Judge keeps death penalty on the table in Charlie Kirk assassination case
Judge Tony Graf ruled that prosecutors may continue seeking the death penalty against Tyler Robinson, who is accused of killing Charlie Kirk.
"The question at this stage, however, is not whether the state proved the aggravator beyond a reasonable doubt," Graf said from the bench. "Because credible evidence and reasonable inferences support probable cause as to each element, under that limited standard, the state has met its burden."
Graf emphasized that whether prosecutors can ultimately prove the aggravating circumstance beyond a reasonable doubt "remains for trial."
The judge also found the state established probable cause for the victim-targeting allegation, allowing the capital sentencing enhancement to move forward as the case heads to trial.

Judge Tony Graf ruled Tuesday that all seven charges against Tyler Robinson will move forward to trial, concluding prosecutors presented enough evidence to establish probable cause on each count during the preliminary hearing.
The seven charges are as follows:
Charge 1: AGGRAVATED MURDER - 1st Degree Felony
Charge 2: FELONY DISCHARGE OF FIREARM - CAUSING SERIOUS BODILY INJURY - 1st Degree Felony
Charge 3: OBSTRUCTION OF JUSTICE - CAPITAL/FIRST DEGREE FELONY CONDUCT - 2nd Degree Felony
Charge 4: OBSTRUCTION OF JUSTICE - CAPITAL/FIRST DEGREE FELONY CONDUCT - 2nd Degree Felony
Charge 5: TAMPERING WITH A WITNESS - 3rd Degree Felony
Charge 6: TAMPERING WITH A WITNESS - 3rd Degree Felony
Charge 7: VIOLENT OFFENSE COMMITTED IN PRESENCE OF A CHILD - Class A Misdemeanor
