We don’t know if the FBI raid on Mar-a-Lago is related to Jan. 6th, the Trump Org. or something else until we see the warrant.
It would have to show probably cause that specific evidence of criminal conduct will be seized in a specific place to be searched.

Hillary Clinton had classified documents at her home. No FBI raid. This is the persecution of one man and it has changed the game forever.
@roamer_1 I don't think he is guilty of anything. This is a raid on an ex-president's home! What crime has he been charged with? The J6 investigation didn't turn out the way that they had hoped. With many FBI agents entering his home and from the report they are 'occupying' the place. So are they staying there until they find what they want?
First thing that pops into my mind is what evidence are they going to 'plant' at Mar a Lago so that they will have something to prosecute him with???

@libertybeleNo more guilty than the 500 members of congress and the 1 million+ federal employees.
I don't KNOW he's guilty of anything. Other than the things that already made the press (I am talking long ago).
But I would be very surprised to learn he is guilty of nothing.
He's a decent con, not first rate, but decent. He cut his teeth on casinos. he plays a big game in a big city... and he levered that into a global position in entertainment and hospitality. You don't do those things and keep clean hands. Sorry, but that's a fact.
BUT, he is only as guilty as the things you catch him at - And so far, bupkis.
That's to be expected if he's good at playing dirty, even more so than if he's innocent.
And none of what I am saying here is intended to knock him - I seriously mean that.
He's a hardball player and they are expecting to trip him up with fishing expeditions that he is all too sure to be ready for.

@mystery-ak He is a smart man and usually one step ahead of people, but in this case, I don't think he ever considered that the leftist would raid the home of an ex-president.
Just my opinion here --- Those prosecuted for J6 that are in prison was a warning to ALL of us. If you vote Republican you will be hounded by the IRS. If you give to a GOP political candidate, the IRS will hound you. I see intimidation happening at the polls. If you have a permit to carry the IRS is going to hound you.
Their next step that I feel strongly is going to happen, will be them going door to door and seizing weapons. You don't turn them over, they will raid your house, confiscate and march you off to jail or a camp.

This nation is in a great deal of trouble. Not because of its people, who are largely good and decent, if often subject to poor education and purposely misleading messages.
But rather because of a thoroughly corrupt, malign and ill-willed government class whose increasingly isolated and unelected bureaucrats now only weakly pretend to support what they privately despise: American independence and liberty. Instead, they crave absolute power, and are rapidly dropping their inhibitions toward achieving that end.

Not a chance. He has some pretty slick lawyers on retainer, and on top of that he is no fool. No way would he have incriminating evidence against himself in his home safe when all he would have had to done was board one of his private jets and place it in a safe deposit box in some offshore bank.
Hell,as far as that goes,IF he had anything incriminating, all he would have had to done was give it to his lawyer and tell the lawyer to save it for him.
This is nothing but show biz and a lame attempt to get the class envy voters on the DIM side.\
Good thing for Biden and the DNC that Trump is too much of a mild-mannered man to fight back, huh?

@mystery-ak
Since the Feebs didn't inventory every box and give whoever was in charge at Key Largo a receipt for every document or other "piece of evidence" they seized, I suspect Trump's lawyers can get it thrown out of court on those grounds alone.
Unless of course they want to dig in deeper and try to find cause to demand the alleged Justice Dept file charges for abuse of authority, etc, etc, etc against Slow Joe and his whole team of babysitters.
After all,if they DIDN'T do that, how are they going to be able to assert, never mind prove, that everything they present was a product of the raid?
The only thing that makes any sense at all about this thing is my suspicion the left already has a tame judge lined up to let them have their way.
Clinton Lawyer: FBI Raid Designed to Disqualify Trump from “Holding Any Office” Ever Again
https://welovetrump.com/2022/08/08/clinton-lawyer-claim-fbi-raid-designed-to-disqualify-trump-from-holding-any-office-ever-again/ (https://welovetrump.com/2022/08/08/clinton-lawyer-claim-fbi-raid-designed-to-disqualify-trump-from-holding-any-office-ever-again/)
Why did the FBI raid Mar-a-Lag0?
According to Hillary Clinton’s lawyer, the FBI raid would disqualify Trump from “holding any office” ever again.
This comes from Marc Elias, the man who was responsible for spreading the (debunked) rumors of Trump-Russia collusion.
Elias points to code 18 U.S. Code § 2071:
(a)Whoever willfully and unlawfully conceals, removes, mutilates, obliterates, or destroys, or attempts to do so, or, with intent to do so takes and carries away any record, proceeding, map, book, paper, document, or other thing, filed or deposited with any clerk or officer of any court of the United States, or in any public office, or with any judicial or public officer of the United States, shall be fined under this title or imprisoned not more than three years, or both.
(b)Whoever, having the custody of any such record, proceeding, map, book, document, paper, or other thing, willfully and unlawfully conceals, removes, mutilates, obliterates, falsifies, or destroys the same, shall be fined under this title or imprisoned not more than three years, or both; and shall forfeit his office and be disqualified from holding any office under the United States. As used in this subsection, the term “office” does not include the office held by any person as a retired officer of the Armed Forces of the United States.

If the charges are dropped, they don't have to prove a damn thing in court, and IF Trump were to file a counter-suit against them, they would be able to get any suit set aside until after the next Presidential elections, which they plan to steal again.

What did the warrant say?
Saw someone interviewed on PMSNBC who was once assigned to that office. Everyone in the interview assumed that the Miami office was the group that executed the raid. Hearing that the DC office did it shows they overstepped their bounds. The warrant had to come from Florida.
Anybody know Garland's home address?

The Biden Administration raid on former President Trump’s Florida home is a bald attack on our republic. The Democrat Party is dragging us into the Third World. Raiding and ransacking a former president’s home, and likely future candidate for president against Biden (who has insisted he’s running again), is bullshit. This an unprecedented act of state-sponsored lawlessness. Millions have rightly lost faith in the DOJ, FBI. media, and Congress, and this is beyond anything I can ever recall.
And where the hell is the Senate GOP leadership? McConnell, Cornyn, Thune, and Barraso?

Exactly.
I am gonna go ahead and say it, why did Trump take documents if he was so "very smart". Honestly the man is too dumb for his own good if he did take the documents. Some of us remember when Sandy Burger did that for Hillary. I don't remember too many conservatives advocating for Burger to get just a slap on the wrist.

Again, it kinda depends...
If it is merely an infraction, that's one thing.
No doubt there is enough that can be merely overlooked in the mad rush of moving out.
Some of that kinda thing is no more than an oversight, providing it is inconsequential.
If they are making a mountain out of a molehill I don't think it will fly.
If it is a serious departure of a substantive nature, then for sure... Pour on the coals.

Political persecution and raiding of a former POTUS? Political weaponization of the FBI in this brazen a manner?
I am leaning more guessing this getting a lot more ugly and violent.
Unless the intent is to shutdown the rallies and impact the impact he is having on republican primariesWith that thought in mind, this is just doing all they can to interfere in campaigning for the mid terms, and the GOPe will be okay with it because they are ultimately the most threatened.

Dear Democrats-In-Charge,
We “deplorables”, we fly-over-country bumpkins, see and understand exactly what you’re doing.
We know you are seeing how Trump’s endorsement of candidates and the overwhelming red wave of votes are putting a big damper on your attempts to steal the mid-term elections.
Monkeypox, new COVID variants, “abortion rights” outrage – all of these (and other) OMG EMERGENCY attempts to jack up votes for Dems are falling flat, so by God, we know you are desperate to find anything on the target of your most seething hatred – Donald Trump. You think that if you somehow destroy him, you destroy our will to fight against you.
Keep doing that. You expose more and more of your corruption and evil with every move you make. You show us how much our fight is justified.

Our Republic is already destroyed. There will be no election. Nor will they allow Trump to run. The 86,00 IRS agents that they just hired are coming for us next!
We have a corrupt DOJ as witnessed with the raid of Trump's home.
Turtle could have stopped this shit on cloture with sub 60 votes.

Vote all the enabler‘s out.
I’m not suggesting we turn the FBI and the DOJ into a political arm for those of us on the right. But they do need to be reined in
If laws were broken then laws were broken. Trump should not be above the law. But I think this big raid was more done for impact effect versus enforcing laws
That is called nullification, and is one step away from secession.
We need to remind the feds that they are not a party to our country's construction. Only the states are, which created the federal government only to serve the interests of the states. not vice versa.
This is an important question that should be answered directly by the Trump team. Why hang on to the remaining documents after the National Archives demanded their return? Seems the raid was unnecessary unless he ignored a subpoena. More details needed, and I look forward to those.Hanging onto documents for the National Archives?
The democrats would love an excuse to pull out all the stops and sic the FBI, DOJ - and the National Guard if it gets bad enough - on the rest of us.I bet the Dems' fake protesting conservatives/patriots/Proud Boys - the FBI agents in identical khaki pants and navy polo shirts - are rehearsing their next interpretive dance performance even as we speak.
Do not take the bait!
In Trump’s case, no surprise, the potential offense appears to be particularly brazen and damaging. Among the documents he reportedly took with him and has declined to return are true historical items that belong to the American people, including the letter President Obama left for him when he took office and his bizarre valentines to North Korea dictator Kim Jong-Un.
So the raid was because of the Obama letter and some letters to Kim Jong-Un? That was Trump's big offense? Are you kidding me?

Those who control the media, control the discussion.
Please @LMAO consider that an election was stolen, the GOP has no backbone and even with a super majority in the past did nothing. So again, who is going to stop the corrupt DOJ??? It's been going on -- take a look back when O'Bammy was in office -- Holder defied what the courts directed him to do.
They will plant evidence so that Trump will be indicted and cannot run for president. So, while Trump isn't above the law, the corrupt leftist/marxists are.
I just don't understand in light of what has happened since Joe has taken office, how you can think that we'll see another election, and if so, how do you possibly think that the GOP is going to be victorious?
86,000 IRS agents are coming for us.

Remember when a year or two later, we read where they wanted to have IRS agents armed (collection agents)?

We are going to have elections, the GOP will take the HOR and possibly the Senate. But it’s gonna have to be pressure from the general public to reign in these bureaucrats because they are getting out of control
I do agree a lot of this is lopsided though. For example, Roger Stone lies to Congress and he gets a midnight raid. Fauci lies to Congress and he gets to keep his job

This was the scene outside the Palm Beach resort Mar-a-Lago owned by Donald Trump on Monday night soon after the former president revealed the FBI had launched a raid on his property.
The image, snapped by local media WPTV, show what appears to be a plain-clothed Secret Service agent with his weapon — an automatic machine gun — as he paraded outside the property.
An unmarked vehicle is also in the picture exiting Mar-a-Lago.

Several members of the Republican Senate leadership team were slow to respond to the Federal Bureau of Investigation’s (FBI) Monday search of Mar-a-Lago, with the two top Republicans in the upper chamber not commenting at all.
Conference Chairman John Barrasso of Wyoming, Senatorial Committee Chairman Rick Scott of Florida, and Vice Conference Chairwoman Joni Ernst of Iowa were the only members of McConnell’s six-senator leadership team to release statements on the raid, as of Tuesday afternoon. Minority Leader Mitch McConnell of Kentucky, Whip John Thune of South Dakota, and Policy Committee Chairman Roy Blunt of Missouri have not commented publicly.
McConnell appeared at a press conference Tuesday afternoon in his home state as he surveyed flooding that has left at least 37 dead. He declined to answer a question about Trump, saying, “I’m here today to talk about the flood, and the recovery from the flood.”

Yes, but sealed things with a high interest factor often get leaked, notwithstanding the sealing.
You mean like SCOTUS decisions written my Alito?
Did this same magistrate judge recuse himself in another Trump case? If so, he had zero business signing a search warrant.

Exclusive — John Solomon: Whistleblower Said FBI Office Behind Mar-a-Lago Raid Has a Political Manipulation Problem
John Solomon says that whistleblowers from the Federal Bureau of Investigation (FBI) warned of “political manipulation” at the FBI’s Washington Field Office, which conducted a raid on Monday of former President Donald Trump’s personal residence at Mar-a-Lago in Palm Beach, Florida.
FBI Director Christopher Wray has not “taken” the whistleblowers’ allegations of partisan political corruption at the FBI “as seriously as the proof and evidence now merit,” Solomon stated.
“We had whistleblowers, just last week, [who] said there’s political manipulation of the cases going on,” Solomon said of Sen. Chuck Grassley’s (R-IA) recent claims of “multiple FBI whistleblowers” warning of partisan political manipulation of some of the bureau’s investigations. Grassley’s office wrote:

Some say destroy, I say this emboldens them even more, and increases their power......
Look what they have been able to get away with the past few years, with no repercussions
I see nothing on the horizon changing that.
Had Conservatives been in power, even within the party, this could not ever have happened.
Apparently, one of the explanations that is being bandied about for this raid is the theory that if Trump is convicted for mishandling government documents, then he would be barred from holding public office - including the presidency - under 18 USC 2071.
However, that statute is quite possibly unconstitutional as applied to the office of the president. The Constitution imposes three requirements for a person to be the president: be at least 35 years of age, be a natural born US Citizen, and have lived in the US for at least 14 years. There is no requirement that the individual in question not have a criminal record, even a federal criminal record.
Accordingly, as applied to the office of the president, 18 USC 2071 would effectively be imposing an additional requirement for a person to qualify as the president over and above what the Constitution requires, and as such would be unconstitutional.
I think this argument has great merit.
Yes, if a court actually gives Trump Standing.
If he is being denied eligibility as president, then he has standing.
I would hope so, but that hope is under serious strain with previous SCOTUS rulings. They would not give standing to actual Electoral College Electors when the question of O'Bastard's eligibility came up after 2008. Folks who were the very people casting the votes to elect a President were deemed as not needing to know if the Nominee for whom they were voting was eligible under the Constitution's requirement for a Natural Born Citizen.
That's breathtaking.
No, not really. It is the states that cert eligibility. The states have standing if the application was falsified.
All this while we suffer a vice president who is not even remotely constitutionally qualified to hold that office.
No, not really. It is the states that cert eligibility. The states have standing if the application was falsified.
States questioning eligibility were also denied Standing. Everybody under the sun was.
Both. There's no way that DoJ makes a move on a former President without the current occupant knowing about it.
To be fair, he also gave money to Jeb Bush in 2015.

Exclusive — Sen. John Cornyn on Reported Reason for Trump Raid: ‘Thin Gruel’
Sen. John Cornyn (R-TX) thinks that the reported reason for the FBI raid of former President Donald Trump’s personal residence at Mar-a-Lago in Palm Beach, Florida, is “thin gruel.”
Matthew Boyle9 Aug 2022Washington, DC0
Sen. John Cornyn (R-TX) thinks that the reported reason for the FBI raid of former President Donald Trump’s personal residence at Mar-a-Lago in Palm Beach, Florida, is “thin gruel,” his spokesman told Breitbart News, adding that he backs other Republican calls for an immediate investigation into Attorney General Merrick Garland on the matter.
The publicly reported reason for the raid, which Cornyn believes is “thin gruel,” is Trump duking it out with the National Archives over presidential records he supposedly took to Mar-a-Lago upon leaving the White House. The fact that the FBI raided his personal residence and broke into his safe—which was, according to his son Eric Trump, empty when agents opened it—is a significant escalation for a process fight over document sharing and preservation.
Cornyn’s spokesman, Drew Brandewie, told Breitbart News that the Texas Republican backs House GOP leader Kevin McCarthy’s announcement that Garland is under investigation for the matter.

Technically, the states, or representatives of the states? Republican legislators are not the state. The legislature moving en-toto is the state.
States. Not all were California-types. All were denied Standing and it was frustrating as Hell. Just like when they denied Standing to TX in December, 2020.
The SCOTUS cannot be trusted when it comes to election law. Especially with Democrat John Roberts at the helm.
It is unclear when negotiations exactly deteriorated.

FBI would not let Trump attorneys in rooms as agents raided Mar-a-Lago, warrant focused on NARA: source
'There is no need for any of this,' a source told Fox News.
By Brooke Singman | Fox News
FBI agents would not allow Trump lawyers watch as they raided former President Trump’s private home at Mar-a-Lago early Monday morning, a source told Fox News.
Trump was in New York City while his home in Palm Beach, Florida, was raided.
A source familiar with the raid told Fox News the warrant for the raid was related to the National Archives and Records Administration effort to collect records and materials the former president took with him from Washington, D.C., to Mar-a-Lago.
"This was a NARA issue," the source close to the former president told Fox News, adding Trump has been "cooperating."
"There is no need for any of this," the source said, adding the FBI "wouldn’t let the attorneys come in to watch the raid. They told them to leave."
The source told Fox News that when NARA visited Mar-a-Lago in February, Trump and his team "gave them what they wanted."
"It was all provided to them," the source said. "This is absurd."
Another source told Fox News negotiations and communications "never broke down."

Technically, the states, or representatives of the states? Republican legislators are not the state. The legislature moving en-toto is the state.Where do you get that idea that a state is only comprised of its legislature? Is that somewhere within the US constitution or any state constitution?
Fox News host Greg Gutfeld advised those who feel anger toward the FBI's raid on former President Trump's residence to look at this "soberly" because the press wants you to react angrily as a form of a "setup."
GREG GUTFELD: Well, I get it. I mean, ratings. I mean, if we went on The Five and said, we don't know, this show would be dead. So we are in the world of speculation, so are they. However, their speculation, always wrong. Walls are closing in. Tick, tick, tick. Boom. This is it. It's worse than Watergate. And then it goes away. But they're reelecting him, by the way, just by the way they're talking. But the one thing – some advice to the people at home is you could be really pissed off at this, but you have to have fun with it, too, because the press wants you to react angrily, because that's the second bite to this apple. They're already doing pieces about pro-Trump message boards, you know, enraged. Surely there's going to be another January 6th. There's going to be, you know, you know, gangs of people in red hats causing problems. So you want to take that away from them. You want to look at this, you know, soberly and have fun with it. They want an excuse to track down more Republicans and people in red hats, and you don't want to give it to them. So I think that's a setup.
Mr. Trump needs to quit soft-stepping around as to whether he is or is not going to be running in 2024.
Declare his candidacy now. This will make further attempts to harass and discredit him appear for what they are -- political prosecution, and nothing more.
They rummaged through Melania's clothing. Weirdos.
Biden demanded a sniff report. He's upset he couldn't participate, at least when it came to her underwear drawer.
Biden demanded a sniff report.
Where do you get that idea that a state is only comprised of its legislature? Is that somewhere within the US constitution or any state constitution?
Texas, as supported by 20 other states absolutely had standing in Texas vs Pennsylvania. Are you saying that it did not because only the legislature can represent the state? If so, that is false.
That was merely an example.
No, they most certainly did not.
For the very same reason that California or New York have no business in how Montana runs itself or how it decides to define votes. And thank God for that!

I'm sorry my friend but you are just flat out wrong on this one! @roamer_1
It is up to each State to decide how its electors are chosen. The problem here is that a number of States violated their own election laws. That should have been handled at the State level, and short of that, it should be settled by the fourth branch of government.
Here in Georgia, both State and County officials violated State Law. And sadly, the State GOP did not lift a finger to stop it. No lawsuits. No injunctions. Nothing. Not a damn thing.

Shower thought:
This is sorta genius on Trump's part. If they did go in on these meaningless documents, he gets his name in the headlines for 2 years into a predecessor's presidency, probably a slap on the wrist penalty, his supporters fired up to vote for him, and he looks sympathetic. I mean, imagine any other 1 term president (Jimmy Carter or Papa Bush) still getting this much press 2 years into their predecessor's presidency's?
I mean i usually don't like these "Trump is playing 4 dimensional chess" arguments, but this one checks out IMO.

It's not. A person has a right to an attorney. That attorney is their legal representative. If Trump had been home at the time, he would have been allowed to remain inside the residence during the search. Likewise, so would his legal representatives. The fact that they did not should by itself disqualify any evidence gathered, and should leave the FBI vulnerable to a civil suit.

I'll never forget the way Trump supporters went on a wild looting and arson spree yesterday, murdering cops all along the way.
Oh, wait....
I don't think that sentence is true. Cops ALWAYS remove the suspect from the premises during a search.
Nope. I have known several people who had cops kick down their doors with warrants, and each and every time without exception, the person was made to sit in the living room while the search took place. It is only in an instance where the person chooses to interfere with the search that they will be removed from the premise.
I have no personal experience (so far).

So Biden still claims he was left in the dark? Amazing.
@BigunI, too, am loathe to attack State Sovereignty. However, the Constitution all States chose to go by, either at its adoption or gaining statehood says that the Legislatures of the Several States shall make election law. In many States that very election law was altered by persons other than the legislature. In that sense, the Compact was violated, the rules for making the rules were not the same as they should be (up to the various State Legislatures, not appointees or other elected officials).

That is what warrants are for. Once the warrant has issued, the warrant can be executed, and the individual does not have the right to be present during the search.
If you believe otherwise, please find the pertinent caselaw that says otherwise.

I believe the warrant has to be provided, but otherwise, I don't believe anyone has the right to remain on the premises while a warrant-based search is conducted.
Rule 41. Search and Seizure
(1) Warrant to Search for and Seize a Person or Property.
(A) Noting the Time. The officer executing the warrant must enter on it the exact date and time it was executed.
(B) Inventory. An officer present during the execution of the warrant must prepare and verify an inventory of any property seized. The officer must do so in the presence of another officer and the person from whom, or from whose premises, the property was taken. If either one is not present, the officer must prepare and verify the inventory in the presence of at least one other credible person. In a case involving the seizure of electronic storage media or the seizure or copying of electronically stored information, the inventory may be limited to describing the physical storage media that were seized or copied. The officer may retain a copy of the electronically stored information that was seized or copied.
(C) Receipt. The officer executing the warrant must give a copy of the warrant and a receipt for the property taken to the person from whom, or from whose premises, the property was taken or leave a copy of the warrant and receipt at the place where the officer took the property.

No one is attacking state sovereignty least of all Texas! That lawsuit was about Pennsylvania's violations of the FEDERAL constitution (can't change the rules in the middle of the game) and SCOTUS had original jurisdiction! @roamer_1
Obviously, the SCOTUS did not agree, @Bigun - And like I said before, I don't know the rules were changed in the middle of the game - As the sole author and arbiter, the state legislature would seem to be the ones to determine that... THEY would have standing - Not the state of Texas, or the SCOTUS. Their acquiescence is acceptance, as they are their own remedy.
And we need not beat this to death yet again.
In an exclusive, two senior government officials told Newsweek that the Mar-a-Lago raid was largely based on information from an informant who told the FBI what documents Trump was hiding in his Florida resort and where they were located.
If this is true, then FBI agents had no business being in that residence for 9+ hours.
Must a warrant specify what is being looked for?
If this is true, then FBI agents had no business being in that residence for 9+ hours.
In the case of Pennsylvania they weren't the sole arbiter though. Mark Elias and the AG for the Commonwealth of Pennsylvania...who is running for Governor by the way...circumvented the state and federal constitution in this instance.
It depends on whether they did a full inventory on-site and how long it took to do the inventory. If they pulled each document out of those 15 boxes and wrote a description of each, then it could very well have taken 9 hours or so.

There is a difference. The Constitution was violated, incidentally, most often in the states that stopped counting, saw a mathematically impossible increase in Biden votes, and which carried the day in the electoral college for Biden, in each having him come from behind after counting was re-started. Other mechanisms of fraud have since been exposed, in those same states, made possible by unconstitutional rule changes regarding elections.
As we all have to suffer the effects of this election, we all have standing, and every state which cried foul should have had standing as well.
They could have photocopied the contents of each box within minutes. Which allowed them plenty of time to break into an empty safe, rummage through Trump's personal effects, and sniff around Melania's closet. Again, if they knew in advance the identity and location of what they were seeking, they could have wrapped that up within 30 min. Not only that, the warrant would have been limited to that specific area based on the sworn affidavit of said informant.
That's better. That's a good thing. Trump does not and did not pack those boxes. Staffers did. He received a broad general description of contents. Other than that, Trump himself, the person, has nothing to do with what is packed in them.
The boxes were unopened.
I don't know about the second part, but if it's true that they refused to provide the Warrant to Trump's legal representative then everything they took should be grounds for exclusion of the evidence.
Of course we know that'll never happen, because the FBI and DoJ have placed themselves above the law.
In the case of Pennsylvania they weren't the sole arbiter though. Mark Elias and the AG for the Commonwealth of Pennsylvania...who is running for Governor by the way...circumvented the state and federal constitution in this instance.
This ultimately comes down to the fourth branch of government. Here in Georgia, we knew in April 2020 that the Secretary of State was violating the law. We did nothing. May? Same thing. June, July, August, September? Same thing. Then in October, the Secretary of State signed off on making changes to the code on all voting machines without recertifying - again in violation of State law. And what did we do? Nothing.
And then we have election day. So far so good. Yet in the days following election day, law after law after law was violated. And we did nothing. And because we did nothing, we allowed our Secretary of State to effectively select the winners of every election. And there is nothing the State of Texas can do to change that.
Judges have a little wiggle room on the details they must have in a search warrant but not much.
If your search warrant says you're searching the bedroom and office of X at their residence Y for items related to Z you can't go snooping in the garage or any out buildings and "discover" something. Any evidence you find outside the scope of the warrant is inadmissible.
The cops would have to stop call the judge and get the building, car room etc added to the warrant to be able to lawfully search the new area.
Unless what they were looking for has nothing to do with Chain of Evidence and more about retrieving something Tumpy was holding over someone else...
State sovereignty in federal elections is not absolute as it most decidedly affects other states.
Or does the US Constitution mean nothing to you?
Very probable. He knows China owns Joe, he knows that Joe and Hunter were involved in Ukraine, and I would guess he probably knows a few things about the Clintons. If he has (or now had) incriminating evidence he should have used it already.
Fauci, Brix, Pelosi, Pence, and the swamp. He knows very well what they've done and what they are doing.
The originals are the subject of the warrant, not photocopies. And an inventory has to be done, which normally requires some sort of description of the documents.
In the end, that's right. Though the People still have their remedy - by disabusing those that took their power of their offices in the next election cycle.
Melania better check her handbags and shoes when she gets back to make sure nothing is missing..some of her handbags cost over 30k...I'd be more worried about what they added as far as tracking devices.
Photocopies ARE the inventory. You hand the photocopies to the resident upon leaving. The hard disk of the copier proves what was copied. And the defendant knows exactly what was taken. It is the best accounting one could possibly have.
It is up to the Penn state legislature to hoe that row... and barring them, then the People of Penn must provide remedy. That's all there is.
Which did not happen in this year's GOP Primary. I'll be voting Libertarian in November.
Why build up all this silly speculation when the bottom line is this: unless they seized proof positive that Trump gave the nuclear codes to the Russians or the Chinese, or something of equal import, this search was inexcusable and politically motivated?
@txradioguy @Bigun
I get the sense that "stuff" is as specific as the current US Goobermint needs to come.
After all,their courts,their justices,their rules.
Yeah, you can appeal it and spend every dime you have getting lawyers to file briefs for years, but by the time you win on appeal and get the charges dropped, you will be broke and living in a State Farm for Fools and have a drip cut attached to your wheelchair.
I think you have a firm grasp of the situation @sneakypete
Obviously, the SCOTUS did not agree, @Bigun - And like I said before, I don't know the rules were changed in the middle of the game - As the sole author and arbiter, the state legislature would seem to be the ones to determine that... THEY would have standing - Not the state of Texas, or the SCOTUS. Their acquiescence is acceptance, as they are their own remedy.
And we need not beat this to death yet again.
My point goes beyond that. Not only was it inexcusable and politically motivated. It was highly personal. They spent nine hours taking over complete possession of a private residence, 30+ people trespassing over highly personal areas for nine friggin' hours when they could have been in and out in 30 min. And on top of that, they denied him personal counsel as well as denied him a video account of the search by intentionally disabling video equipment. This was one big personal powerplay FU to Trump, and it was our own Justice Department that did it.
In the case of Pennsylvania they weren't the sole arbiter though. Mark Elias and the AG for the Commonwealth of Pennsylvania...who is running for Governor by the way...circumvented the state and federal constitution in this instance.
It has to adequately describe the evidence being sought for.
Yes! And EVERYTHING that is removed has to be cataloged and the subject given a receipt.
It depends on whether they did a full inventory on-site and how long it took to do the inventory. If they pulled each document out of those 15 boxes and wrote a description of each, then it could very well have taken 9 hours or so.
My point goes beyond that. [...] This was one big personal powerplay FU to Trump, and it was our own Justice Department that did it.
Add to that the fact that the FBI lies to Judges & Magistrates all the time. Just ask Carter Page. They can get a warrant to search a ham sandwich.
ALL of the reporting I have seen thus far says that they did not do that! They took boxes they hadn't even opened.
I'm not seeing anything that states or implies that.
I very seriously doubt they could have been in and out in 30 minutes. I also doubt that a quickie raid would have been any the less threatening than a 9 hour raid, particularly given that Trump was not personally present at the time and was not restricted or limited during that time.
Every hear the phrase "Fruit of the poison tree"?
And thus far I have not seen anything that says anything but what I said earlier.
Sloe Joe has plenty of Judges lined up to ignore that principle.
I'm not seeing anything that states or implies that.
He wasn't restricted, but his legal counsel was. I still don't know if they let her see the Warrant, there seems to be an issue there.
The attorney, Christina Bobb, also told NBC on Tuesday that a copy of the search warrant that FBI agents left at the Mar-a-Lago residence in Palm Beach indicated agents are investigating possible violations of laws related to the Presidential Records Act and the handling of classified material.
Or evidence was never the point of the action.
I don't know either way. Nobody has said what condition the boxes were in before the Feebs started rifling them, they could have been opened already. All we know for sure is the boxes were taped when they came out of the house.
According to a CNBC story that quotes Trump's attorney, a copy of the warrant was left at the premises and she reviewed it, at least briefly:
Source: https://www.cnbc.com/2022/08/09/fbi-seized-boxes-in-trump-raid-in-florida-lawyer-says.html
I believe that is really the case.
They should generally be taped - and sealed in a provable manner - in order to establish chain of custody as they leave the premises.
Most likely. Or somebody blew it big time... And gave Tumpy a butt-ton of ammo.
Those two are certainly not mutually exclusive.
Yes, I can see that. That's how evidence is supposed to be handled and I have no reason to doubt that they were. But there is still no way of knowing if they opened the boxes during the search. I am sure they did, and that's why they were there for 9 hours. Document "boxes" can hold thousands of sheets of paper.
They should generally be taped - and sealed in a provable manner - in order to establish chain of custody as they leave the premises.
Then that would be evidence tape - clearly visible on the box. Packing tape would imply that the boxes were unopened, or opened, resealed, and not holding evidence.
Maybe so, maybe not. Do you have upclose photographs of these boxes as they exited the premises?
NOPE. I ain't that interested. But I am fairly familiar with evidence tape and its use, through other means.
Trump team won’t release copy of Mar-a-Lago FBI raid warrant
By Callie Patteson
August 10, 2022 1:40pm
Former President Donald Trump and his legal team have no plans to release a copy of the search warrant used to raid Mar-a-Lago on Monday, leaving it up to the Department of Justice to detail the reasons for the unprecedented operation, according to a new report.
“No, we’re not releasing a copy of the warrant,” NBC News quoted a source close to the 45th president as saying.
Trump attorney Christina Bobb did not immediately respond to a request for confirmation from The Post.
The report comes one day after Rep. Mike Turner (R-Ohio), the ranking member of the House Intelligence Committee, sent a letter to FBI Director Christopher Wray requesting details on the evidence used to justify the raid.
“I would assume that an escalation of this magnitude — for the Bureau to obtain a court-ordered search warrant and conduct an unannounced search, for the first time in our country’s history, to seize documents stored at a former president’s residence — would indicate that the Federal government perceived something in those documents posed a serious, ongoing threat to our national security,” Turner wrote.
“As such, the evidentiary basis presented to the court to justify the necessity of this warrant is of keen interest to the investigative and legislative activities of this Committee.”

Why is Trump choosing to not disclose the warrant?
TOS is claiming his lawyers never got it.
Why is Trump choosing to not disclose the warrant?
@Sighlass
No,in fact,I don't.
BTW,your link doesn't work.
Then we don't know, do we?
That's right. But anything determined to be evidence (which should be anything they hauled off) would be sealed with evidence tape to prevent tampering and preserve Chain of Custody.
I heard it was sealed. If that's the case then as I understand it unless the Judge that signed the warrant unseals it....it's illegal to do so.
A cite would be helpful, then.
Trump's attorney Bobb said last night on Fox that The attorneys at MAL were shown the warrant but not allowed to keep it.
Now on Fox they are reporting that Trump/attorneys did receive a list of everything that was taken...
They should generally be taped - and sealed in a provable manner - in order to establish chain of custody as they leave the premises.
A list of things that were taken is not the warrant.
Fox reporting that the Trump team are planning to get a court order for the FBI to release the warrant and a complete list of everything that was taken....
This story is constantly changing...don't know what to believe
That chain of custody should include records of the boxes being packed by the GSA and shipped to Maralago after Trump left office.

Why?
Fox reporting that the Trump team are planning to get a court order for the FBI to release the warrant and a complete list of everything that was taken....

Because that is where the boxes originated.
It is also illegal for a judge with prior personal history with a defendant to issue a warrant against that defendant.
Doesn't matter; the chain of custody doesn't have to demonstrate that, it only has to demonstrate that they were in Trump's possession at Mar-a-lago, and haven't been tampered with since then.
On what basis?
So I mail a classified document to your house. Your housekeeper collects the mail and places it in the basement where it sits unopened for 18 months. Suddenly, the FBI raids your house, spends several hours rummaging through your wife's underwear drawer before moseying down the basement stairs, finding the envelope, and then hauling it off as evidence you had classified info in your possession. Sounds like some Stasi bullshit to me.
Maybe try comparing apples to apples. Are you seriously claiming that certain boxes were packed at the White House, without Trump's knowledge, sealed up, sent to Mar-a-Lago, and stored in the secured area where Trump knew boxes containing the disputed documents were kept, and that all of this was done months ahead of time on the off chance that Trump wouldn't know about it?
Really?
Coolidge v. New Hampshire, 403 U.S. 443 (1971) (https://supreme.justia.com/cases/federal/us/403/443/)
I gave you the link. I can't click it for you.
You didn't give me a link demonstrating that the FBI must have a chain of custody showing that the boxes originated from the White House and were packed by the GSA.
Try again.
That chain of custody should include records of the boxes being packed by the GSA and shipped to Maralago after Trump left office.

https://twitter.com/leslibless/status/1557457614342062081
Exactly.
There is no constitutional jurisdiction either federally or state that makes the legislature the sole author or arbiter.
Here is you responding to it:
Why?
From the article:The boxes contain documents from Trump’s tenure at 1600 Pennsylvania Avenue — reportedly including letters from former President Barack Obama and North Korea leader Kim Jong Un.
The material had been packed up by the General Services Administration and shipped to Mar-a-Lago when Trump left office in January 2020, a legal source told The Post.
That still doesn't require a chain of custody from GSA/the White House to Mar-a-Lago. It is sufficient if documents he is not supposed to have are nonetheless in his possession. If he wants to argue some fruitcake "the GSA secretly salted them in those boxes" argument, he's free to do so, but that's on him; the government is not required to disprove that theory.
"Must" and "require" are your words, not mine.
Your words required there to be a chain of custody from the GSA to Mar-a-Lago
When it become a felony ? When Trump made removing classified documents a felony....
So if it is an felony to take classified documents (Trump signed it into law himself) and Trump (who is already wishywashy on gun issues) is found guilty, would we want a bitter felon that can't own guns even in the WH? Just thinking out loud, since felons are not barred from running for President.
Yes the above post might be aimed at inflaming some folks...
Those are two insurmountable 'ifs' there.
When it become a felony ? When Trump made removing classified documents a felony....
Then obviously that makes the opposite true - Others CAN mess with election law, and others CAN certify it.You now are making no sense.
Be careful what you wish for. Because what you wish for is our doom.
You now are making no sense.
This has to do with the petition to the US SCOTUS on Texas vs Pennsylvania submitted/supported by AGs of 20 states.
This is a fundamental constitutional issue only between states, with SCOTUS as arbiter. This is not an election issue.
Try to keep up.
A list of things that were taken is not the warrant.
https://en.wikipedia.org/wiki/Texas_v._Pennsylvania (https://en.wikipedia.org/wiki/Texas_v._Pennsylvania)
Thanks, I know what it says.
Filed by Texas State Attorney General Ken Paxton on December 8, 2020, under the Supreme Court's original jurisdiction, Texas v. Pennsylvania alleged that Georgia, Michigan, Pennsylvania, and Wisconsin violated the United States Constitution by changing election procedures through non-legislative means – thus violating the Independent state legislature theory. The suit sought to temporarily withhold the certified vote count from these four states prior to the Electoral College vote on December 14. The suit was filed after about 90 lawsuits arising from disputes over the election results filed by Trump and the Republican Party had failed in numerous state and federal courts.
The suit had been drafted by a team of lawyers with ties to the Trump presidential campaign. Paxton agreed to file the case after other state attorneys general declined to do so. The Solicitor General of Texas Kyle D. Hawkins objected to the suit and refused to let his name be added. Paxton hired Lawrence J. Joseph, who had helped draft the suit, as special counsel to assist with the suit.[1]
Within one day of Texas's filing, Trump, over 100 Republican Representatives, and 18 Republican state attorneys general filed motions to support the case.[2][3] Trump referred to this case as "the big one" of the election-challenging lawsuits.[4] Attorneys general for the defendant states, joined in briefs submitted by their counterparts from twenty other states, two territories, and the District of Columbia,[5] urged the Court to refuse the case, with Pennsylvania's brief calling it a "seditious abuse of the judicial process".[6] Legal experts argued that the case was not likely to be heard and not likely to succeed if it did get heard, and that it was thus a "Hail Mary" action.[7][8][9]
The Supreme Court issued orders on December 11, declining to hear the case on the basis that Texas lacked standing under Article III of the Constitution to challenge the results of the election held by another state.[10][11]...
The case made no mention of fraud or any other such thing. It was solely about violations of the UNITED States Constitution and, I will forever believe, should have been heard!
@Smokin JoeWell stand there. Why even have rules if no one is going to go by them?
It is not determined what authority was given through law or precedent by that legislature to appointees or other elected officials... (in the case of Penn)
And who is to determine that? Why the state legislature, through their own means. Their own acquiescence is their verdict.
I believe the firewall set up by the founders around election law was absolute for a reason, and breaching that firewall will have unintended consequences.
The legislature has the only standing and in not exercising their duties it is left to the people of Penn to provide remedy.
And I will stand on that till I die, friend.
Article I, Section 4, Clause 1: The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators.
It makes no difference what words it contained @Bigun .
It was a direct assault on a sovereign state attempting to decertify what that state (in its own right)
declared and certified as valid.
Thank God it wasn't heard. I don't think you are looking at the precedent it would set.
Maybe you should actually read the statute instead of posting a photo of it from some leftwing website.
Well stand there. Why even have rules if no one is going to go by them?
As for the legislatures abdicating their sworn duties to unelected bureaucrats, a pox on them and their houses!
Well stand there. Why even have rules if no one is going to go by them?
As for the legislatures abdicating their sworn duties to unelected bureaucrats, a pox on them and their houses!
I've looked at it from every angle possible and you and I will NEVER agree if that remains your position @roamer_1 !
My position, violating the Constitution should NEVER be tolerated and states most assuredly do have standing to ensure that it isn't, will never change!
And BTW: What the hell could possibly be wrong with setting a president that says "Violations oof the constitution will not be tolerated"?[/size]
I do.
Unless what they were looking for has nothing to do with Chain of Evidence and more about retrieving something Tumpy was holding over someone else...
@roamer_1
It doesn't even have anything to do with that.
What it was all about was the political drama. Their purpose was to try to make Trump SEEM to be guilty of everything under the sun in order to try to convince undecided voters to support some RINO instead of him in order to make it easier for the Dims to win the next Presidential election.
You watch, the alleged "evidence of Trump wrong-doing" will be leaked to Dim news sources to report as facts and speculate about if Trump will be forced to drop his run for President in order to defend himself in court..
This is nothing more and nothing less than political theater.
Federal Judge Orders DOJ to Provide Copy of Trump Raid Warrant
Jon Dougherty August 10, 2022
A federal judge on Wednesday ordered the Biden Justice Department to produce a copy of a search warrant executed at his Mar-a-Lago estate, where the FBI conducted a nine-hour-plus search on Monday.
Federal Magistrate Judge Bruce Reinhart ordered the DOJ to “file a Response to the Motion to Unseal” the warrant after requests were made by the Times-Union, a newspaper located in Albany, N.Y., as well as the conservative legal group Judicial Watch.
The judge said that the DOJ must respond no later than Aug. 15, reports said.
Reinhart signed off on the FBI’s warrant to search the former president’s palatial home in South Florida in what he said was an “unannounced raid on my home.” He took a leave of absence from a local U.S. Attorney’s office more than 10 years ago to represent employees of convicted pedophile Jeffrey Epstein after they had gotten immunity during the lengthy probe of the now-late financier for sex trafficking.
The New York Post added:
Reinhart was elevated to magistrate judge in March 2018 after 10 years in private practice. That November, the Miami Herald reported that he had represented several of Epstein’s employees — including, by Reinhart’s own admission to the outlet, Epstein’s pilots; his scheduler, Sarah Kellen; and Nadia Marcinkova, who Epstein once reportedly described as his “Yugoslavian sex slave.”
Kellen and Marcinkova were among Epstein’s lieutenants who were granted immunity as part of a controversial 2007 deal with federal prosecutors that allowed the pervert to plead guilty to state charges rather than federal crimes. Epstein wound up serving just 13 months in county jail and was granted work release.
According to the Herald in 2018, the judge was later identified in a civil lawsuit accusing him of violating DOJ policies by changing sides during the Epstein investigation. The paper went on to suggest that Reinhart used insider information regarding the investigation in order to gain favor with Epstein.
Reinhart denied that he had done anything wrong in a 2011 affidavit while going on to claim that since he did not get involved in any federal probe of Epstein, he, therefore, had no access to any inside information regarding the case.
Earlier, Trump attorney Lindsey Halligan said that the warrant was “sealed” when agents showed up to search Trump’s estate.
Another Trump lawyer, Christian Bobb, meanwhile, told streaming network Real America’s Voice: “When I arrived and kind of announced myself as the legal representation for President Trump. I asked to see a copy of the warrant.”
“Initially they refused and said, ‘You know, we don’t have to show it to you.’ And there was a little bit of an exchange about whether it was appropriate to withhold the warrant when you’re searching the residence of the former president, who’s likely to be the Republican nominee in the next election, though they conceded and let me see it, they did not give me a copy of it right away, but they did let me see it,” she went on, according to Mediaite.
“It was very, I would say, thin. And as you can tell from public records, the affidavit, the supporting documentation of what the probable cause was to obtain the warrant has been sealed,” Bobb continued.
Mediaite said that several observers opined that Trump and his attorneys likely had a copy of the warrant beforehand but Bobb dismissed those claims.
“So we’re not allowed to see that. We have to go to court to request the judge to release that which, you know, may or may not happen. So we don’t know what the probable cause is, why they were allowed to search, but they did,” she reported.
“They also said that they were looking for classified documents, evidence of a crime as far as classified documents go,” Bobb explained.

But then, we won't know one way or another until that card gets played. If it can be played.
That's fine @Bigun  We have already proven we don't have to agree on everything.
I don't think the Constitution was violated... I think what you propose would be far worse.
Because if successful, every_single mishap in every election will be seized upon to decertify results and the winner of that mess will be the liberals. Mark my words.
That's why that firewall is there.
Why is Trump choosing to not disclose the warrant?
@roamer_1
Just a question... If the big 5 states, who are winner take all states, manipulate vote counts to one candidate then the votes for the smaller states are effectively nullified illegally. I am not sure why a state trying to protect their voters don't have standing when the impact is larger than the "offending" state.
I didn't post a link Pete... but here is one to refresh your memory on one of Trump's gun grabs, there was more. @sneakypete
https://dailycaller.com/2018/02/28/trump-guns-first-go-through-due-process-second/
You don't think the constitution was violated? How in the HELL can you say that when the plain language therein says "Each State shall appoint, in such Manner as the Legislature thereof may direct..." when that is clearly not what happened in 2020!

@Sighlass
So you think Trump,as President, being in favor of removing guns from the possession of people whose own families think they are disturbed and dangerous makes him a gun-grabber?
Seriously? After all,who knows more about the emotional stability of someone than their own family?
@sneakypete
Then that's a huge risk, politically, and just as desperate.
And one which has already backfired big time.

@sneakypeteQuoteYES. My ex would have had me red tagged and all my guns taken from me as a matter of course.
Gun-grabbing bullcrap straight out of the liberal handbook.
Maybe in the big northern cities, but I THINK that in most of America a DA is NOT going to take such charges seriously from an ex.
Now,a current wife with their children and other relatives and neighbors backing her up is a different story.QuoteThen you'll need to see a shrink to get your guns back, and shrinks are invariably liberal a*******, who will forever remove your ability to own a weapon until they deem it reasonable... Which will be never.
I agree,IF it gets that far. Most sheriffs will check the arrest records and ask the deputies who patrol the area where this man lives to see if he has ever been any trouble before they make these decisions.
Sheriffs don't like being caught in the middle of marital squabbles any more than the rest of us.
Exactly. We need three things right now:
1) The Warrant in its original form, no redactions.
2) The complete inventory of what was removed.
3) The application for the Warrant. Again no redactions. A copy that includes any last-minute changes and margin notes.
QuoteI think that any law that someone can accuse you of something and the law act on it without due course of law (being able to defend oneself) pertaining guns is dangerous.
You should have stopped at "I think",because you are not thinking.QuoteFamily does not always have one's best interest at heart. Neither does government.
So you want to go on record in favor of red flag laws ! If one of your kin decides that "chemo brain" is reason to take away your guns, you would be in favor of it?
As you know, the law's problem is the lack of common sense in administering it. Some suit decides they don't like you, you have lost your rights.
Off subject, you can have the last word.
Will they be assisted by Klingons?

No, it is not wrong,
Did the state certify or not?
I posted 18 U.S. Code § 1924(a) verbatim. I also provided a link. Again:
18 U.S. Code § 1924 - Unauthorized removal and retention of classified documents or material
(a)Whoever, being an officer, employee, contractor, or consultant of the United States, and, by virtue of his office, employment, position, or contract, becomes possessed of documents or materials containing classified information of the United States, knowingly removes such documents or materials without authority and with the intent to retain such documents or materials at an unauthorized location shall be fined under this title or imprisoned for not more than five years, or both.
(b)For purposes of this section, the provision of documents and materials to the Congress shall not constitute an offense under subsection (a).
(c)In this section, the term “classified information of the United States” means information originated, owned, or possessed by the United States Government concerning the national defense or foreign relations of the United States that has been determined pursuant to law or Executive order to require protection against unauthorized disclosure in the interests of national security.
https://www.law.cornell.edu/uscode/text/18/1924
Again, we are not dealing with classified documents here. This is a National Archives issue. Secondly, Trump was not a officer, employee, contractor, or consultant of the United States when he came in possession of the boxes. Thirdly, Trump did not take the boxes to his residence. They were packed and delivered by the GSA. Please read the statute.
If you'd like to continue to discuss this, I've got two humble requests: the first: Read the full filing and second: start a separate thread. Continuing the discussion here is interrupting an important thread.

Yes! But not the legislatures as you are desperately trying to imply!
@roamer_1

MSNBC and CNN are trying so so so so hard to convince somebody that it wasn’t a “raid”. I’m sorry, were the FBI agents invited guests who were encouraged to come in and break open a safe? If not, it was a raid, you disgraceful idiots.
... And those states are trying to do... what exactly... TO Pennsylvania?Read the petition in case you did not do so in 2020
Once again, words actually mean something, unlike what you attempt to obfuscate with babble they mean something else.
Ironically, the 'did direct by way of their acquiescence' logic (or by not disagreeing) is 180 degrees different than the logic you deploy to not vote against Democrats from taking power.
You appear to be happy to compliantly permit those who are most destructive in our government to take control due to your stated refrain from voting.
And what we witnessed with this raid is the result of this decision or 'acquiescence'
@Bigun
Nothing desperate about it. It is the legislature's imprimatur as certed by its agents.
And lastly, what have the legislatures done to clean up the mess? Because again, if they do nothing to stop it from happening again, that is acquiescence... implied approval.

What happened has all been chronicled right here on TBR @roamer_1 for your convenience here are the links:
Eric Trump revealed FBI agents refused to hand over the search warrant for their raid on Mar-a-Lago and kicked an attorney off the property in a new, incisive account of the Monday operation at the Florida estate.(read more at headline link.)
Speaking exclusively to DailyMail.com, the former president’s son said the 30 agents who arrived at the property asked staff to turn security cameras off – but they refused.
He also said that the attorney was forced to stand at the end of the Mar-a-Lago driveway while the team searched inside – and allegedly used safe crackers to break into his father’s safe.
He called the raid another ‘coordinated attack’ on his father Donald Trump and insisted there is no way President Joe Biden was kept in the dark about the search.
The latest explosive account comes with the Department of Justice facing mounting pressure to explain what grounds they had for the search.
Eric said that his father’s lawyer Christina Bobb was forced to stand at the end of the Mar-a-Lago driveway throughout the raid.
‘There’s 30 agents there,’ he recalled of the Monday search in a phone call with DailyMail.com. ‘They told our lawyer… you have to leave the property right now. Turn off all security cameras.’
‘They would not give her the search warrant,’ he claimed. ‘So they showed it to her from about 10 feet away. They would not give her a copy of the search warrant.’
He said that Bobb was confused why a lawyer for the person’s home being raided by the FBI was not able to see or obtain a copy of the search warrant.
Eric said he would be ‘thrilled’ to find out if there was a valid search warrant.
The FBI declined to comment to DailyMail.com on the raid and Eric’s claim no search warrant was handed over to Trump’s legal team.
‘It’s all a coordinated attack with the FBI,’ the former president’s son added, insisting the raid was approved by President Biden.
‘Do you think that the FBI director is going to raid the former president’s house, especially a house as you know, kind of world renowned as Mar Lago is in a place as public as Mar Lago is without getting the approval of President [Biden]?’ Eric questioned.
By not turning off the security cameras, Eric said they saw the FBI raiding areas of the property that they ‘shouldn’t have been.’
Donald Trump lamented Wednesday that the FBI blocked his lawyers from the property during the raid at his Palm Beach, Florida residence and suggested that agents may have ‘planted’ evidence.

More details surfacing about the illicit, sketchy and highly political FBI raid on President Trump’s home are coming out. The federal agents sent by the DC political system refused to provide the search warrant and demanded all of the security cameras covering the compound be turned off as they conducted their raid.
Thankfully, and due to the suspicious nature of the FBI operatives involved, the Trump security team did not turn off the cameras. The Dept of Justice and FBI have yet to give a public statement supporting the predicate of their raid, as a result the transparent political motives have awakened an entire world to the reality of a corrupt USA deep state.
Based on prior statements outlined by Trump’s legal team, I suspect a different DOJ/FBI motive than is currently being discussed. First, the information from Eric Trump.

No warrant, then they are trespassing...They may have done everything as "brutally and illegally" as possible, intentionally.
Were they really FBI? Credentials or just wearing the hat?
Hunter Biden Breathes Sigh Of Relief As FBI Raid Team Passes By His House On Way to Mar-A-Lago

WEST PALM BEACH, FL — High-level Chinese asset and sex trafficker Hunter Biden breathed a sigh of relief this evening as an FBI raid team passed by his West Palm Beach vacation home to raid Donald Trump's residence in Mar-a-Lago.
"Whew! Thought they had me for a minute there," Biden sighed, according to sources before going back to smoking crack with a hooker on a pile of cash freshly delivered by Chinese agents. "Glad to know the FBI is still working for my Dad!"
The FBI arrived at Mar-a-Lago shortly after, but things got awkward after the FBI raid team ran into the FBI evidence planting team due to a scheduling mistake.

Please, let's stop relitigating the SCOTUS decisions WRT the 2020 Elections. It's been done to death. And also, the legal ramifications of Trump's decision concerning firearms. Knock that off too and stick to the raid on Mar-A-Lago.

Yes, it did provide perspective in this story. So let's move forward with the raid that has a lot of shady things. For example, Trump is suing to get the inventory of things taken. Apparently the FBI did not do that, and it was required. Just one example, there are many more, like the fact the Feebs obviously Judge shopped to get the fellow who signed the Warrant.
FBI Was Given Tip By Confidential Informant Prior To Trump Raid
Carmine Sabia August 11, 2022
. . .
The informant gave specific locations to the FBI on where certain documents were stored and the FBI gave that information to a magistrate judge to obtain the warrant.
So they knew exactly what it was that they were to confiscate and they knew exactly where those items were located. Yet they remained in the house for NINE HOURS searching everywhere that wasn't the area where those items were.Whatever it was they sought, I'm sure they knew it wasn't to be found in Melania's underwear drawer.

Judge Orders DOJ to Turn Over FBI Search Warrant for Raid on Donald Trump’s Home or Explain Why It is Under Seal
by Kyle Becker
August 11, 2022
The federal judge who signed off on the search warrant for the FBI to conduct an unprecedented raid on former President Donald Trump’s estate in Mar-A-Lago has ordered the Justice Department to produce a copy of the warrant by August 15.
Federal Magistrate Judge Bruce Reinhart ordered the DOJ to “file a Response to the Motion to Unseal” the warrant after Times-Union, an Albany, N.Y. newspaper, and conservative legal group Judicial Watch filed a motion to unseal the search warrant. ... No, that's not what's happening. Judicial Watch has petitioned the judge to release the warrant. The judge is giving DOJ an opportunity to respond to (and potentially block) that request. In other words, he is telling DOJ that he will release a copy of the warrant to Judicial Watch if he doesn't hear back from DOJ by Monday.

No. The judge has it. He is the one who issued it. He is the one who placed it under seal.
Current rules - Warrant under seal
Judicial Watch Request - Change the rules to release the warrant
DOJ - Has until Monday to challenge Judicial Watch Request.
@Cyber Liberty
Let's start at the beginning.
- DOJ goes judge-shopping in South Florida. They find one that is a known Trump hater and ask him to issue a search warrant of Trump's house. They submit a sworn affidavit from a witness saying that he has seen 'X' documents in 'Y' location inside the Trump house. DOJ corroborates that these documents are in violation of some federal statute.
- Based on affidavit, Judge agrees to issue a warrant. That court order (which includes a copy of the warrant) is now recorded in the official courthouse records.
- DOJ makes second request. Because of the notoriety of the person involved, they ask that the warrant be sealed.
- Judge agrees to that request and seals the warrant. 'Under seal' means that these courthouse records cannot be made available to the public.
- Warrant is served. By law, the subject of the warrant must be served a copy of that warrant detailing the target and location of the search.
- After the serving of the warrant, a third party (in this case, Judicial Watch and an Albany newspaper) filed a motion with the judge to unseal the court records.
- Since DOJ was the entity that initially requested the records be sealed, he is giving them the opportunity to argue why the records should remain sealed.
- Judge will receive DOJ argument on Monday.
Impasse here. I think he has NOT seen it, likely because he signed a blank Warrant.
Nope. That would end his job. There is a warrant. The warrant has an address printed on it. It has a list of items that are being sought. It has the boundaries of the search area identified. It has a federal statute listed that pertains to this search. And it has a record of a sworn affidavit that was submitted by a witness as probable cause. The warrant will include all of those things. And there is a record of this warrant in the Palm Beach Courthouse where this judge resides. That court record is currently under seal.
And there is zero reason to believe that Trump does not have a copy of it by now. So the big question is - why is Trump not releasing it? Is it because the warrant contains something he doesn't want the public to know? Is it because the judge's seal order applies to him also? Or is it because he is waiting it out for maximum benefit?
I'm thinking option 2 or 3. If it was option 1, it would have been leaked already.

It's entirely possible that Trump, knowing his adversaries have tried to arrest and even frame him for yrs, squirreled away a top secret nuclear document, intentionally hoarded it in a personal stash for some reason & made sure not to keep the stash hidden from Secret Service.

Donald Trump Mocks Claim He Had Classified Documents on Nuclear Weapons at Mar-a-Lago
President Donald Trump on Friday ridiculed a report suggesting he had classified documents about nuclear weapons at his home at Mar-a-Lago, which prompted the FBI raid on Monday.
Nuclear weapons issue is a Hoax, just like Russia, Russia, Russia was a Hoax, two Impeachments were a Hoax, the Mueller investigation was a Hoax, and much more,” Trump wrote on social media.
The Washington Post cited “people familiar with the investigation,” who claimed the FBI was searching Trump’s home for “classified documents relating to nuclear weapons.”
No other details were provided.
https://www.breitbart.com/politics/2022/08/12/donald-trump-mocks-claim-he-had-classified-documents-on-nuclear-weapons-at-mar-a-lago/
Most likely what this is about is that when Trump met NK's Kim Jong Un, KJU wrote on a cocktail napkin "we have 20 nukes we can drop on you" and slid it over to Trump (who, of course, laughed inside), and Trump kept that napkin as a memento of NK's ridiculousness.
Sources familiar with the investigation told ABC News and the New York Times ...Of course that's who they'd tell - a "news" organization gullible enough (and Trump-hating enough) to accept it as truth.
The documents sought by the FBI from former President Donald Trump's Mar-a-Lago estate this week included material designated "special access," a label reserved for information even more classified than “top secret,” according to reports.
Investigators discovered "boxes everywhere" in at least two areas of Trump's home, including his personal office and in a storage room near the pool, FBI agents told NewsNation.
FBI found several classified documents in Trump Mar-a-Lago raid: Report
by Cami Mondeaux, Breaking News Reporter |
| August 12, 2022 08:51 AM
FBI agents found several classified documents during their search of former President Donald Trump's Mar-a-Lago residence, with some documents being considered the highest level of classification, according to reports.
Investigators discovered "boxes everywhere" in at least two areas of Trump's home, including his personal office and in a storage room near the pool, FBI agents told NewsNation. Some of these boxes contained sensitive material that may be so secret it's unknown if investigators will ever publicly disclose what information was found.
Some of the documents that were recovered may have been related to classified nuclear weapons documents, sources told the Washington Post Thursday night.
It’s not clear what kind of information agents thought may have been included in the boxes taken from the White House or whether these documents were recovered, but experts told the outlet the unusual search points to deep concerns that the sensitive information could fall into the wrong hands.
Information on nuclear weapons materials is highly sensitive and is only given to top government officials, according to experts. If the FBI thought that information was located inside the Mar-a-Lago home, that could potentially explain why agents acted with urgency to execute a warrant.
“If that is true, it would suggest that material residing unlawfully at Mar-a-Lago may have been classified at the highest classification level,” David Laufman, former chief of the Justice Department’s counterintelligence section, told the outlet. “If the FBI and the Department of Justice believed there were top secret materials still at Mar-a-Lago, that would lend itself to greater ‘hair-on-fire’ motivation to recover that material as quickly as possible.”
Trump denied the nuclear report, calling the assumption a "hoax."

* Many people have drawn analogies between what Hillary Clinton did and whatever misdeed Trump may now be charged with. I don’t see any comparison. Hillary, while Secretary of State, conducted official business on an illegal, off-the-books server located in her home, apparently for the purpose of evading the Freedom of Information Act. Most notably, the server was insecure, and the Russians, Chinese or others could have, and likely did, intercept her official communications as Secretary of State. [Private Citizen] Trump, on the other hand, has 15 boxes of documents in his basement. There is no comparison.
Mar-a-Largo CCTV Cameras Were Only Off For Short Period
Christina Bobb states that while staff initially complied with the FBI request to turn off the CCTV cameras in Mar-a-Lago, President Trump’s lawyers stepped in and the cameras were turned back on.

Of course that's who they'd tell - a "news" organization gullible enough (and Trump-hating enough) to accept it as truth.“Federal law, long-standing department rules and our ethical obligations prevent me from providing further details as to the basis of the search at this time,” Garland said.

iT'S A DONE DEAL, ALL DOCUMENTS WERE DECLASSIFED WILE HE WAS PRESIDENT VIA EXECUTIVE ORDER. TRUMP CHECKMATED THE DOJ THEY ARE GOING TO LOOK FOOLISH. It might be a good idea for the DOJ to read these before executive orders before making them themselves look like a fool.

There is no administrative process requirements for the President to declassify documents. I other words it only requires a simple witness.
I followed it, @roamer_1 attacked his post, calling it HS. @IsailedawayfromFR attacked a Briefer personably, calling him, or whatever pronoun that Mountain Man uses, HS.
I love them both as Briefers and they contribute so much here.
No. Actually, @IsailedawayfromFR provided a much longer back and forth than any of us do with @roamer_1
because well, he's an 'unmovable' force.
Each of those are qualities I admire: a person willing to engage, and a person unwilling to compromise their standards. Personally, I don't have a problem with either poster. I have seen a lot of posters here beat up on Roamer, and I have seen a lot of posters let their emotions get the best of them. We are all human. Forgive and forgive.

There was a popular meme going around that simply said "WE HAVE IT ALL!!" ...Pres. Trump
But you can't believe it valid.
Hell...social media's turned Morgan Freeman into 'Socrates'.
Definitely real key-limes. No fake liquids are used when I make my pies. Never. What's the point then of homemade?

Brilliant tactical move by DOJ on selecting statutes for the search. None of the crimes cited require the documents to be classified. Any claim by Trump that he declassified the documents is irrelevant. I’ll discuss at 7 am ET on
@MSNBC
.
I disagree on that point. Trump never campaigned as a Conservative or a Swamp Drainer. People who thought they identified with those things simply attributed them to Trump because they liked Trump. Trump was being Trump, period. You knew what you were getting. Divorces, bankruptcies, Clinton wedding photos, Reagan critic, and all.
I like Trump because he gave it right back to the DNC press. I liked his foreign policy moxie. But at no time did I ever believe him to be a Conservative.
Very well said. Forgive and forgive. You never know when somebody is having a lousy day.
Do you use condensed milk?
Nope. I zest and squeeze dozens of key-limes to make it.
Andy McCarthy: Wehavehad the 4th Amendment to prevent Mar-a-Lago type raids.
Fixed it!
Oh he plays his charisma... That part is right.
But he is definitely a con. He's a chaos con. He lives to piss everybody off, and follows through with a martyr play - Just about every time. And he has done it all the way along. Long before his political career.
Everyone feels sorry for all the flak he takes, but I don't because I know he is a pig in sh*t. He LOVES this kinda thing. And often, mostly, he causes it on purpose... He likes to cause the meltdown - And it IS funny... But I think he does it because people that are out of their minds don't think very well.
That's fine @Bigun  We have already proven we don't have to agree on everything. This was no mishap it was people who were not Constitutionally authorized to make election law doing so by edict. There is my beef. If my State has to follow the Constitution in that the legislature makes the election rules, and those other states do not, the results can unfairly and illegally affect the outcome of the election. (which they did in 2020).
I don't think the Constitution was violated... I think what you propose would be far worse.
Because if successful, every_single mishap in every election will be seized upon to decertify results and the winner of that mess will be the liberals. Mark my words.
That's why that firewall is there.
@roamer_1Yep.
This was no mishap it was people who were not Constitutionally authorized to make election law doing so by edict. There is my beef.
The post I reacted to was a taunt, and I had been trying to be nice, because Cyber wanted the hi-jack ended. So I had reason to be unreasonable... Even if it wasn't wise... Or elegant.
I return to this by the way, before anybody gets bent around the axle... i really do not mean it to be derogatory. It ain't meant to be. Just commentating on how a player plays. What he DOES with that is a different issue, and could be taken either way.
Which you will notice I did not comment on (right here right now).
All I mean to say (and to reinforce) is that it should not be surprising that he would have dirt.
That's all the there that's there. happy77

The official who triggered the federal probe into former President Donald Trump's handling of classified documents opted against doing the same concerning Hillary Clinton's email scandal.
David Ferriero, who served as the director of the National Archives and Records Administration (NARA) from November 2009 until he retired this past April, said in a February letter to House Oversight Committee leadership that his staff had started communicating with the Department of Justice (DOJ) earlier this year.
In January, Trump returned 15 boxes of documents from his time in office to NARA after the agency notified him the material belonged to the federal government. ...

Trump Ally Says He Knows What the FBI Was Looking for in Mar-a-Lago Raid
By Victoria Taft Aug 13, 2022 8:37 PM ET
The lead investigator in the House of Representatives committee on the Trump Russia hoax says he knows why the FBI raided former president Donald Trump’s Mar-a-Lago resort, and it didn’t have anything to do with scary-sounding “classified documents relating to nuclear weapons,” as the DOJ got The Washington Post to spread on its behalf.
Kash Patel believes something more is afoot than a beef between Trump, the General Services Administration (GSA), and the National Archives and Records Administration (NARA).
The former federal national security prosecutor and Trump Administration Chief of Staff for the Department of Defense believes the FBI raided Trump’s resort to seek and destroy any documents related to the Trump-Russia hoax — Russiagate — that Trump had previously declassified back in 2020 and 2021.
The former federal prosecutor told Fox News anchor Martha MacCallum that Donald Trump issued “sweeping declassification orders” in 2020 and 2021, including the Russiagate and Hillary Clinton email investigation documents.
https://twitter.com/bennyjohnson/status/1558173138885672960
When that is added to the comments by the Director for National Intelligence (DNI) in the Trump Administration, John Ratcliffe, you begin to wonder what’s really at play here.
Ratcliffe told Fox Business anchor Larry Kudlow, another former Trump official, that “surely this is not about classified documents and the president being in possession of those.” He said, “it has to be more than that because the Department of Justice and the FBI have already set a standard that makes it virtually impossible to prosecute a case like that.”
The Washington Examiner reported that Ratcliffe claimed this was settled back in 2016. “As people talk about Espionage Act and classified documents and all of that, the standard was set in 2016,” with the Hillary Clinton email probe. He said, “the Department of Justice and FBI said six years ago, you gotta be able to prove intent. He’s already denied that he had the intent to do it.”

Trump lashes out at FBI amid fallout from Mar-a-Lago raid: 'See what they were willing to do'
The former president's rant came after the FBI conducted a raid on his Mar-a-Lago estate in Palm Beach, Florida
By Lawrence Richard | Fox News
Former President Donald Trump lashed out at the FBI on social media Saturday night, calling their integrity into question days after they conducted a raid on his private Florida residence.
In a series of posts, Trump called the FBI "corrupt" and claimed their raid at Mar-a-Lago on Monday was just the latest in a series of attempts to undermine him. These claims are unsubstantiated.
"The FBI has a long and unrelenting history of being corrupt. Just look back to the days of J. Edgar Hoover," the former president wrote on TRUTH Social, referencing the first director of the federal bureau.
Trump added: "In the modern era, nothing has changed except that it has gotten far worse."
The former president then made a series of unverified claims involving former FBI Director James Comey, former FBI Deputy Director Andrew McCabe, former FBI agent Peter Strzok, and former FBI attorney Lisa Page. He also referenced the way the FBI impacted the 2016 presidential election.
"Look at Comey, McCabe, Strzok and lover Lisa Page. Check out the brilliantly written but damning I.G. Reports. See what they were willing to do in order to get Crooked Hillary Clinton elected (they failed), and got caught! They spied on my campaign, pushed the FAKE Dossier, and illegally used the FISA Court," Trump claimed.

Trump never had 60 votes in the Senate so his ability to drain the swamp was limited.
This is true. And many senate Republicans were working just as hard to torpedo his efforts on that front as any Democrat!
And Trump did shut down the government 3 times to get congress to reduce those outrageous funding bills but the republicans were to focused on big bad Trump than doing their jobs.

If true, this is an outrageous overreach. Passports can be ordered by a court seized once an individual is indicted based upon concerns they may be a flight risk. I have never seen passports seized pursuant to search warrant except where the target used fake passports.

Let's imagine for a moment that the person is a member of his Secret Service detail. If this agent can't be trusted to act in good faith with the person he is sworn to protect, then how can he be trusted to protect his life? Let's say a gunman approaches Trump on the street. Will this agent risk his life to protect the President? Or will he simply step aside and tell the gunman to have at it?
Trump needs to know he can count on the people around him.

Because he has something they need...it's his insurance.
Well it won't be the first time a Democrat filed a false affidavit. (See: David Boies, Florida, 2000)
Which is all the more reason the judge should release the affidavit. This isn't a FISA court. It isn't a federal appellate court. it isn't even Federal circuit court. This is lowly magistrate court. This case may make it to Atlanta in the near future.

“We have learned that the filter agents seized three passports belonging to President Trump, two expired and one being his active diplomatic passport. We are returning them, and they will be ready for pick up at WFO at 2 PM today,” the email to Trump’s attorneys read.

They will make Trump a martyr.
Dems really stepped in it this time.

So now that the DOJ blatantly lied about Trump’s passport, how can we believe ANYTHING they say about this raid is true?
It's too late now. The documents are no longer 'privileged' because they have been reviewed by several different layers of investigators. Confidentiality has been lost. And on that alone, the search should be declared illegal, and any and all evidence derived from it declared inadmissible.

I was under the impression that there is a 90 day deadline before an election that prevents the DOJ/FBI from these gestapo tactics. By Law (if that even matters anymore) they couldn't have raided MaraLago this week. There is. The DOJ acted on the 91st day prior to the election, just to play by the rules, because they have such respect for the rule of law. :silly:

I believe that it is just a matter of DOJ policy: https://www.lawfareblog.com/justice-departments-policy-against-election-interference-open-abuse
Eric Trump Reveals His Family Has Footage of What Really Happened During Mar-a-Lago Raid

In an interview Monday night with Fox News host Sean Hannity, Trump’s son Eric Trump touched on the surveillance tapes that exist documenting what the FBI agents did as they searched the Trump estate. Eric Trump had said that staff refused an FBI request to turn off the surveillance cameras.

Signs are the Biden operation raided Trump's home to see what he had...on them. Watergate break-in pales in comparison.

Yes it was to see what they had on them and also to see how they can keep him from running in '24.
In last night's show Levin asks a question I've been asking: Where the hell are the statements on this raid from the former Presidents??Pretty simple.... None of them like Trump.

Protecting the uniparty.. Anything to keep the status quo going and Trump is the threat.
The federal government has grown too big, and is out of control.

NYT:
WASHINGTON — As the midterm elections near, top Justice Department officials are weighing whether to temporarily scale back work in criminal investigations involving former President Donald J. Trump because of an unwritten rule forbidding overt actions that could improperly influence the vote, according to people briefed on the discussions.
Under what is known as the 60-day rule, the department has traditionally avoided taking any steps in the run-up to an election that could affect how people vote, out of caution that such moves could be interpreted as abusing its power to manipulate American democracy.
We’ll see ‘bout that!!!
It was 'O'riginally reported as a 90 day rule @BellyAche
We will soon come to realize that rules don't apply anywhere, anymore.

REPORT: New FBI Raids for Donald Trump Expected as Biden Administration Impanels Criminal Grand Jury to Investigate Election Campaign Arm..

They didn't find the dirt Trump had on the FBI and DoJ at MAL,so it's time to find a new fishing hole.
Biden and his criminal gestapo FBI/DOJ are past obsessive with DJT.
I hope some hard core MAGA folks start camping out and start guarding his residences.
That would not be a good idea. That would almost certainly end up in precisely the sort of violence the democrats are trying so desperately to trigger, and could lead to a latter-day Reichstag Fire scenario which they would use as a figleaf to declare martial law and suspend elections, and most of the Constitution.
So what is your suggestion for fighting this gestapo? Rely on elections that will be rigged anyway?
Just wondering.
Start from the ground up, at the state and local level, and put the fighting into getting clean, auditable election rules in place - no more mail-in balloting, no more early voting, no more electronic voting - paper ballots - rigid, mandatory record-keeping and reporting rules, and massive amounts of required transparency on ballot-counting - requisition sports arenas if need be.
If you think that getting violent is going to do anything other than play directly into their hands, well, enjoy prison; it'll be the last time you breathe free air - just ask the J6 political prisoners.

Where in my previous suggestion did I say "get violent"? Don't project my posts. People loyal to Trump could camp out and not carry out any thing resemembling violence. And do it effectively.
They didn't find the dirt Trump had on the FBI and DoJ at MAL,so it's time to find a new fishing hole.
Then what are they going to do? Just stand there and stare? What will that accomplish? People who are riled up enough to spend days or weeks camping outside of Trump's properties on the off chance the FBI or the police will show up to execute a search warrant - and they will have warrants - are people who are riled up enough to take the bait.
Why not bring a couple of full plastic gasoline containers to your next camping trip and store them a few inches from the fire pit?
Baloney on the gas analogy.
Peaceful obstruction and tons and tons of film of the FBI carrying out the raid, and placed on social media, might do wonders in the court of public opinion. Knowing which agents are hung ho- to take the assignments migh squelch further memebers wanting to take part.
The left has been doing this for decades, with much success.

Just a fishing expedition, shotgun style approach to finding ANYthing, anything at all, to hang him with. Guaranteed anything sensitive and private will be leaked...
This indicates they know they have failed, and reeks of a drowning man grasping at the sky trying to stay afloat.

Not to worry!
The Dims are capable of making something up if they can't find anything, and then picking a leftist judge to rule it as solid evidence.
The 'murikan judiciary is as corrupted as the 'murikan political system.
Even Trump, with all his money and lawyers will not be able to PROVE he is innocent, and this is all about political destruction, not an actual conviction.
Although the entire left would go orgasmic if it were to happen.
And they had better enjoy it while they can because I honestly think that would be "One Step Too Far" for a majority of Americans.
After all,the left isn't even trying to hide their lies, corruption, and desire to rule with absolute power anymore, and I don't think at this point it would take much to really set people off.
I have talked with a lot of ordinarily calm folks, some of whom are well enough heeled to prep as we can only dream, who are hunters and gun folks, and they are concerned.@Smokin Joe
