Navy SEAL charged with war crimes considers suing his investigators

A Navy SEAL is considering a civil rights lawsuit against Navy investigators after alleging that they "laid siege" to his home and marched his children out of the house during a probe into the SEAL's actions in Iraq.

Special Operations Chief Edward Gallagher, a 19-year Navy veteran, hired lawyers Colby Vokey and Phillip Stackhouse to consider a lawsuit against Naval Criminal Investigative Service agents for entering his home in June with weapons drawn and taking his children out of the house at gunpoint.

Gallagher was arrested Sept. 11 and is being detained at San Diego’s Naval Consolidated Brig Miramar.

Gallagher's arrest was linked to a 2017 stabbing death of an Islamic State detainee in Iraq, according to the Navy Times. Gallagher and others are being investigated to see if they executed an ISIS fighter without offering aid while they were deployed near Mosul between 2017 and 2018.

Gallagher’s complaint alleges that the agents knowingly charged into his home when his wife was gone and threatened his children.

"NCIS laid siege to the house in the morning hours ― weapons drawn — and inexplicably traumatized Chief Gallagher’s young sons by pulling them out of the house at gunpoint in their underwear," Stackhouse said.
