The federal indictment alleges Trump retained classified documents he was not entitled to, knowingly showed off sensitive documents to people without clearance and obstructed investigators by moving documents from place to place and proposing they destroy some of the papers.

The idea that the DOJ needs five years to decide whether to indict Hunter Biden but was able to cook up an indictment of Trump in less than a year only makes sense in the face of corruption and political favoritism.

That was probably what got the DOJ to move, so they could distinguish it from Hillary and Sniffy.

The indictment references a previously reported event from July 2021 at his Bedminster, New Jersey golf club where he described and showed a document about a 'plan of attack' that he said was prepared by the Pentagon. That appeared to be a reported document about U.S. attack plan off the shelf for Iran that Trump used to try to disparage Chairman of the Joint Chiefs Gen. Mark Milley, whom he said had drawn it up.

It also says in September 2021 Trump showed a representative of his PAC, also at Bedminster, a classified map about an unidentified 'military operation.' He told the representative that he should not be showing it – language suggestion prosecutors could use to try to establish consciousness of guilt.

 The indictment was unsealed shortly after news broke that former 'bodyman' and aide Walt Nauta was also being indicted, and both men's name are listed on the charging document.

The document mentions the grand jury subpoena for information from March 2022 requiring the return of documents, and says Trump 'endeavored to obstruct the FBI and grand jury investigations and conceal his continued retention of classified documents.'

My first take on this:

When an indictment is released, as in the case of President Trump, it presents a completely one-sided story developed by the prosecutor.  Witnesses are not represented by attorneys, there is no opportunity for cross-examination, there is no opportunity for presenting exculpatory information, etc.  It is not a trial jury.  The indictment appears to me to be a piling on, which explains why the prosecution brought in as many witnesses and documents as possible, cherry-picking information, etc.  Even now, nobody is present to deal with these charges in the media  -- for example, why is it assumed in some instances that the movement of some boxes was for the purpose of concealment.

Remember, virtually none of this would be an issue but for the original decision by the Biden White House and DOJ to turn this into a criminal case.  Most of what is claimed in these charges flow from that decision.  And attorney-client privilege was circumvented in at least one instance, I would argue, which will be a basis for challenge, among other things.

If any of the alleged evidence is based on violations of privilege, due process, etc., would result in the prosecution having to figure out what parts of that information was used to poison other witnesses or the presentation of information to the grand jury.

Now, they are trashing the federal judge in the Miami arraignment (perhaps the entire case), who is a Trump appointee (the judges handling all motions respecting the grand jury were Obama appointees, and that did not draw the criticism of these same critics, of course).

So the 2024 vote will be a referendum on the Trump prosecution, and if Trump wins, he can immediately pardon himself.

Any executive branch document created before or during a Presidency is the President's to do with as he pleases. That's the point of The Presidential Records Act. It has to be that way to keep Constitutional power in the hands of the only elected official of the executive branch.

Importantly, the Presidential Records Act has NO criminal penalty because the Congress and Carter had no intention of criminalizing document retention matters.  And never before has the 1917 Espionage Act was never even discussed as applying to a former president.  There is no justification for criminalizing this matter against Trump.
