I don't believe they will, not after the 60-vote rule was nuked for Gorsuch.
And quite honestly, I believe that ultimately we have to give this one to them. It's a lib-for-lib swap, so it won't substantially upset the ideological balance on the Court, so trying to deny any nominees at all will simply be a bridge too far.
Instead, we have to hold the nominee's toes to the fire, make sure they're fully vetted, and avoid any blatantly obvious radicals.

That's the thing about forcing through changes like that - they eventually give rise to consequences one is tempted to regret.
In this case, however, I don't think that it's cause for regret because we're swapping a liberal for a liberal.
What would be catastrophic would be for Thomas' seat to open up while the libs/progs control the White House and the Senate. I recognize that Thomas is a conservative anchor on the Court, but it might have been advisable for him to have retired in time for Trump to have nominated his replacement, and for McConnell to have shepherded the nominee through the Senate. As it is, we will have to pray to God that a lot of moving parts come out just right - that Thomas survives until the next Republican president, and at a time when the Republicans also control the Senate, all of which means he has to stay on the bench until at least early 2025.
I pray to God that it works out alright.

Schumer vows to vote on Biden Supreme Court pick with 'all deliberate speed'
Senate Majority Leader Charles Schumer (D-N.Y.) said Wednesday that Democrats will take up a replacement for Supreme Court Justice Stepehen Breyer, who is expected to retire at the end of the current term, with "all deliberate speed."
“President Biden’s nominee will receive a prompt hearing in the Senate Judiciary Committee and will be considered and confirmed by the full United States Senate with all deliberate speed," Schumer said in a statement.
Sen. Dick Durbin (D-Il.), Schumer's No. 2 and the Judiciary Committee chairman, added that he looked "forward to moving the President’s nominee expeditiously through the Committee.”
NBC News first reported on Wednesday that Breyer, 83, will retire at the end of the Supreme Court's current term. The court typically recesses in late June or early July.
The decision gives President Biden a chance to fill a seat on the Supreme Court ahead of the November midterm election, where Republicans are feeling increasingly bullish about their chance of flipping the House and potentially the Senate.

Justice Stephen Breyer will step down from the Supreme Court at the end of the current term, according to multiple reports on Wednesday.
The current court term will end in June or early July.
Breyer is one of the three remaining liberal justices and has been under pressure to step down in order to let President Joe Biden appoint his replacement.
Liberal activists fretted that Justice Ruth Bader Ginsburg stayed on the Supreme Court too long despite her history of health problems and should have stepped down during the Obama administration. Instead, when she died in 2020, President Donald Trump appointed a conservative, Amy Coney Barrett, to fill her seat, moving the court further to the right.
Breyer's decision to retire after more than 27 years on the court allows Biden to appoint a successor who could serve for several decades. Biden's appointee should maintain the current 6-3 split between conservative and liberal justices on the high court.

Biden said as a presidential candidate that if he were given the chance to nominate someone to the court, he would make history by choosing a Black woman. And word on Wednesday that Justice Stephen Breyer plans to retire should give Biden that opportunity.
“As president, I’d be honored, honored to appoint the first African American woman. Because it should look like the country. It’s long past time,” Biden said in February 2020 shortly before South Carolina’s presidential primary.
The White House has reiterated Biden’s campaign pledge since his election.
Almost all recent Supreme Court picks have been federal appeals judges. And since Biden took office in January 2021, he has worked to dramatically expand his options in that potential candidate pool by nominating five Black women who are currently sitting on federal appeals courts, with three more nominations pending before the Senate.

The news that Supreme Court Justice Stephen Breyer is retiring is still fresh. He won't even officially retire until October, and the Biden administration will likely spend months vetting potential nominees.
But I can tell you right now, whoever Biden picks, they sexually assaulted me 25 years ago at a high school party. I can't remember how I got there or how I got home. So far, the people I know who were present are telling me it didn't happen. I may have changed my story a few times too. But, hey, look, you can trust me. I have no agenda.
I should also let you know that Biden's nominee, whoever it is, might have a detailed calendar proving they weren't at the party. Don't believe it? Believe me!
I think I should be praised for my bravery in coming forward. I think the media must tell my story without questioning the details, and Time Magazine should profile me.
Just in case you think my memory is bad, you should know, I’m 100% certain it was… whoever Biden picks. There is zero chance I’ve mistaken them for someone else.
I feel so strongly that Biden’s nominee is too dangerous to be on the Supreme Court that I’d testify before the Senate Judiciary Committee… if I wasn’t afraid of flying.
I implore the U.S. Senate to listen to my story and give it the benefit of the doubt that similar accusations against other Supreme Court nominees have been given.

If I'm not mistaken, if all 10 republicans on the SJC vote NO it throws the vote in Limbo, that's where lady lindsey comes in, herd them cats,
then schumer will need 10 republican votes to bring it up for debate, 4 hours, I think. Highly likely and it will advance to a floor vote, and then Aunt Jemima will be confirmed, if my theory is right.

If it comes down to mitt, lisa or susan, they fail, IMHO. The only thing we missed here is an opportunity to add a Genuine Conservative to the Bench, Give Thomas and Alito some help, but we're use to that....It's the NEW normal.

Just once I'd like to see the republicans have the balls to give the democrats back the same treatment they give. But republicans always worry they won't be liked and suffer at the polls, they need to learn that only rabid libs that already don't vote for them will be upset.

We owe them one.
Replacing RBG was a REALLY big deal. First, we replaced a liberal judge with (one who will hopefully mature into) a conservative --- and we did it within spitting distance of a Presidential election; the outcome of which could have kept the seat filled with a liberal for a generation.
What's happening now is no big whoop ... a liberal for a liberal in a liberal President's second year of his first term.
Other than breaking with the court's own decision on discrimination practices, this is a nothingburger.

Republicans need to oppose any affirmative action pick as unqualified. Now is time for honesty. We know that Joe Biden plans to exclude the vast majority of candidates from consideration. The left eventually will regain control of the court, and some Joy Reid clone will write the majority opinion.

I would guess that the DEMS are plotting a way to make the GOP appear as Racists in this process, but we're lucky it's a mid-term election and not a 'Big' one.
