Justice Department asks Supreme Court to overturn DACA ruling

The Department of Justice on Thursday formally asked the U.S. Supreme Court to overturn a lower court’s ruling to block, in part, the Trump administration’s decision to phase out the Deferred Action on Childhood Arrivals program.

The unusual step bypasses the U.S. 9th Circuit Court of Appeals, which would have been the normal move to overturn U.S. District Judge William Alsup’s ruling.

It is important to understand what Judge Alsop's ruling does and does not do.    It does NOT order the President to keep DACA.   Approximately 700,000 of the several million folks eligible for DACA came forward and applied for work permits.   The Judge did NOT require Trump to keep the program available for those who haven't yet applied.   He is merely trying to preserve the bargain accepted by the 700,000 pending a full disposition of the matter on the merits.   So the Administration must, for example,  allow folks in the program to renew their work permits pending the resolution of litigation.

That's entirely reasonable given these folks' detrimental reliance on the government's offer.   

It also ought to buy time for our Congresscritters to strike a good deal that will enshrine DACA in legislation in exchange for increased border security and changes to legal immigration rules.

I agree. A deal is a deal. The people that signed up in good faith and did what they were supposed to do have a right to expect the government to uphold it's side of the bargain.  Those that didn't sign up can take a long walk on a short pier for all I care. You snooze,you lose,MF.

I couldn't disagree more strongly. WHY do we need to do this as a CONDITION TO DO WHAT WE HAVE EVERY RIGHT TO DO ANYHOW?

Mexicans are no better than anyone else. If you want to come here to live and become a citizen,go through the same process as everyone else or stay home.

SP,  I actually like what I think you're proposing.   Trump should accept the Judge's ruling, preserve DACA for the 700,000 who've applied, and then say he'll veto any attempt to expand DACA beyond the 700,000 unless he gets ALL of what he wants on border security and legal immigration.   

Accepting the 700,000 will shut down the Dems' whinefest, and stop in its tracks the bad compromises that would enshrine DACA in legislation while expanding its scope to the millions who didn't apply, and their parents.   

The Judge has unwittingly provided the cover the President needs to show both his "heart" and his backbone!

Close,but I want it shut down,period. NO more numbers added. If you don't the Dims will continually use that as a wedge to play race-baiting political games,and no number will ever be high enough for them. Since no number will please them,why allow any at all?

Once again,Mexicans are no better than anyone else,so why should they get treated better than anyone else when it comes to immigrating to America?

We also desperately need to get rid of the Anchor Baby program,where any illegal alien woman that is pregnant can run across the border and then squat down to produce a "new American citizen" that is not only her "get out of jail free card",but her access to the national treasury for a minimum of the next 18 years.

One set of rules for everyone when it comes to nationality. That way nobody can bitch about being singled out for denial.
