Title: ATF proposes rule to close 'gun show loophole'
Post by: Elderberry on September 04, 2023, 01:02:30 pm
abc News By Luke Barr 9/1/2023

The rule comes after bipartisan legislation was passed last year.

A new proposed rule by the Bureau of Alcohol, Tobacco, Firearms and Explosives would increase what is required to obtain a federal firearms license (FFL) for gun sellers across the country -- an attempt to end what gun control advocates term "the gun show loophole."

Justice Department officials told reporters that prior to the Bipartisan Safer Communities Act, which was signed into law last June, those "engaged in the business" of a firearms dealer were defined broadly. The definition that ATF is proposing is more specific in an effort to better regulate the market in accordance with the new federal law.

Gun rights groups criticized the Biden administration's proposal.

"First, they said five guns, but now, anyone who sells a single firearm in a given year and makes even a penny of profit will be subject to dealer requirements, including a background check," Erich Pratt, Gun Owners of American Senior Vice President, said in a statement. "People need to realize this is just the next step in the anti-gunners' longform playbook to enact backdoor universal registration of firearms, and eventually, to confiscate all firearms. They will not stop until that day."

Define Profit.

In real terms.

Keep in mind that $230 spent on a firearm in 1980 is matched in buying power by $853.26 in 2023.  Yes, inflation has chewed up that much of the value of the dollar.
That same firearm, used,in today's market is worth about $750.00 in 2023 dollars, which is less buying power that the original purchase price equivalent today.

In terms of what the money can do, selling that (Formerly, in 1980) $230 firearm for $750 in 2023 represents a net loss of $27.83 (in 1980 dollars). Not a profit.

There is no "gun show loophole" and this is just an attack on private citizens being able to sell their gun.

They literally contradict themselves. There's no loophole because it's not covered in the laws. Nobody is getting away with anything, it is legal to privately sell your gun to another individual without an FFL and background check.

They are trying to make illegal which is legal in the first place, which is basically admitting it's a legislative job to 'fix'. The Executive does not have the power to 'close' a 'loophole'.

@roamer_1 If you want to read a vintage Field and Stream article on forestry practices in the American West, go to the above link and scroll down a couple of pages. People have been trying to tell them for 45 years...and the smoke is so thick it's hard to see 1000 ft. here today.
