Full Fifth Circuit Hears Arguments Over the Fate Of Texas' Floating Border Wall

The legal saga over the fate of a 1,000-foot floating barrier on the Rio Grande has entered a new phase.



Texas Gov. Greg Abbott last summer ordered the deployment of the string of giant orange buoys in the river near Eagle Pass. As a part of Operation Lone Star, the Republican governor’s signature initiative aimed to curb illegal border crossings from Mexico into his state, the buoys are anchored to the bottom and themselves rotate so that people can’t climb over or swim under them.

Following the installation of the barrier, the Biden administration sued Texas, demanding that it be taken down. Attorneys for Texas invoked the Constitutional right for each state to defend itself against “invasion”—in Texas’ case, by those illegally crossing the river, but that self-defense argument was rejected by the lower court, as did by a split three-judge panel of the Fifth Circuit Court of Appeals.

Arguing on Wednesday before a full, 17-member Fifth Circuit, attorneys for both Texas and the U.S. Department of Justice largely focused on the question of whether Mr. Abbott’s floating wall violates a Reconstruction-era law regulating the use of waterways.

ICE Points To Biden Admin Policy As Reason Illegal Immigrant Accused Of Murdering Teen Was Out Free

Federal immigration authorities cited a Department of Homeland Security (DHS) policy directive when explaining their handling of an illegal immigrant who is now charged with the murder of a teenager.

Antonio Antonio-Rodas, an illegal immigrant from Guatemala, was arrested and charged with murder last week for a fatal car accident in Alabama involving a 19-year-old.

Immigration and Customs Enforcement (ICE) confirmed to the DCNF that they had been aware of Antonio-Rodas’ criminal history and legal status since he was arrested for a DUI in 2021, but cited the COVID-19 pandemic and a directive issued by (DHS) Secretary Alejandro Mayorkas that altered enforcement priorities as a reason for not taking custody of him at the time.

The Semmes Police Department arrested Antonio-Rodas earlier this month for a car crash on April 28 in a Mobile, Alabama, suburb that resulted in the death of 19-year-old Adam Luker.

On the day of the deadly accident, calls were made to law enforcement about a reckless driver on the road, according to the crash report. Responding officers noticed “a strong odor of an alcoholic beverage coming from the driver” and discovered “open and unopened alcohol containers in his car.”

Illegal immigration and control over the nation's borders will be one of the major issues in this fall's elections, and a key aspect of that issue is the number of people who are present in the country today - and what should be done about them. Should he win reelection, former President Donald Trump is reportedly being advised to deport almost 20 million illegal aliens, in a project similar to the United Kingdom's Rwanda policy:

The goal, the people said, is to be ready on the first day of a Trump presidency to stem the flow of migrants across the U.S.-Mexico border, unwind President Biden’s immigration agenda and lay the groundwork for what the former president has said would be the largest mass deportation in U.S. history.

Data Reveal That US Heat Wave Index, Japan Drought Coincide With Solar Activity

In 1962, Japanese meteorologist Hirohide Saito found the instability of summer temperature of Hokkaido (northern part of Japan) during the solar minimum as follows:


In 1967 Japanese meteorologist Junkichi Nemoto published the following graph, below, showing that drought in Japan occurs at the solar minimum as well as at the solar maximum. Further Nemoto showed the drought occurs with the crop failure due to the low temperature in the northern part of Japan at the solar minimum. This is coincident with Saito’s finding above showing the instability of summer temperature at the solar minimum in Hokkaido.
 
In 1988, based on the meteorological studies above, Japanese climatologist Kunihiko Kodera published the following graph showing the jet stream blocking frequency is higher at the sunspot minimum and the aa index minimum. The graph shows the highest frequency of the jet stream blocking during 1931-1936, which is coincident with the highest U.S. heat wave index and the highest burned forest area below.
