"This is not an extension of open enrollment," Sebelius told Michigan Fox 2. "It is just saying, like you do on election day, if you're in line to vote, we want to make sure you vote."

In congressional testimony last month before the House Ways and Means Committee, Sebelius told Rep. Kevin Brady (R-TX) that there would be no delay of the enrollment deadline. Centers for Medicare and Medicaid Services spokeswoman Julie Bataille said last month that the open enrollment period would not be extended and that, "In fact, we don't actually have the statutory authority to extend the open enrollment period in 2014."

Now, however, Bataille presumably believes the Obama administration does have statutory authority.

“We are... making sure that we will be ready to help consumers who may be in line by the deadline to complete enrollment – either online or over the phone,” said Bataille.

Congress ought to ratify the administration's many extensions and waivers by authorizing the President and/or Secretary to make such decisions with absolute discretion. That will then allow the next GOP President to effectively repeal the whole thing by executive order.

I'd like to see a bill proposed in the House giving the President and/or HHS Secretary unlimited authority to waive or postpone any and all deadlines and obligations in the ACA. Makes what Obama is doing constitutional, and makes it real easy for the next GOP President to get rid of the whole thing.

And it'd be fun to see how the Democrats would argue against it.

They will be in line waiting UNTIL Obama bails out all the insurance companies BUT ONE. The one insurance company will be the one that gives the most to the Obama/dem campaign. And then, bow down to Uncle Obama, we are your new insurance company and you must pay, or be charged a tax and you must get maternity care even if you are 96 years old.


Obama cannot even control his new car company Government Motors, without failure and corruption.

interesting; however, I wouldn't want to play that game of chicken with the roster of players we currently have on our team.

We are being governed by lawless people, wholly lacking in virtue, and dedicated to the extension of their own power unto infinity.
