McConnell Scrambles To Soothe Conservative Anger Over Slow Judicial Confirmations

According to the Judicial Conference of the United States, 149 vacancies currently exist in the federal courts. President Donald Trump has named 50 judicial nominees since taking office, submitting a slate of approximately 10 candidates every month. Thus far, the Senate has confirmed just seven, including Justice Neil Gorsuch.

The president’s nominating pace is astoundingly fast compared to recent administrations. Former President Barack Obama named just 10 judicial nominees during his first year in office, including Justice Sonia Sotomayor. Former President George Bush named only four. Former President Bill Clinton’s only judicial nomination during his first year was Justice Ruth Bader Ginsburg. As such, the Senate has not been made to contend with so many nominees at this early stage of a presidency in modern history.

Still, conservative think tanks and advocacy groups like the Heritage Foundation and the Judicial Crisis Network (JCN) have registered their complaints with GOP leaders, fearing the dispirited Republican Senate caucus will forfeit an unprecedented opportunity to reshape the federal courts.

I see from the article that the Senate is not in session this week.  Why the hell not? 

Maybe that's much of the problem. Too much time off and not enough work for these overpaid bums.

I don't know.  I haven't read of that many blue slips being issued, but perhaps it would not be publicized, unless the Senator issuing them wants to do so.

"The chairman of the Judiciary Committee will determine how to apply the blue slip courtesy for federal judicial nominees, as has always been the practice," said Taylor Foy, Grassley spokesman, in an email to the Washington Examiner. "Over the years, chairmen have applied the courtesy differently, but the spirit of consultation has always remained."

Under the Senate's blue slip procedure, a state's senators are consulted by the White House before a president nominates a judge from that state, regardless of party affiliation, according to a Congressional Research Service report detailing the blue slip policy. The senators historically have had the opportunity to block the nominee from receiving a Senate Judiciary Committee hearing and vote.

Hearing, yes.  Vote, no.  A nominee does not have to have a hearing in order to bring up a confirmation vote.

When Orrin Hatch did an excellent job as Judiciary chairman.  He regularly told Dems to pound sand when they brought up this Blue Slip nonsense.  But then unlike Grassley, Hatch was a Conservative.

"- Confirming judicial nominees has been elevated to a top priority in the Senate. “I decide the priority,” McConnell said in an interview. “Priority between an assistant secretary of State and a conservative court judge—it’s not a hard choice to make.” And when nominees “come out of committee, I guarantee they will be dealt with,” McConnell said. “Regardless of what tactics are used by Democrats, the judges are going to be confirmed.”
- No longer will “blue slips” be allowed to deny a nominee a Senate Judiciary Committee hearing and vote on confirmation. In the past, senators have sometimes barred a nominee from their state by refusing to return their slip to the committee, thus preventing a hearing and confirmation. “The majority”—that is, Republicans—will treat a blue slip “as simply notification of how you’re going to vote, not as an opportunity to blackball,” McConnell told me. The use of blue slips, he noted, is not a Senate rule and has “been honored in the breach over the years.” Now it won’t be honored at all."


Migosh, it looks like McConnell has actually done it -- given the blue slip the pink slip!
