A Georgia indictment of former President Donald Trump that is expected this week could depend on a grand jury’s interpretation of an often-misreported phone call that Trump had with Secretary of State Brad Raffensperger in the aftermath of the 2020 vote.

The indictment in Fulton County would likely charge Trump and several associates with using improper pressure and methods to convince state officials to overturn the result of the 2020 presidential election in the state, through their aggressive challenges.

But while Trump is often accused of telling Raffensperger to “find me the votes,” the transcript of the conversation shows that Trump said something different: “I just want to find 11,780 votes, which is one more than we have because we won the state.”

Here we go again: another disastrous Trump indictment. It’s downright pathetic that Fulton County publicly posted the indictment on its website even before the grand jury had finished convening.

Since the four prosecutions against Trump are using novel & untested legal theories, it’s fair game for him to do the same in defense: immediately file a motion to dismiss for a constitutional due process violation for publicly issuing an indictment before the grand jury had actually signed one. He should make a strong argument on these grounds & it would send a powerful message to the ever-expansive prosecutorial police state.

As someone who’s running for President against Trump, I’d volunteer to write the amicus brief to the court myself: prosecutors should not be deciding U.S. presidential elections, and if they’re so overzealous that they commit constitutional violations, then the cases should be thrown out & they should be held accountable.

The DA's office has denied that any charges have been filed. Yet, this document appeared on the Superior Court docket.

The Grand Jury is just a formality for these Banana Republic proceedings.

The Georgia grand jury investigating former President Donald Trump’s efforts to overturn the 2020 election results in the Peach State handed up a sealed indictment Monday night.

After approximately 10 hours of hearing testimony and voting on potential charges, the bill was presented to Fulton County Superior Court Judge Robert McBurney, who signed off on the charges shortly before 9 p.m.

Hours earlier, the court clerk’s office appeared to prematurely post the potential charges Trump was facing in the case.

The prematurely posted docket included 13 counts against the 77-year-old former president, including violation of the Peach State’s anti-racketeering law, conspiracy, false statements and asking a public official to violate their oath of office.

Trump has no love for the intricacies of the law.  He should have been pushing hard for a special session of the legislature in December.  But he was too busy believing that giant rallies and sympathetic judges would secure his right position in the White House without having to do the basic footwork.

I know you like to spin things RiV, but it was basically cursing (intimidate) the Governor and Lt. Governor for not "solving this mess" (and declaring Trump the winner) by whatever means Trump could think of. Why of course is the caps of his tweet "AND WIN" (So Trump could save face).

Now I doubt anyone here doubts a lot of the mail-in votes was fraudulent and I am sure everyone here would love to weed out all vote harvesting liberals do. But (and a big Butt), you word it not as a threat/order like you own everyone.

Not true.  Jack Poso doesn't understand how things are done in Georgia.  The number of days in session is strictly limited by law.  The only way they could act is for the Governor to call a special session (which he won't do).  A good number of State Senators (led by Brandon Beech in Alpharetta) put their careers and reputations on the line by fighting for a special session back in Nov-Dec 2020.  It cost Beech his committee chairmanship.

It would have been nice to have gotten Trump support with this effort at the time.  But he was too busy sweet-talking the one guy who did more to cost him the Georgia election than anyone else.  While Beech et al. were fighting in the trenches and asking people like me to flood the Governor's office with phone calls, Trump was wasting time talking to Raffensperger.

Fulton County can also subvert an election when the person in the White House is a complete fool with no understanding of the legal process and completely deaf to the shouts from Georgia Conservatives who gave warning that this was going to happen for eight straight months before election day.  How nice it would have been to have someone from Trump's justice department challenge Raffensperger's re-writing of election laws in April 2020.

Here we go again: another disastrous Trump indictment. It’s downright pathetic that Fulton County publicly posted the indictment on its website even before the grand jury had finished convening.

Since the four prosecutions against Trump are using novel & untested legal theories, it’s fair game for him to do the same in defense: immediately file a motion to dismiss for a constitutional due process violation for publicly issuing an indictment before the grand jury had actually signed one. He should make a strong argument on these grounds & it would send a powerful message to the ever-expansive prosecutorial police state.

As someone who’s running for President against Trump, I’d volunteer to write the amicus brief to the court myself: prosecutors should not be deciding U.S. presidential elections, and if they’re so overzealous that they commit constitutional violations, then the cases should be thrown out & they should be held accountable.

The Georgia indictment against former President Donald Trump and 18 co-defendants cites Trump’s tweets as acts purportedly made “in furtherance of the conspiracy.”

On Monday, a Fulton County, Georgia, grand jury handed down a 98-page, 41-count indictment. Fulton County District Attorney Fani Willis’s nearly three-year-long investigation into Trump culminated on Monday when jurors met for approximately ten hours and then handed down the indictment.

Trump is being charged under Georgia’s RICO statute, among others, which is the same statute Willis used to bring charges against Atlanta rap star Young Thug. The RICO statute was designed to dismantle organized crime groups.

The indictment cites 12 of Trump’s tweets, and one from former New York City Mayor Rudy Giuliani, as “overt” acts made “in furtherance of the conspiracy.”

Some tweets were sent by Trump on January 6, 2021, while other posts encouraged people to watch public hearings about the allegations of voting irregularities.

Former President Donald Trump could face up to 76.5 years in state prison if he is convicted and receives the maximum sentence on all 13 counts he faces in the indictment filed by Fulton County, Georgia, District Attorney Fani Willis late Monday night.

Here are the counts:

1 – Violation of the Georgia RICO (Racketeer Influenced and Corrupt Organizations) Act, O.C.G.A. § 16-4-4(c) – up to 20 years

5 – Solicitation of Violation of Oath by Public Officer – O.C.G.A. §§ 16-4-7 & 16-10-1 – up to three years

In addition, Trump faces:

    136 years in 34 counts in the New York case, involving alleged false business records in the Stormy Daniels affair
    460 years in the 40 counts in the federal case in Miami, involving alleged mishandling of presidential documents
    55 years in 4 counts in the federal case in Washington, D.C., involving 2020 election challenges and the January 6, 2021 Capitol riot

Thus Trump could face up to 727.5 years in prison. The latter charge in D.C. also includes the possibility of the death penalty.

(b)  It shall be unlawful for any person employed by or associated with any enterprise to conduct or participate in, directly or indirectly, such enterprise through a pattern of racketeering activity.

(c)  It shall be unlawful for any person to conspire or endeavor to violate any of the provisions of subsection (a) or (b) of this Code section. A person violates this subsection when:


(1)  He or she together with one or more persons conspires to violate any of the provisions of subsection (a) or (b) of this Code section and any one or more of such persons commits any overt act to effect the object of the conspiracy; or

There is NOTHING in Sections (a) or (b) that even remotely describe the very worst of what Trump is being accused of.

The office of the clerk for the Fulton County, Ga., court system admitted to accidentally posting a “sample working document” related to former President Trump’s indictment hours before the grand jury completed its work.

The Tuesday statement came after the office blamed media outlets Monday for sharing what it called a “fictitious document.”

The docket sheet was first spotted and shared by Reuters, with reporters indicating Trump had been indicted.

It was quickly removed, however, and the clerk’s office later issued a statement saying it was a “fictitious document that has been circulated online and reported by various media outlets.” 

The charges filed against Trump on Monday night, however, were exactly those first shared by the outlet.

In a Tuesday statement, the clerk’s office said it was running a test of the system “in anticipation of issues that arise with entering a potentially large indictment,” posting a “sample working document related to the former United States President, Donald Trump.”

“Unfortunately, the sample working document led to the docketing of what appeared to be an indictment, but which was, in fact, only a fictitious docket sheet,” the office said in the statement.

“Because the media has access to documents before they are published, and while it may have appeared that something official had occurred because the document bore a case number and filing date, it did not include a signed ‘true’ or ‘no’ bill nor an official stamp with Clerk Alexander’s name, thereby making the document unofficial and a test sample only.”

Meadows trying to move Fulton County case to federal court

 Former Trump White House chief of staff Mark Meadows is seeking to move the Fulton County, Georgia, prosecution against him to federal court so that he can try to get the case dismissed under federal law, according to court filings.

In a new court filing submitted in the US District Court of the Northern District of Georgia, Meadows argued that he is entitled to bring a federal immunity defense because the Georgia state charges against him stem from his conduct as then-President Donald Trump’s chief of staff.

Meadows is one of 19 defendants, including Trump, who were charged on Monday in Fulton County in the Georgia 2020 election subversion case.

He said he intends to submit at a “later date” a more comprehensive request laying out why the case against him should be dismissed under federal law. But in the meantime, Meadows argued that the federal court should move the charges out of state court, and into federal court, effectively halting the state-level proceedings against him.

“Even if the Court is not prepared to dismiss outright at this early stage, however, justice requires granting removal and halting any further state-court proceedings against Mr. Meadows,” the filing said. “That will allow for the timely consideration of Mr. Meadows’s defenses, including his federal defense under the Supremacy Clause, without requiring him to defend himself in state court simultaneously.” .............

Trump really needs to stop using the word 'fraud'.  Seriously.  He should instead focus on the illegality of the election which is certainly provable in multiple states including Georgia.  Trump is his own worst enemy.  He could win a ground-breaking case in Georgia if he approached it as someone interested in cleaning up elections instead of one seeking some judge to declare him the winner.

Maybe. But I'll say it's a challenge.

It's tough to watch our society and a country I grew up and loved go to Hell (figuratively and literally). Oftentimes the antidote to that is to focus on what you can do, focus on your spouse and children... but when I don't even have that to look forward to, and society feels so hostile to it, it makes it even harder.

I don't understand God's plan. I get why He's doing what he's doing, but I was of the understanding that he avoided collateral damage.
