January 6 Committee to Conclude by Asking DOJ to Prosecute Trump

The Democrats’ January 6 Committee will conclude its “investigation” on Monday by asking the Department of Justice (DOJ) to prosecute former President Donald Trump, though the committee lacks constitutional authority to do so.
Congressional committees must be organized for a legislative purpose, not as part of a law enforcement action, which is a function of the executive branch under the separation of power in the Constitution.
Nevertheless, the January 6 Committee — in what is expected to be its final act before a Republican-led House takes over next month — is expected to ask the DOJ to prosecute Trump for what it says are multiple crimes.
Committee member Rep. Adam Schiff (D-CA), who misled the public about evidence of “Russia collusion,” lied to the public about his own role in a “whistleblower” complaint that led to Trump’s first impeachment, made up a phony “transcript” of Trump’s phone call with Ukrainian president Volodymyr Zelensky, and spied on fellow members of Congress during the impeachment investigation, called for three criminal charges against Trump during an appearance Sunday on CNN’s State of the Union.
Those charges are expected to be “insurrection, obstruction of an official proceeding, and conspiracy to defraud the federal government,” though Schiff would not confirm the committee’s plan. The latter charge refers to the Trump campaign’s effort to prepare an alternative slate of electors in case the courts invalidated the Electoral College votes in disputed states.

Former President Trump on Sunday slammed lawmakers on the House select committee investigating the Jan. 6, 2021, attack on the U.S. Capitol, calling them “Thugs and Scoundrels” as the panel prepares for a final public hearing and report this week.
The panel has also expected to issue symbolic criminal referrals on Monday, with multiple members arguing there is plenty of evidence that Trump is guilty of crimes.
“Republicans and Patriots all over the land must stand strong and united against the Thugs and Scoundrels of the Unselect Committee,” Trump wrote on his Truth Social platform. “It will be a dark period in American history, but with darkness comes light!!!”
The House panel, which investigated Trump’s efforts to overturn the 2020 election for more than a year, will hold a final public hearing on Monday before releasing a report Wednesday on what led up to the Jan. 6 attack.
Its criminal referrals would not be binding but could increase pressure on the the Department of Justice (DOJ) to indict Trump or others in his orbit. Attorney General Merrick Garland appointed a special counsel last month to oversee the ongoing probe into the role of Trump and his allies in the Capitol attack.

Confirmed: January 6th Committee Will Jump the Shark With Final Move Against Donald Trump

The conclusion was never in doubt for the January 6th committee. Despite a year-plus of investigations and hearings that over-promised and underdelivered, Liz Cheney, Bennie Thompson, Adam Schiff, and crew will send criminal referrals targeting Donald Trump to the Department of Justice.
As Redstate reported previously, the details of the referrals were previously leaked, showing that the committee is going to charge Trump with insurrection, obstruction of an official proceeding, and conspiracy to defraud the United States. Now, the vote has been completed and it is confirmed those referrals will go forward. The announcement will be made in dramatic fashion on Monday during the committee’s final hearing.

Jan. 6 committee holds final public meeting
The House select committee investigating the Jan. 6, 2021, insurrection has begun its final public meeting.
The panel is expected to announce criminal referrals to the Justice Department and Chairman Bennie Thompson, a Mississippi Democrat, has said the panel will approve its final report at the meeting. It won’t be made public until Wednesday. Members of the committee have promised to release the report before the end of the year since Republicans are expected to dissolve the panel when they take over the House in January.
The meeting — which, unlike previous gatherings of the committee, is not a hearing with witnesses — will include a presentation and cover the names of people facing criminal and other referrals, as will as the basis for those referrals, Thompson said last week.
CNN previously reported the committee will refer at least three criminal charges against former President Donald Trump to the DOJ, including insurrection, obstruction of an official proceeding and conspiracy to defraud the federal government. The panel has also weighed criminal referrals for a number of Trump’s closest allies...........
House select committee Chair Rep. Bennie Thompson told CNN that the Jan. 6 committee will send the criminal referrals to the Justice Department “shortly after we take care of business today.”
There are “no plans” as of yet to meet with special counsel Jack Smith, he added.............

The House panel investigating the violent Jan. 6, 2021, attack on the U.S. Capitol urged the Justice Department on Monday to seek criminal charges against former President Donald Trump for his extensive efforts to overturn his 2020 election loss.
Lawmakers recommended charges on four counts stemming from Trump’s monthslong effort to stay in power after his election defeat — obstruction of an official proceeding, conspiracy to defraud the United States, conspiracy to make a false statement and efforts to incite, assist, or aid or comfort an insurrection.
The panel voted unanimously to send the criminal referrals to the Justice Department. The referrals, which mark the first time that the House has recommended criminal charges against a former president, do not guarantee that Trump will be indicted — but they do add to the evidence being weighed by the Justice Department and special counsel Jack Smith in its own investigation of Trump.
Members of the panel argued that Trump’s efforts to overthrow the election results, from pushing unsubstantiated claims of voter fraud to urging his supporters to send fake electors to Washington, form enough evidence for federal prosecutors to win a conviction against the former president.
“Even if it were true that President Trump genuinely believed the election was stolen, this is no defense. No president can ignore the courts and purposely violate the law no matter what supposed ‘justification’ he or she presents,” House investigators wrote in a section of their report released Monday...............

The House select committee investigating the January 6, 2021, attack on the US Capitol has concluded that former President Donald Trump was ultimately responsible for the insurrection, laying out for the public and the Justice Department a trove of evidence for why he should be prosecuted for multiple crimes.
“That evidence has led to an overriding and straight-forward conclusion: the central cause of January 6th was one man, former President Donald Trump, who many others followed,” the committee writes in a summary of its final report released on Monday. “None of the events of January 6th would have happened without him.”
The summary describes in extensive detail how Trump tried to overpower, pressure and cajole anyone who wasn’t willing to help him overturn his election defeat – while knowing that many of his schemes were unlawful. His relentless arm-twisting included election administrators in key states, senior Justice Department leaders, state lawmakers, and others. The report even suggests possible witness tampering with the committee’s investigation.
The committee repeatedly uses forceful language to describe Trump’s intent: that he “purposely disseminated false allegations of fraud” in order to aid his efforts to overturn the 2020 election and to successfully solicit about $250 million in political contributions. “These false claims provoked his supporters to violence on January 6th.”
The full report, based on 1,000-plus interviews, documents collected including emails, texts, phone records and a year and a half of investigation by the nine-member bipartisan committee, will be released Wednesday, along with along with transcripts and other materials collected in the investigation.
