'Biden has grossly overreached his authority'

A Christian college is asking the Supreme Court to let it keep separate dorms and showers for men and women.

It is the College of the Ozarks in Missouri, represented by the Alliance Defending Freedom, that is asking that it be allowed to uphold its biblical standards and offer those facilities only on a basis consistent with students' biological sex.

Earlier, the 8th U.S. Circuit Court of Appeals had determined that the school wasn't allowed to sue the Biden administration for new rules requiring open facilities – available to anyone claiming any gender identity.

According to a report by Decision Magazine, the school sued Biden in 2021 to protest a Department of Housing and Urban Development rules declaring that dorms and showers are open for all.

Hard to tell, but it sounds as if the school is asking the Court to grant emergency interlocutory relief before the case has been decided on the merits.  In other words, SCOTUS could reject this, but the school could still ultimately win the case later.
