Could Derek Chauvin Win An Appeal? Here’s What Legal Experts Say

Former Minneapolis police officer Derek Chauvin’s defense team is likely to appeal his three convictions for killing George Floyd, but legal experts say the odds of success are incredibly slim.

Chauvin was convicted of both second and third-degree murder, as well as manslaughter. He’s scheduled to be sentenced on June 25, after which point his defense will have ninety days to file an appeal.

Legal experts and television pundits have debated multiple potential lines of argument for appeal, including Judge Peter Cahill’s refusal to change the trial’s venue, possible civil unrest that might’ve occurred if Chauvin wasn’t found guilty and potentially inflammatory comments made by people like Democratic California Rep. Maxine Waters.

Experts say that the venue challenge will almost certainly be rejected. It’s unlikely that a pool of potential jurors anywhere in the state of Minnesota could have avoided the intense media coverage and civil unrest that surrounded the case.

“If they were to overturn the conviction and send it back to the trial courts to be retried in a different venue, it would be even more difficult now than it was before the first trial to find another location in which pre-trial publicity wasn’t ubiquitous,” Minneapolis-based defense attorney Brock Hunter told the Daily Caller.

For him to win an appeal, the nation would have to have honest courts.

If the nation had honest courts, he couldn't have been convicted.

if the nation had honest courts, the Chief Justice of the Supreme Court would not have considered the social outcome of his decision regarding blatant Rodent election fraud in 2020, and Biden would not have been allowed to illegally occupy the White House.

So, no, Chauvin isn't going to win any appeals.

If some miracle happens and he wins an appeal, the fascists in the Just Us Department are going to nail him with unconstitutional double-jeopardy civil rights bogus violations.

I don't believe that Chauvin can win an appeal that is "pushed up" through the state courts to the state supreme court (where any state appeal would end up).

I'll reckon Minnesota's supreme court is populated by leftist judges who will reject any appeal out-of-hand.

To be realistic, I believe that all Chauvin can hope for at this point is for a future Republican president (assuming there will ever BE one) to commute his sentence to "time served" (assuming that a president might have the power to do that).

Other than that, his future is grim.
Again, why I said before the trial his best strategy would have been to slip out of the United States to another country without an extradition treaty...

An honest SCOTUS ruling would merely rule that the public gov't announcement of $27 MILLION days before the jury went into deliberations certainly harmed the defendant...and throw it back to the previous Court that ruled on it. 

Maybe he'd win his freedom that way?    :shrug:

IMHO, he will win an appeal as the original verdict was tainted by the venue and the Floyd family award prior to the verdict.

He will, however, not be able to win against the federal Civil Rights lawsuit as the burden of proof will be unfavorable to him.

Biden's administration will simply follow the Bush/Barr strategy to convict and imprison him, just as Bush/Barr did with the Rodney King cops when they were found innocent. And if I recall correctly the Biden injustus department is is already exerting pressure for an extreme penalty to be handed down.
