Supreme Court Justice Sonia Sotomayor granted a last-ditch plea from Catholic groups Tuesday night to block a birth control mandate in the new health care law for religious organizations, just hours before it was to have gone into effect.
Sotomayor issued the stay specifically for the Little Sisters of the Poor of Baltimore and Christian Brothers Services of Illinois.
The groups requested the emergency stay of provisions of the Affordable Care Act that require companies — regardless of religious beliefs — to provide contraceptives and other abortion-inducing drugs to their employees.
The groups wanted the mandate halted while the court considers a legal challenge, brought by the for-profit company Hobby Lobby, arguing that the requirement violates their religious liberties.
In June, the 10th U.S. Circuit Court of Appeals in Denver waived millions of dollars of fines against Hobby Lobby and a subsidiary, Mardel Christian Stores, which refused to comply with the mandate, writing that the companies were likely to win their claim that requiring for-profit companies to pay for birth control was a violation of religious protections.
The motion for a stay went to Sotomayor as the justice with oversight for the 10th Circuit.

At the heart of this is the Religious Freedom Restoration Act. And thanks to the 1993 law, it will give the court's conservatives, including Scalia, a chance to deal a blow to Obama's healthcare law

It is to allow the case to continue through the lower courts, while blocking the plaintiffs from being forced to pay for abortions and contraception.
Sotomayor knows it is going to end up before the Supreme Court, but like all SC justices, wants to hear from the various appellate courts first.

Did you just at that to the title of this thread? (while it goes thru the lower court/) or did I miss that when I read the title?

Most likely not until next term, which begins in October. While there is still time to add it to the current term, the cases are still moving through the appellate courts so the SC is likely to wait until that all plays out. We all know the courts do not usually move very quickly, unless it is a liberal activist judge on a mission.

I don't trust these people in any way. So I am looking for the angle. I see it now. If they get this in Oct '14 they won't give out the decision for months. So this mandate stops until maybe '15. Obama gets another delay without looking like he did it. I never trust them

If the businesses prevail, the handwriting is on the wall for the religious organizations. Sotomayor no doubt knew that there were 4 other justices who would support her granting a stay.
