WASHINGTON — The U.S. Supreme Court has voted to strike down Roe v. Wade, the 1973 ruling that made abortion legal in all 50 states, Politico reported Monday. The news organization said it had obtained an initial draft majority opinion written by Justice Samuel Alito circulated inside the court.
The news site called the draft opinion "a full-throated, unflinching repudiation of the 1973 decision which guaranteed federal constitutional protections of abortion rights and a subsequent 1992 decision — Planned Parenthood v. Casey — that largely maintained the right."
Alito wrote, "Roe was egregiously wrong from the start."
The document, labeled as a first draft of the majority opinion, includes a notation that it was circulated among the justices on Feb. 10. If the Alito draft is adopted, it would rule in favor of Mississippi in the closely watched case over that state’s attempt to ban most abortions after 15 weeks of pregnancy.
A Supreme Court spokesperson declined to comment or make another representative of the court available to answer questions about the draft document.
POLITICO received a copy of the draft opinion from a person familiar with the court’s proceedings in the Mississippi case along with other details supporting the authenticity of the document. The draft opinion runs 98 pages, including a 31-page appendix of historical state abortion laws. The document is replete with citations to previous court decisions, books and other authorities, and includes 118 footnotes. The appearances and timing of this draft are consistent with court practice.

According to the report, Associate Justices Clarence Thomas, Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett joined Alito in a 5-4 decision to overturn the law.

In the short term, Biden and Democrats intend to seize on the apparent overturning of Roe to galvanize voters ahead of the November midterm elections. They are desperate to motivate a base that’s been disappointed by the president’s inability to get much of his agenda through a narrowly divided Congress, and to appeal to swing voters given that a solid majority of Americans support maintaining abortion rights.
“If the court does overturn Roe, it will fall on our nation’s elected officials at all levels of government to protect a woman’s right to choose. And it will fall on voters to elect pro-choice officials this November,” Biden said in the statement, noting that Democrats don’t currently have the ability to codify abortion rights. “At the federal level, we will need more pro-choice senators and a pro-choice majority in the House to adopt legislation that codifies Roe, which I will work to pass and sign into law.”

If the Court really wants to push back, it should declare that, because the illicit leak has irrevocably tainted the case and whatever opinion the Court will ultimately hand down, that they are revoking their grant of certiorari in the case, and will take up the matter if and when it presents itself again in a subsequent case.
That would represent a rather milque toast win for the left, because it would not be the Court's new imprimatur on existing abortion rights law, and would remove the impetus the democrats are hoping to use for the midterm elections. It would also take a lot of the pressure (not all) out of the demand to pack the Court. On the other hand, it would generate a huge amount of anger on the part of the right, which should legitimately be directed at democrats/libs/progs and should energize the right to take full control of Congress in the midterm elections.
Sorry @Kamaji but IMHO it is just that sort of thinking that has brought us to the point at which we find ourselves currently. FAR better to just issue the opinion and let the chips fall as they do.

Can the offending US Supreme Court Justice and/or staff be censured, impeached, sanctioned, or prosecuted? It's interference of a Federal judicial proceeding.
It sets a precedent that makes the US Supreme Court susceptible to mob threats and violence.
It further politicizes the US Supreme Court deliberation process.

Sen. Susan Collins (R-Maine) said on Tuesday that a leaked draft ruling by the Supreme Court was “completely inconsistent” with what Justices Brett Kavanaugh and Neil Gorsuch told her during their private conversations as Supreme Court nominees.
“If this leaked draft opinion is the final decision and this reporting is accurate, it would be completely inconsistent with what Justice Gorsuch and Justice Kavanaugh said in their hearings and in our meetings in my office,” Collins said in a statement.
“Obviously, we won’t know each Justice’s decision and reasoning until the Supreme Court officially announces its opinion in this case,” she added.
Collins’s statement comes after Politico published a draft decision from the Supreme Court, authored by Justice Alito, to strike down Roe v. Wade, a landmark case that guarantees the right to an abortion.
The draft ruling concludes by declaring that Roe and the court’s 1992 decision in Planned Parenthood v. Casey have no grounding in the Constitution. The court is expected to issue an actual ruling in the case in the next two months.

I didn't read it that way. I read it as referring to the justices as a group; i.e., that it would have been one of the clerks for one of the justices, not just one of Alito's clerks.

Newsflash: The Left actually celebrates abortions. My colleague Brandon Morse already expertly covered this morbid behavior back in 2020, but with the recent leak of a SCOTUS opinion striking down Roe v Wade — and the Left’s unhinged reaction to it — it seems like the perfect time to re-visit the subject.
Abortion has been a complicated issue for decades, and despite predictions at the time, 1973’s Roe v Wade did not magically make these divisions go away. In fact, the infamous decision arguably made the divide wider because its legal foundation was pathetic, and it basically just made up a brand new right that was never enumerated in the Constitution or its amendments.
Whichever side of the argument you’re on, however, it’s despicable to glamorize what should at the very least be a sober event. Death penalty advocates aren’t known to celebrate executions with confetti and dance, but that’s what some of these sick puppies do.

The first is that for 50 years — despite countless opportunities — Democrats did nothing legislatively to legalize abortion. (Why would they when solving the issue would dry up fundraising and ginning up the base?) So, despite my own beliefs on the issue, a wide swath of America was pretty comfortable with the abortion issue.

Most civilized countries place limits on abortion, anywhere from 12 to 20 weeks. This is why in most civilized countries, abortion is not a galvanizing issue. Most people agree abortion should be legal, most people agree that there must be time limits, and the abortion laws reflect that consensus.
The same is true with Americans. Regardless of my own opinion of the atrocity of abortion, there’s no question that 1) a majority of the public want abortion to remain legal and 2) an even bigger majority want limits placed on abortion.

Joe Scarborough began today's Morning Joe with an act of repentance to the lords of the left, screaming, "what was I thinking?" after admitting he had been a Republican for years.
He then argued that the likeliest scenario is that the draft Supreme Court opinion overturning Roe v. Wade was leaked by a "fanatical" person on the "hard right" who was trying to prevent any of the Justices who had signed onto the draft from drifting away from Alito's opinion. John Heilemann helpfully agreed with Scarborough, saying he would put money on Scarborough's take as the likely explanation.
MSNBC Republican Elise Jordan then proclaimed that "hell has frozen over," because she agreed with Ted Cruz that the leaker was probably someone on the left.
Oh, the temerity to disagree! She argued that if someone on the right had leaked it to keep, for example, Justice Kavanaugh from straying, that would likely have backfired. But Jordan also suggested, without naming names, that the leaker might have been the "spouse" of a SCOTUS Justice. Scarborough jumped on that, naming names, speculating about Ginni Thomas as another possible leaker. She's a "fanatical" advocate on the "hard right" in the view of the MSNBC bubble.

Elizabeth Deutsch wrote hers about reproductive rights and abortion. Specifically, she argued that Obamacare's non-discrimination provision should be interpreted to *force* Catholic hospitals to perform "emergency abortions."

They should have released the Dobbs v Jackson decision immediately after the draft ruling was leaked to the public. By not releasing it already they've allowed the left to mass their forces in DC and now run the risk of being cowered into changing their decision.

Again, incorrect. Amendment II specifically states that the right to keep and bear arms shall not be infringed. Not so with Amendment I. There is nothing in Amendment I that guarantees a right to free speech, free exercise, freedom from establishment, freedom of assembly, etc. Read it for yourself. The Court was right. There is only one indisputable situation where there is a right to kill, and that is in self-defense. There is no right to kill one's own child in the womb, and there never was.
But I have seen everything from the manufactured sob stories, to the sexist efforts to silence men because they can't have children, to offers to smuggle women out of state to murder their own children, even to calls for assassination (thinly veiled of course).

To give you a different perspective of the same issue, I grew up as the only child of a single mom who was pro-choice and pro-Roe. Back then, I would have given anything for a brother or a sister. Looking at it now, maybe I did. It breaks my heart to see mothers with their daughters in tow out in the streets championing the killing of the yet-to-be-born. What sort of message are they imparting to their children? That they were lucky enough to survive their mothers' whims, while possibly a brother or sister was not.

Protests over the United States Supreme Court’s ruling overturning Roe v. Wade brought an estimated 7,000 to 8,000 people to the Arizona State Capitol Complex in Phoenix on Friday, June 24, 2022.
What began as a peaceful protest evolved into anarchical and criminal actions by masses of splinter groups. As groups realized the state legislature was in session, they attempted to breach the doors of the Arizona Senate and force their way into the building. The violence of their efforts literally shook the building and terrified citizens and law makers who occupied the building. As the glass doors bowed from attempts of forced entry, the occupants of the building were instructed to move to secure locations.
Due to the direct threat to the occupants of the Senate building and damage to the building itself, Arizona State Troopers took immediate action and utilized tactics including the deployment of field force teams and tear gas.
As the riotous behavior at the Legislature was taking place, concurrent and spillover criminal misconduct in the form of felony criminal damage and the defacing of state memorials was occurring in Wesley Bolin Plaza.
Troopers exercised patience and application of tactics in Wesley Bolin Plaza as some people unwisely brought children to the protest turned unlawful assembly. After multiple warnings, and notifications of trespass and unlawful assembly, state troopers deployed gas and strategically moved to clear the plaza. After the plaza was cleared, additional state buildings in the area sustained criminal damage.

No, it did not. It found that the federal Constitution did not guarantee a right to abortion. That is all it did. It did not hold that no court, including a state court, could rule on the issue.

The one thing Dobbs most emphatically did not do is strip state courts of the power to hear matters relating to abortion. For one thing, the Court has absolutely no power to do so.

The Court ruled that the Great State of Mississippi does indeed have the right to establish it's own laws in regard to abortion.It also said this as a result of the ruling.

Scotus ruled that the Judicial System (Itself and all inferior courts) has no right to create a constitutional right to abortion as it did with Roe vs Wade.
It then said that the people (read citizens through its representatives in our Democratic Republic under the US and State Constitutions) have the right to decide whether there should be a right to abortion or not (read create a law or Constitutional Amendment).
