

If this sounds provincial, well, it is.

Joe Biden is intentionally keeping America from producing more oil and gas. Look at this graph of acres of federal land leased for oil & gas production. Biden’s leased just 126k acres so far, Nixon, the lowest in fifty years prior, leased 4.4 million. This is madness.
