Title: New York court breaks rules, refuses investigation into James Comey

The New York courts have refused to pursue an investigation against former FBI Director James B. Comey and several other major figures involved in the Clinton email scandal, seemingly breaking their own rules in the process.

Ty Clevenger, a lawyer, had filed grievances against Mr. Comey and three others saying they violated fundamental rules of lawyers’ ethics by the way they handled the investigation into former Secretary of State Hillary Clinton’s emails.

The New York grievance commission, in a letter dated earlier this month, rejected all of the complaints without comment.

Under the commission’s own rules, it is supposed to provide “a brief description of the basis for the determination,” so the move to dismiss the grievances without any reason was striking.

This is not surprising and it’s not confined to NY.  Disciplinary committees rarely act against prosecutors or investigators.

In this case, it’s definitely a matter of “professional courtesy” - although they rarely extend the same courtesy to members of the defense bar.

I guess it is definitely a matter of "professional courtesy" to hate lawyers, @Frank Cannon

I wouldn't expect the NY Bar to take action against Comey in response to Mr. Clevenger's claims of "illegal conduct" if the US Department of Justice isn't interested in taking action first.

The New York  barr is as corrupt as everything else in that state.

This isn’t limited to NY. It is rare that an attorney in the executive function of government is subjected to discipline for actions taken while in office.

The problem (broken rule) stated is they didn't provide the proper documented reasoning.

However, from a practical standpoint, wouldn't this be a federal issue as it was a violation of federal law and statute, not a state issue to investigate?

No, it’s a bar disciplinary proceeding against a lawyer who, I assume, is admitted as such in NY.
