America First Legal Files Petition to Stop the FCC’s Unlawful Collection of Race and Sex Data of Television and Radio Broadcasters

America First Legal (AFL), with co-counsel Boyden Gray PLLC, has filed a petition for review in the U.S. Court of Appeals for the Fifth Circuit on behalf of the National Religious Broadcasters and American Family Association against the Federal Communications Commission (FCC) for its order unlawfully requiring television and radio stations in the United States to publicly report the race, ethnicity, and sex of their employees.

On February 22, 2024, the FCC announced that it would begin collecting “[d]ata concerning the gender, race, and ethnicity of a broadcast station’s workforce” and make the submissions from each television and radio station publicly available.

The FCC claims that this “data will not be used for the purpose of assessing any aspect of an individual broadcast licensee’s or permittee’s compliance with…nondiscrimination or equal employment opportunity requirements.” However, the FCC never clearly explains what this data collection is for, only making vague allusions to using it “for purposes of analyzing industry trends and making reports to Congress.”

The real purpose is obvious: to put pressure on broadcasters to institute discriminatory employment practices. ...

“In addition to the poor driving range and higher purchase price that comes with an EV, owners of cars in northern states will soon be forced to contend with poor performance in cold weather. Federal and state officials should reconsider their efforts to ban gasoline vehicles.”

January of this year brought near-zero temperatures to Chicago and other northern cites, producing an electric vehicle (EV) charging nightmare. National media showed images of owners pushing dead EVs around charging stations and waiting for hours to try to charge their vehicle. Drivers lucky enough to connect to a charger sat in their freezing-cold automobile, unable to run the heater while the car tried to charge. Nevertheless, the federal government and many states continue to push to eliminate gasoline vehicles.

On March 20, 2024, the Environmental Protection Agency announced a final rule, Multi-Pollution Emissions Standards for light vehicles sold in model years 2027 to 2032. The rule includes restrictions on the amount of carbon dioxide that can be emitted per mile, restrictions which most gasoline cars will be unable to meet. The goal of the rule is to force manufacturers to produce EVs for up to 56% of new light vehicle purchases by 2032.

The Green Energy Wall Can't Arrive Quickly Enough

We are fast approaching something I have called the “Green Energy Wall.”  The “Wall” consists of some combination of real-world obstacles, partly cost and partly physics, that will inevitably end the quest for emissions-free “net zero” electricity generation well before the goal of zero emissions is reached.  I first identified the approaching Wall in this post in December 2021, and remarked that it was “gradually coming into focus” in this follow-up post in November 2023.  Everyone who pays attention and is capable of doing basic arithmetic knows that the we are approaching this Wall, some jurisdictions much faster than others.  (New York has voluntarily put itself in the front ranks.).

What we don’t know is how the hitting of the Wall will manifest itself:  Widespread and frequent blackouts?  Regular, enforced load-shedding brown-outs?  Tripling or quadrupling of electricity prices?  A political uprising as people realize that they have been duped by scammers claiming that an energy transition would be easy and cheap?  Or perhaps it will be all of the above.

Meanwhile, the years pass slowly.  The impossibility of the situation we are digging into becomes more and more obvious, but so far there is no obvious crisis.  Will it arrive in another year, or two?  Or maybe five?

Since the 1970s, China has been waging an effective long-term strategy to transform its energy resource vulnerabilities into a net advantage. China’s growing control of and influence over global energy supply chains is providing it with new sources of leverage. Worse still, the U.S. is actively contributing to China’s dominance over the green energy domain while failing to exploit the challenges China has in this sector. With the energy policy trajectory under the Biden Administration, China is positioned to dominate future energy markets for decades to come.
