 (CNN)Dynel Lane will not face murder charges for allegedly cutting and removing an unborn baby from the mother's womb, Boulder County, Colorado, District Attorney Stanley Garnett told CNN late Thursday.

The mother, Michelle Wilkins, answered a Craigslist ad for baby clothes on March 18.

When she arrived at the purported seller's home in Longmont, she was attacked, beaten, cut open and her fetus was removed. The baby did not survive.

Wilkins was treated at a hospital and later released.

I am. Supposedly the perp's husband found the baby breathing. Any forensic medical examiner worth his/her salt could determine if there was oxygen in the infant's lungs. That constitutes murder [depraved indifference as opposed to intentional]. But I guess the "Let Sleeping Feminists Lie" rule applied.

Colorado legislators did pass a measure that makes it a felony to violently cause the death of a mother's fetus. The maximum punishment under that provision is 32 years in prison, whereas a person convicted of homicide in Colorado could face the death penalty or life in prison without the possibility of parole.
