The 5th Circuit expressed skepticism about arguments from both sides in considering whether a coalition of Black and Latino voters should be granted the same protections as a single racial group under the Voting Rights Act.

A full panel of federal appellate court judges was split over whether a coalition of voters of color should be afforded the same protections under the Voting Rights Act as a single group of protected citizens during Tuesday’s oral arguments over a Galveston County redistricting case.

The hearing before the 5th U.S. Circuit Court of Appeals was not tasked with determining if Galveston County commissioners discriminated against Black and Latino voters by dismantling a district made of a majority of voters of color. Rather, the judges are considering whether a coalition of Black and Latino voters should be granted the same protections as a single racial or language minority group under the 1965 Voting Rights Act.

Some appellate judges on Tuesday warned that extending protections to groups of minority voters would result in an avalanche of discrimination claims.

But others were open to including coalitions in the Voting Rights Act as a means of preventing voter dilution.

“What the Supreme Court has said is that the Voting Rights Act should be interpreted in a manner that provides the broadest scope possible in combating racial discrimination,” Judge Dana Douglas said.

The original case stems from the question of whether local officials violated the rights of Black and Latino voters when they redrew a precinct of the Galveston County Commissioners Court primarily composed of voters of color.

Nicolas Riley, a lawyer for the Justice Department, argued that Galveston County’s redistricting efforts harmed both Black and Latino voters. Thus, those two groups of voters should be interpreted as a single “class” under the Voting Rights Act given they were similarly injured. Riley rejected the definition of class in the federal voting legislation to refer to a single racial group.

Judge Edith Brown Clement said this interpretation would extend the precedent set by Thornburg v. Gingles, a 1986 Supreme Court case that affirmed that a North Carolina redistricting plan had unlawfully discriminated against Black voters. If the Justice Department’s interpretation of coalition was correct, then the Supreme Court would have stated so in previous rulings, Clement said.

BFD!  A ten GAME suspension!  That's only TWO scheduled STARTS for a rotation pitcher.

Should be at least a FIFTY (50) DAY suspension...locked out of the league, not just the field.  Without salary!

New book reveals stunning true stories of Jan. 6 patriots

Ashli Babbitt entered the Capitol alone on the Senate side of the Capitol through a broken window at 2:23 p.m. on January 6, 2021. Once in, she encountered a female police officer who directed her towards the House side.

As Ashli walked, recording her fellow protestors with her iPhone along the way, she saw crowds wandering peacefully through the many rooms and corridors of this vast building. Uniformed police officers looked on, seemingly as clueless and confused as the protestors. There were no commands being given, no arrests being made, no police being attacked or abused.

At 2:25 p.m., Ashli climbed over a velvet rope to honor the walking lane designated for visitors. Still alone, Ashli made her way to the hallway leading up to the main door of the House Chamber.

A crowd had already gathered there. Not one to follow the crowd, literally or figuratively, she continued to explore the Capitol. At 2:36, Ashli, now accompanied by citizen journalist Tayler Hansen, walked down the long, narrow corridor leading to the Speaker’s Lobby.

Hansen recorded her as she walked. Guarding the lobby doors were three USCP officers – Sgt. Timothy Lively, Officer Kyle Yetter and Officer Christopher Lanciano. Hansen offered the officers some water, while Ashli joked with them. Within a minute or two, the trailing crowd of roughly thirty people quickly filled up the hallway in front of the lobby doors.

In that crowd was Zachary Alam, thirty, from Centreville, Va. In October 2023, former CBS reporter Sharyl Attkisson did a feature on Alam and two other potential provocateurs for her show “Full Measure.”

Attkisson explained, "I didn't see key provocateurs removed from the crowd. In fact, the key provocateurs in this case seem to be sort of tolerated, if not encouraged, by some of the police officers on the front line."

Free to roam despite his erratic behavior, Alam moved to the front of the crowd, reached between the officers, and began punching the glass panels while yelling, “F*** the blue.” This was not a MAGA thing to say or do. In fact, as Attkisson pointed out, Alam had no social media history tying him to Trump or the MAGA movement. He had, however, been arrested a half-dozen times in the previous four years.

Appalled by Alam’s behavior, Ashli’s police training kicked in. “Call f***ing back-up!” she shouted at the feckless officers as they stood in place with their backs to the doors, doing nothing.

“She was basically yelling at these officers telling them to do their jobs,” said Hansen. For more than a minute after the first window was cracked, protestors argued with the officers but did not touch them or threaten them. Nor did they smash any more windows. At one point, Alam stood with his back to the officers keeping the crowd at bay. Clearly frustrated, Ashli wandered away from the doors.

Do non-citizens vote in U.S. elections?

The answer, of course, is yes, they do. That is the subject of the most recent episode of The Drill Down, featuring co-host Eric Eggers, whose 2018 book FRAUD examined the history and various ways that election fraud has occurred in U.S. elections historically.

A recent academic study based on surveys done for the Cooperative Congressional Election Studies showed evidence that non-citizens are voting in our elections in meaningful numbers. As many as 27 percent of non-citizens surveyed were registered to vote, and as many as 13 percent of them actually cast ballots.

In response, House Speaker Mike Johnson (R-LA), introduced legislation requiring proof of citizenship before registering to vote.

Peter Schweizer and Eggers note that the influx of illegal immigrants (an estimated 16 million since President Joe Biden took office) means that the potential pool of illegal voters rises to between 1 million and 2.7 million ballots.
