The impeachment trial of suspended Texas Attorney General Ken Paxton begins at 9 a.m. CDT on Tuesday. The trial is expected to last at least two to three weeks as House impeachment managers present witness testimony and more than 4,000 pages of evidence.

Paxton faces trial in the modified Senate chamber of the Texas Capitol for abuse of public trust and bribery as expressed in the 20 Articles of Impeachment passed by a vote of 121-23. The bipartisan votes for impeachment came from 60 Republican legislators and 61 Democrats. Only 23 Republican legislators voted against the impeachment. Under the Texas Constitution, Paxton was suspended immediately from his position as Attorney General of Texas.

People I know work with him.  They are the ones saying he's not a great guy.  I've never met the guy.

I've known HIM since he was a member of the Texas house. He was somewhat unpopular in that body because of his uncompromising nature when it came to conservative issues.

Nothing changed in that regard when he became AG. If one is going to make an omelet one MUST break some eggs! Paxton broke eggs!

In a fiery response to the House impeachment managers’ opening statements, Ken Paxton’s lawyer Tony Buzbee argued that “this whole case is a whole lot of nothing.”

In a nearly hour-long speech, Buzbee and defense attorney Dan Cogdell made sweeping promises that he and his legal team will disprove accusations in the impeachment articles by showing photos of home renovations and documents that refute allegations, including that Paxton’s political donor Nate Paul paid for his home renovations, and claiming there is no evidence that Paxton used burner phones or secret emails to communicate, as alleged by the House managers.

Paxton’s lawyers also said many of the allegations are based on assumptions that will be disproven — and vowed that there is not enough evidence on any count to prove the attorney general’s guilt beyond a reasonable doubt.

Buzbee criticized the media and the gag order imposed by Lt. Gov. Dan Patrick that prevented Paxton and his lawyers from responding to allegations and media reports leading up to the trial.

He and Cogdell also made a political argument that if the Senate votes to impeach and remove Paxton from office, they are undermining the will of the voters who elected him, while detailing Paxton’s conservative record as attorney general.

“What happens here will have consequences no matter how it turns out,” Buzbee said. “If this misguided effort is successful, which I am confident it will not be, the precedent would be perilous for any elected official.”

After Senators resoundingly rejected all of Attorney General Ken Paxton motions to dismiss articles of impeachment against him Tuesday morning, Lt. Gov. Dan Patrick handed Paxton a small victory by ruling that he cannot be forced to testify as a witness in his trial before the Texas Senate.

The Senate-approved rules for the trial gave Patrick, who is acting as the presiding officer, or judge, the power to issue subpoenas to compel the attendance of witnesses.

Paxton had stated that he would not testify in the trial, and his lead lawyer, Tony Buzbee said in a statement in early July that Paxton "will not dignify the illegal House action by testifying."

His lawyers followed by filing a pretrial motion asking the Senate to excuse Paxton from testifying, arguing that the trial is a criminal proceeding, giving Paxton the same legal protections as a criminal defendant who would not be forced to testify.

Testimony offered in the Senate’s impeachment trial of Attorney General Ken Paxton raises questions about who has been behind the movement to oust him from office, with a former top deputy accused of staging a coup.

Wednesday marked the second day of the trial and picked up where yesterday’s proceedings stopped, with the prosecutions’ first witness, Jeff Mateer.

Mateer, who is currently the Chief Legal Officer at First Liberty Institute, formerly served as the First Assistant Attorney General under Paxton.

He resigned from the position in October of 2020 after he, along with seven members of the AG’s office, accused Paxton of engaging in unethical acts and abuse of office in order to help real estate developer Nate Paul.

Additionally, Buzbee revealed that Mateer and other employees had sent correspondence from the Office of the Attorney General on which they had removed Paxton’s name from the letterhead.

“You were involved in staging a coup, weren’t you?” Buzbee asked, pointing to Mateer’s meeting with the governor’s office, communication with Texans for Lawsuit Reform, and the removal of Paxton’s name from the letterhead.

'An undemocratic assault on the will of voters'

There's an impeachment going on in the Texas legislature now. Attorney General Ken Paxton is being targeted on allegations of bribery and such.

But the case also has been described as largely political by critics and as the proceedings begin, he already has support from eight of the 10 state senators he would need to be cleared.

That's the number who voted that most of the case should be thrown out because the events happened before his most recent election.

He was voted to trial in the state Senate by a vote in the state House, and is facing 16 counts related to misuse of his office.

A commentary from WND columnist Andy Schlafly charged that the case was an "ambush impeachment" and an "undemocratic assault on the will of voters."

They had returned him to the AG's office by some 800,000 votes last year.

Schlafly explained, "Texas House Speaker Dade Phelan, who was elected by pandering to Democrats, 'kept this under wraps until the end, there wasn't a lot of time for Paxton's defenders to react,' observes Rice University political scientist Mark Jones."

Paxton certainly has offended a number of major powers, with his fight against Joe Biden's open borders agenda and his decision to investigate Pfizer over COVID-19.

Sen. Ted Cruz, R-Texas, has called him "the strongest conservative AG in the country. Bar none" in recent years.

Why Tony Buzbee Keeps Bringing Up George P. Bush

Buzbee’s questions and occasional editorial comments on testimony are trying to suggest that the impeachment proceeding has been orchestrated by a group of Republicans in Name Only, including Jeff Mateer, currently on the stand, and . . . former land commissioner George P. Bush. In various instances, Buzbee has pushed Mateer, one of the staffers who blew the whistle on Paxton, to elaborate on the timeline of the whistleblower lawsuit and his communication with the attorney general about it. Specifically, Buzbee is angling for an answer as to why the eight former aides didn’t tell Paxton that they went to the FBI until October 1, 2020—the same day, Buzbee noted, that Bush applied to reactivate his law license.

Bush is one of several Republicans who levied a primary challenge against Paxton in 2022. Paxton routed him in a runoff. Buzbee hasn’t said it directly, but it seems like he’s trying to get Mateer to admit, under oath, that the whistleblowers, Bush, and leadership-aligned groups such as Texans for Lawsuit Reform were trying to get Paxton out of office. It’s unclear whether this argument will pass muster—especially because one doesn’t need a law license to serve as attorney general of Texas.


The Jury Is Starting to Get Restless

Tony Buzbee scored his points early in his cross-examination of Jeff Mateer, as I wrote before. Now the examination has devolved, for a seeming eternity, into a back-and-forth concerning the hiring of Brandon Cammack, a lawyer Paxton brought on to investigate complaints Nate Paul had raised about the FBI raid of his home. Hardin, who stayed quiet during the cross-examination before the lunch break, finally objected to the line of questioning.

The senators, for the most part, are trying to stay alert, though degrees of slumping can be observed. Donna Campbell of New Braunfels was momentarily curled over her desk in a position of seeming abject despair. Angela Paxton, crisp in a blue-and-white-checked jacket and a matching blue shirt, meanwhile, is watching intently. Her husband is still MIA.

Why One Allegation Against Paxton Keeps Getting Considerable Play

The flashiest allegations levied against Ken Paxton involve personal misconduct or venal corruption, and they have gotten a lot of attention: Nate Paul hired Paxton’s mistress, Nate Paul paid for Paxton’s kitchen renovation, that sort of thing. But a much lesser-known incident has already surfaced a couple times, and it has to do with an unexpected topic: Ken Paxton’s conditional appreciation for COVID restrictions.

Knowledge of the incident in question is not new. According to House investigators, Paul’s real estate empire was floundering, and he needed breathing room. In a remarkable coincidence, Paxton’s AG’s office fired off an opinion that public foreclosure sales could not be held because of restrictions limiting crowd size during the early days of the pandemic. (Side note: his office asked Senator Bryan Hughes, of Mineola, to request the opinion—creating the circumstances for what would become one of the impeachment proceeding’s many conflicts of interest.) When the employee tasked with writing the opinion initially opined that foreclosure sales were fine, he was allegedly told that Paxton wanted it to say otherwise.

Paxton defense presses whistleblower on what evidence he brought to FBI

On cross examination, Paxton’s defense attorney launched into whistleblower Ryan Vassar for bringing no physical evidence when he and others reported their boss to the FBI. Vassar said he was a witness and not an investigator.

A whistleblower’s comment that he and his associates “took no evidence” when they reported Ken Paxton to the FBI has turned into an early flashpoint in the attorney general’s impeachment trial.

The comment Thursday from Ryan Vassar set off jubilation among Paxton supporters and prompted a House lawyer, Rusty Hardin, to coach Vassar through a clarification Friday.

Vassar said he meant physical evidence, and Hardin asserted that Vassar going to the FBI was inherently a form of evidence because he was a witness to a potential crime.

Vassar, the former deputy attorney general for legal counsel, was among the top Paxton aides who went to the FBI in October 2020 to share concerns that Paxton was abusing his office to help Nate Paul, an Austin real estate investor and Paxton campaign donor. The articles of impeachment accuse Paxton of going to extraordinary lengths to help Paul investigate his perceived enemies as his businesses were floundering.

Cross examining Vassar on the witness stand Thursday afternoon, Paxton lawyer Mitch Little zeroed in on the decisions the whistleblowers made before reporting Paxton to the FBI. As part of that, he pointedly asked Vassar: “I want to get this straight: You went to the FBI on Sept. 30 with your compatriots and reported the elected attorney general of this state for a crime without any evidence, yes?”

“That’s right,” a stone-faced Vassar replied. “We took no evidence.”

Little paused for dramatic effect.

Vassar had previously disputed the premise of the line of questioning — that the whistleblowers would be expected to bring evidence to the FBI to report their concerns. But his “no evidence” comment quickly took on a life of its own, giving pro-Paxton forces an opening after a trial that began Tuesday with a barrage of setbacks as senators rejected all of Paxton’s pretrial motions to dismiss the articles of impeachment.

“BOMBSHELL: Lead ‘Whistleblower’ In AG Ken Paxton Impeachment ADMITS No Evidence Submitted To FBI,” the pro-Paxton Conservative Political Action Conference tweeted.

"Their entire case is falling apart," Jonathan Stickland, the head of a pro-Paxton group, said Friday on Steve Bannon's "War Room" podcast. "We have witnesses come up and say, 'Yeah, I went to the FBI with absolutely no evidence.'"

OK, I'm half a continent away, but the contradiction between this shampeachment claim:

Paxton went "to extraordinary lengths", but the accusers went to the FBI with no memos, no cell phone recordings, no meeting notes (not even their own!), no emails, not even a fortune from a fortune cookie?! Testimony in the Senate’s impeachment trial of Attorney General Ken Paxton has revealed that a Bush-connected lawyer has not billed whistleblowers for his representation.

Many of the impeachment charges were spurred by a group of employees of the Office of the Attorney General that reported Ken Paxton to the FBI in 2020 due to what they said was illegal and unethical abuse of office.

On Friday, cross-examination continued of Ryan Vassar, former deputy assistant attorney general for legal counsel and one of those whistleblowers.

Mitch Little, one of Paxton’s lawyers, asked Vassar about his legal representation by Johnny Sutton.

Sutton has strong ties to the Bush family. He was an advisor to George W. Bush when he served as Texas governor, and Sutton was later appointed to be a U.S. attorney when Bush was in the White House.

I have voted for Paxton since 2014 and will continue to do so whenever he's on the ballot. You can make up your own mind. I ain't a teacher. I try to stay away from religion and politics discussions. I just post articles I find interesting. No one is perfect.

I've known Ken Paxton for quite a while. I have never attended Church with him or asked anything about his personal life, but I will vote FOR him for any office he seeks either here in Texas or elsewhere.

Back in may, Andrew Murr, Ann Johnson and the leadership in the Texas House promised that Ken Paxton was a felon. That he was a criminal. They promised that even though they didn't produce any evidence, or cross examine any witnesses, that the facts and the law would be determined by the Senate, with the evidence produced at the trial.

Well, we are not more than halfway through the trial, and the Texas House has not produced evidence.

Also, the Defend Texas Liberty PAC has released its monthly statewide GOP voter poll and there are some remarkable findings this month. Donald Trump has experienced a post debate bump, and voters are almost unanimous in their opposition of Jacey Jetton's bill to give taxpayer money to mental health facilities that use transgedner ideology in their treatment with children.

It's my understanding that the men that were fired by Paxton and are testifying against him are strong Christian men, I've never met any of them nor know anything about each.  Also, didn't Paxton have an affair on his wife during this time?  Paxton is not a great guy, so I hear.

I've never met Paxton, but when my best friend, who works in Paxton's sphere and knows all of the players says Paxton is not a good guy, I tend to believe them.  They also know the people fired by Paxton and say they are very honorable individuals.  It's hard to discount their testimony.  It sounds like Paxton pulled a few strings for a donor, which apparently was unethical.  Seems this is the bottom line of this case.

Looks like we have hit the homestretch of the Ken Paxton impeachment trial, at least according to Lt. Gov. Dan Patrick who is acting as the judge in the case before the Texas Senate.

Patrick told members of the Texas Senate today they will not take any days off from here on out until they reach a final decision on whether Paxton, currently the suspended attorney general, will become the first statewide elected official impeached in Texas since 1917.

“From this moment forward, no off days until the trial, the deliberations and the decision is given,” Patrick, a Houston Republican, said.

Each side has about 14 hours remaining to question witnesses. That clock will likely run out by Thursday morning, Patrick said, and then both sides will have an hour for rebuttal and another hour for closing remarks.

Firing honorable people isn't unethical is it? For one thing, that's a subjective definition.

Hate to tell you, but for good or bad, if your bar for impeachment and conviction is based on pure ethics, The Capitol, and all the county's statehouses would be near vacant.  Not justifying, just being realistic of what pretty much has become witch hunt, with Kanagroo Court Legislators deciding his fate.

And if you really could be a universal fly on the wall, I'll venture a guess that the fictional Washington bound Mr. Smith does not exist.

Proving this claim with documents - hard copy and soft copy - should be incredibly easy ... and the lack of such evidence is an indicator that the accusation is non-credible.

The reason I'm following this myself is that I knew going in that the press would parrot the prosecution line and, as usual, what they DON"t report is more important than what they do report.

As in, the defense has thus far very effectively shredded EVERY prosecution witness.

Paxton would likely get replaced with someone just as conservative.  They don’t have the 2/3 rds to convict him.  Doubt this was good for his marriage.

He has been formally censured by his home county Executive Committee, several other counties have formally endorsed that, and the SREC will take up the matter at their October meeting.

Several people have already announced their intention to run against him in the primary.

AUSTIN — As the trial of Attorney General Ken Paxton continues its second week, more details about the role George P. Bush allegedly played in the impeachment effort have come to light.

Paxton’s defense team has advanced the theory that a Bush political network has worked for years to oust the attorney general, as reported by The Dallas Express. (https://dallasexpress.com/state/is-bush-family-part-of-a-plot-to-unseat-ag/)

During cross-examination, it was noted that disgruntled employees of the Office of the Attorney General (OAG) went to the FBI on September 30 regarding potential unlawful conduct by Paxton. The very next day, Bush reactivated his law license after a 10-year hiatus.

Furthermore, many of the whistleblowers had retained Bush-affiliated lawyer Johnny Sutton to represent them in the matter. However, during the trial, it was revealed that Sutton had not charged them over the course of three years and that fees had hardly been discussed.

Ryan Vassar explained, “He has agreed to bill us at a future date.”

Sutton was the criminal justice policy director for George P. Bush’s uncle, George W. Bush while the latter served as the governor of Texas. Sutton also led the Department of Justice transition team for George W. Bush after he was elected president.

Bush then named Sutton associate deputy attorney general before appointing him as U.S. attorney for the Western District of Texas, a position he held from November 2001 to April 2009.

Sutton also notoriously prosecuted several border patrol agents while acting as a U.S. attorney, apparently giving drug traffickers legal immunity in order to secure the agents’ convictions. Sen. Dianne Feinstein (D-CA) claimed Sutton had a “prosecutorial over-reaction” following a congressional hearing on the subject in 2007.

“You weren’t going after cartels in this case,” the senator said. “You were going after Border Patrol agents.”

Throughout the case, Sutton was “vigorously supported” by President George W. Bush, while congressmen called the prosecutions “the worst betrayal of American defenders I have ever seen,” per the Washington Times. Bush eventually commuted the agents’ sentences in 2009, but President Donald Trump actually pardoned them in 2020...

Nothing I have seen indicates that he will be doing so with Phelan.  Depending on the nature of the event, I assume that it is quite possible that a fundraising event in Phelan's own district may apply to both him and to DeSantis, but that does not mean that DeSantis is fundraising with Phelan, other than in the mere coincidence category.

I have held GOP rallies and fundraisers that were public and alcohol was served. The Party did not pick up any bar tabs, they were paid for by the attendees themselves.

Patrick has been vocally critical of the House-led impeachment since the trial concluded on Saturday.

After signaling that he would call for an audit into the Paxton impeachment trial expenses shortly after the verdict on Saturday, Lt. Gov. Dan Patrick has now officially made the request.

In a letter to state auditor Lisa Collier, Patrick asks for all expenditures incurred by the Texas House of Representatives, the Texas Senate, and the Office of the Attorney General from March 1, 2023 through October 15, 2023.

“To be clear, the goal is to determine the absolute total cost to the state of preparing for and conducting this trial from the beginning through its conclusion,” wrote Patrick. “This must detail all expenses, including but not limited to, investigators expenses, document production and assembly, attorney expenses, witness fees, travel, food and lodging. This list is illustrative, not exhaustive. Please determine and report on all expenses; if there are invoices outstanding, we seek to know what they are and when they will be received.”

Within minutes of the Texas Senate voting to acquit Attorney General Ken Paxton of all impeachment charges, the politics came into much clearer view.

Lt. Gov. Dan Patrick, who oversees the Texas Senate, broke his months of silence and declared the Texas House “rammed through” the impeachment and wasted taxpayer money and time.

“An impeachment should never happen again in the House like it happened this year,” said the Houston Republican who was acting as the judge in the impeachment case.

His comments immediately triggered an angry rebuke from House Speaker Dade Phelan, a Beaumont Republican, who said Patrick was attacking the House for “standing up against corruption.” Phelan said Patrick’s comments show the trial outcome was “orchestrated from the start, cheating the people of Texas of justice.”

It all highlights an inescapable political reality: leaders of the House and Senate don’t like each other much these days. Phelan and Patrick have been at odds for months, barely communicating most of the last year and with plenty of name-calling, as I reported earlier this year. They fought over property tax reforms and when the first special session was called in the summer, Phelan had his members meet for just one day before bailing on Austin. That made certain no further negotiations would happen resulting in the 31 members of the Texas Senate having to return for yet another 30-day special session later, further ruining their summer.

I can attest personally, that there are some local grumblings about Phelan.   He tried to do this stealthily, but with the internet, and some actual local coverage, there is a growing groundswell against him.  And they don't care how powerful he is, or how much extra he brings to the locals.
