Hur to testify as a private citizen

Special Counsel Robert Hur will testify as a private citizen before the House Judiciary Committee on Tuesday after leaving the Department of Justice (DOJ), a source familiar confirmed to The Hill.
The source added that Hur will still be bound by DOJ policies and protocols because he is testifying about his work for the agency. When DOJ employees, former or current, are set to testify, they receive a letter explaining the bounds of DOJ policy, the source said.
Hur’s work for the Justice Department ended last week when he resigned from the agency following the conclusion of the investigation into President Biden’s handling of classified documents.
Other special counsels, like Hur, have resigned at the conclusion of their work. Special counsel Robert Mueller, who led the investigation into Russian inference in the 2016 election, resigned after the conclusion of the investigation.

When Robert Hur testifies before the House Judiciary Committee on Tuesday, he will reportedly be testifying as a private citizen rather than special counsel.
Hur spearheaded the investigation into President Joe Biden‘s alleged mishandling of classified documents and declined to prosecute the president in a report issued last month. A report from the New York Times on Tuesday says that Hur will not be testifying as an employee of the Justice Department.
The report claims he had resigned from the DOJ as of Monday and would be represented by a private lawyer.

As Jerry Nadler claims Biden cooperated and Trump did not.
NARA, in cahoots with DOJ and Biden WH, concocted a documents case shortly after Trump left office.
NARA reached out to Team Trump almost immediately, claiming presidential records were missing and needed to be returned.
Which files? Obama's letter to Trump and some correspondence btw North Korea dictator and Trump.
Contrary to claims Trump and his team did not cooperate, they did--probably too much. Finally, Trump voluntarily turned over 15 boxes to NARA in Jan 2022.
NARA then claimed the boxes had classified papers and sent a criminal referral to DOJ, which immediately opened an investigation.
Trump and his lawyers continued to cooperate. ON THE SAME DAY BIDEN INITIATED A SEARCH OF PENN BIDEN FOR CLASSIFIED DOCUMENTS HE KEPT, his DOJ issued a subpoena in May 2022 to get more records with "classified markings" from Trump.
They returned 38 more files.
Trump allowed DOJ counterintelligence chief Jay Bratt and 3 FBI agents into Mar-a-Lago in June 2022. He delayed his trip to Bedminster to greet the officials and told them they'd help with "anything they need."
FBI raided MAL in August 2022, taking 13,000 items and later claiming agents found 102 more "classified" papers.

Hur getting attacked by all sides this morning. Dems view the inclusion of Biden's memory in his report as gratuitous. Republicans like Rep. McClintock arguing that Hur has now set a bad precedent that memory issues exonerates people for retaining classified documents.

Hur is saying that he was deterred from bringing charges due to the higher standard of "beyond a reasonable doubt." He had to consider the President's "overall mental state" and found that they created obvious defenses for any trial...
...Hur said that he did not remember even what he told his ghostwriter or how documents on Afghanistan came into his house. Hur notes that juror might believe the blanket denial of the President...
...Hur did a great job in explaining calmly and clinically why the President's mental faculties were relevant to explaining his conclusions on the underlying allegations...
...Hur further admits that Biden told a third party that he just found classified material downstairs. Hur ultimately dismisses the weight of such evidence, which is curious. That is particularly the case when you have an audio recording of Biden saying "I just found all the classified stuff downstairs." That would seem pretty powerful evidence to put before any jury even when a defendant is claiming a near blackout on memory. ...

There is clear evidence Biden violated the Espionage Act by willfully taking and keeping his highly classified records from his time as Vice President--and even as Senator.
Six stashes of stolen classified records, unguarded for years, moved many times, accessible by Biden's Chinese agent, and likely used by Hunter for foreign corruption.
Biden even illegally shared these highly classified records with his ghostwriter.
Biden's ghostwriter obstructed justice by illegally deleting recordings of highly classified discussions with Biden, after learning Garland appointed Hur as the special counsel.
Special Counsel Rob Hur, handpicked by Garland, went out of his way to protect Biden from prosecution.
The only way Hur could do it--in the face of overwhelming evidence of Biden's guilt--is to argue Biden's declining mental state created reasonable doubt as to whether Biden intended to willfully take and keep his highly classified records.
Bottom line:
Hur saved Biden's ass.
Yet Democrats are furious at Hur for stating what everyone already knows:
Biden isn't mentally fit.

Rep. Hank Johnson just ask "you are a member of the Federalist Society" are you not? Hur said no, but Johnson then attacked him for being a Republican and trying to "smear" the President. It is a measure of our times that prosecutors are now greeted with McCarthy like demands to know if they are or have been a member of the Federalist Society. Ironically, many in that organization opposed Donald Trump and supported challenges to his claims and campaign, including disqualification efforts.

The transcript of Joe Biden’s interview with Special Counsel Bob Hur showed the president frequently wandered off topic, even making “car noises.”
The transcript, obtained by Breitbart News in advance of Hur’s testimony to the House Judiciary Committee, showed a prosecutor had asked Biden about his beloved Corvette, trying to pinpoint the timeline of when classified documents were moved to make room for the car in his home garage.
Attorney Marc Krickbuam asked Biden: “Do you remember whether it was when the Corvette was coming back after the Jay Leno show? So, in other words, it goes out for Jay Leno, eventually it comes back.” Biden responded, “Oh no, it was, it was in and out for a bunch of reasons,” before starting to chatter away.
“Because it drove me crazy; I wanted to drive it,” Biden continued. Krickbaum responded, “Got it. That makes sense. A beautiful car.” According to the transcript, Biden then proceeded to talk about his car, and make car noises.
“And the worst part was, they said I couldn’t drive it outside the driveway. It’s a long driveway. So I’d get to the bottom of the driveway, tack it up to about four grand (indiscernible) (makes car sound) (indiscernible) (laughter),” it quoted Biden.

In the hearing just now, Russia collusion conspiracy theorist, liar and leaker Adam Schiff just said it's common for witnesses to say "I don't recall" and in fact attorneys are supposed to instruct them to do so if they don't remember everything. The J6 Committee tried to smear Stefan Passantino for guiding Cassidy Hutchinson to say "I don't recall" when she didn't remember key details or facts.

Biden is asked a specific and difficult question that will incriminate him if he answers honestly, so he falls back on the familiar sly defense: 1. Delay; 2. Invoke his dead son for sympathy; 3. Feign memory loss. It’s all over the transcript. Classic con artist behavior. And it worked.
